PHILRACOM RESOLUTION NO. 52-16
Excerpts from the minutes of the meeting of the Board of the Philippine Racing Commission (PHILRACOM) held on 27th July 2016 at 4th Floor Electra House Bldg., Esteban St., Makati City.
WHEREAS, Presidential Decree (PD) No. 420, as amended, vests the Commission with exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;
WHEREAS, the same law further grants the Commission the power to prescribe additional rules and regulations not otherwise inconsistent therewith and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, under PR 80 of the Rules and Regulations on Horse Racing only the jockeys and racing officials are allowed to file a motion for reconsideration on all decisions made by PHILRACOM on certain cases;
WHEREAS, the Commission deems it appropriate to repeal PR 80 to give or allow all parties or licensees of PHILRACOM an equal right to file a motion for reconsideration on all decisions or orders made by PHILRACOM;
NOW THEREFORE, BE IT RESOLVED as it is hereby RESOLVED to repeal PR 80 of Unit III, Chapter 6 of the Rules Governing the Conduct of Races, thus:
PR 80. RECONSIDERATION
A motion for reconsideration may be filed on all decisions made by the PHILRACOM in the following cases:
A. Penalties imposed on all licensees by the Board of Stewards that have been affirmed by the Commission.
B. Suspension imposed by the Commission on all licensees.
C. Monetary penalties imposed by the Commissions on all licensees: A corresponding fee of Three Thousand Pesos (Php3,000.00) or Twenty Percent (20%) of the assessed fine shall be charged, whichever is lower.
D. Penalties imposed on horses by the Board of Stewards that have been affirmed by the Commission (may be filed by the horse owner or horse trainer concerned).
E. Suspension imposed by the Commission on horses (may be filed by the horse owner or horse trainer concerned).
