PHILRACOM RESOLUTION NO. 19-17
Excerpts from the minutes of the meeting of the Board of the Philippine Racing Commission (PHILRACOM) held on 3 May 2017 at 4th Floor Electra House Bldg., Esteban St., Makati City.
WHEREAS, under Presidential Decree No. 420, the Commission has exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing.
WHEREAS, the Commission is also given by the said Decree the specific power, among others, to prescribe additional rules and regulations not otherwise inconsistent with it and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, the Commission continuously reviews the Rules and Regulations on Horse Racing with the objective of making these Rules more responsive to the changing racing situation and amending the same, if necessary.
WHEREAS, the March 14, 2017 race meeting at the Philippine Racing Club, Inc. (PRCI) was cancelled due to the absence of the necessary link (to broadcast) with the service provider and the same resulted to loss in government revenue and prejudiced all stakeholders;
WHEREAS, the Commission, after due consultation, deems it necessary to penalize cancellation of races without justifiable cause in order to avoid any similar incidents from happening in the future.
NOW THEREFORE, be it RESOLVED as it is hereby RESOLVED that Unit II, Chapter 2 of the Rules and Regulations on Horse Racing be amended as follows:
"PR 1-B. CANCELLATION OF RACES
For cancellation of races without justifiable cause, the Racing Club shall pay a fine of not less than Five Thousand Pesos (P5,000) and not more than (P50,000) after due notice and hearing. In case the cause for the cancellation of races is not resolved before the drawing of lots for the next scheduled racing day, PHILRACOM may re-assign said scheduled racing day to the other racing clubs."
RESOLVED FURTHER, that all orders, resolutions and rules that are contrary hereto or inconsistent herewith are deemed repealed or modified accordingly.
