PHILRACOM RESOLUTION NO. 10-17
Excerpts from the minutes of the meeting of the Board of the Philippine Racing Commission (PHILRACOM) held on 15 March 2017 at 4th Floor Electra House Bldg., Esteban St., Makati City.
WHEREAS, under Presidential Decree No. 420, the Commission has exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;
WHEREAS, the Commission is also given by the said Decree the specific power, among others, to prescribe additional rules and regulations not otherwise inconsistent with it and to impose fines, penalties and forfeitures of erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, the Commission continuously reviews the Rules and Regulations on Horse Racing with the objective of making these Rules more responsive to the changing racing situation and amending the same, if necessary.
NOW THEREFORE, be it RESOLVE as it is hereby RESOLVED that the Unit II, Chapter 3 of the Rules and Regulations on Horse Racing be amended as follows:
"PR 29.F. ALLOWING A SUSPENDED JOCKEY TO RIDE AND HIS ELIGIBILITY FOR DECLARATION
A suspended jockey shall only be allowed to ride in the following instances:
1. If he has already been declared for a race prior to his suspension, provided that in the case of Stakes Races, the period between the date of his suspension and the race wherein he was previously declared shall be counted in the computation of his suspension.
2. In case the jockey has appealed his suspension, in which case, the jockey shall only serve his suspension on the day after a final ruling by the Commission upholding or modifying the penalty is made.
3. In case the scheduled race of the suspended jockey shall fall on the day after the last day of his suspension, he shall be eligible for declaration even if he is still serving his suspension on the day of the declaration.
Failure of the Handicapper to implement this provision shall mean a corresponding penalty that will be determined by the PHILRACOM Board."
