PHILRACOM RESOLUTION NO. 02-17
Excerpts from the minutes of the Meeting of the Board of the Philippine Racing Commission (PHILRACOM) held on 25 January 2017 at 4th Floor Electra House Bldg., Esteban St., Makati City.
WHEREAS, under Presidential Decree No. 420, the Commission has exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;
WHEREAS, the Commission is also given by the said Decree the specific power, among others, to prescribe additional rules and regulations not otherwise inconsistent with it and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, the Commission received reports that a number of licensees penalized, after due notice and hearing, to pay fines only do so upon the renewal of their respective licenses.
NOW THEREFORE, be it RESOLVED as it is hereby RESOLVED that Unit II, Chapter 4 of the Rules and Regulations on Horse Racing be amended as follows:
"PR 47. PENALTIES FOR NON-PAYMENT OF FINES
The licensee shall pay all fines imposed by the Commission and/or Board of Stewards within fifteen (15) days from the receipt of the order, notice or decision directing the payment of fines. Failure to pay the fines within the given period shall have the corresponding consequences:
A. For jockeys, they shall not be eligible for declaration on the next declaration day following the expiration of the fifteen (15)-day period to pay the fine;
B. For trainers, all horses under their care shall not be accepted for declaration on the next declaration day following the expiration of the fifteen (15)-day period to pay the fine;
C. For horse owners, all horses owned by them shall not be accepted for declaration on the next declaration day following the expiration of the fifteen (15)-day period to pay the fine; and
D. For Racing Officials, they shall not be allowed to perform their duties during racing days after the expiration of the fifteen (15)-day period to pay the fine and until payment of said fine has been made."
