PHILRACOM RESOLUTION NO. 48-16
Excerpts from the minutes of the meeting of the Board of the Philippine Racing Commission (PHILRACOM) held on 28th June 2016 at 4th Floor Electra House Bldg., Esteban St., Makati City.
WHEREAS, Presidential Decree (PD) No. 420, as amended, vests the Commission with exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;
WHEREAS, PD No. 420 further grants the Commission the power to prescribe additional rules and regulations not otherwise inconsistent therewith and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, there are instances when horses encounter accidents immediately prior to the actual race and, consequently, resulted to horses running below their normal standard;
WHEREAS, the Commission deems it appropriate to amend the rules to address the above-described situation in order to protect the interest of the betting public, ensure safety of the jockeys and promote the welfare of horses.
NOW THEREFORE, BE IT RESOLVED as it is hereby RESOLVED to amend PR 71 of Unit III, Chapter 6 of the Rules Governing the Conduct of Races, thus:
PR 71. WITHDRAWAL OF HORSES FROM A RACE
A. Any horse withdrawn from any race due to any medical condition shall require a Veterinary Certificate to be submitted before the race or at the time of the withdrawal.
B. Any horse withdrawn from any race with a veterinary certificate shall be suspended for a period to be determined by the club veterinarian/PHILRACOM veterinarian/accredited veterinarian, Provided that the period of suspension shall not be less than seven (7) days and that the horse concerned shall be required to undergo one (1) barrier trial before it is allowed to race again.
C. Any horse withdrawn from any race without a timely veterinary certificate shall be given a minimum suspension of one (1) month and shall be required to undergo one (1) barrier trial as a requirement for declaration.
D. In case a horse falls on its back prior to the race the Board of Stewards shall declare the horse withdrawn.
E. Bets on withdrawn horses shall be subject to the existing rules on betting by the Games and Amusements Board.
F. All provisions of prior Board Resolutions that are contrary hereto or inconsistent herewith are deemed repealed or modified accordingly.
