PHILRACOM RESOLUTION NO. 21-16
WHEREAS, Presidential Decree No. 420 gives the Commission exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;
WHEREAS, the same law gives the Commission the power to prescribe additional rules and regulations not otherwise inconsistent therewith and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, the Board understands that failure by entries to appear for their scheduled races undermines the credibility of the races in the mind of the betting public and tarnishes the image of the industry;
NOW THEREFORE, be it RESOLVED, as it is hereby RESOLVED that Letter D of PR 75 under Chapter 7, Unit III of the Rules and Regulations Governing Horse Racing Participants, be amended as follows:
PR 75. ACTS AND/OR OMISSIONS BY HORSE OWNERS AND/OR TRAINERS AND THEIR CORRESPONDING PENALTIES
D. For failing to run his horse declared in a race without justifiable cause (non-appearance) as determined by the Board of Stewards and without notifying the latter at least four (4) races before the scheduled race, the trainer shall be given the following penalty:
1st offense — At least three (3) months suspension and/or a fine of not less than Ten Thousand Pesos (P10,000.00)
2nd offense — At least six (6) months suspension and/or a fine of not less than Twenty Thousand Pesos (P20,000.00).
Succeeding offenses — PHILRACOM discretion
RESOLVED FURTHER, that the following amendment shall be EFFECTIVE IMMEDIATELY upon publication of this Resolution on the PHILRACOM website.
