PROPOSED PROCLAMATION EXCLUDING FROM THE OPERATIONS OF PROCLAMATION NO. 39, SERIES OF 1920 WHICH ESTABLISHED THE MOUNTAIN NATIONAL AGRICULTURAL SCHOOL (NOW BENGUET STATE UNIVERSITY) CERTAIN PORTION OF THE LAND EMBRACED THEREIN AND DECLARING THE SAME AS ALIENABLE AND DISPOSABLE FOR RELOCATION SITE PURPOSES OF THE VICTIMS OF TYPHOON PEPENG IN LA TRINIDAD, BENGUET AND GRANT AND GRANTING OWNERSHIP THEREOF IN FAVOR OF THE GOVERNMENT OF LA TRINIDAD
Upon the recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby exclude from the operation of Proclamation No. 20, Series of 1920, which established the Mountain National Agricultural School, now Benguet State University, situated in the Municipality of La Trinidad, Province of Benguet, Island of Luzon, certain parcels of land embraced therein and declaring the same as alienable and disposable for relocation site purposes of the victims of typhoon "Pepeng" in La Trinidad, Benguet, and granting ownership thereof in favor of the Municipal Government of La Trinidad, subject to private rights, if any there be, which parcels of land are more particularly described as follows: HEAcDC

Bounded on the SW., W., NW., NE., and SE., along line 1-2-3-4-5-6-7-8-9-10-11-1 by Lot 10, Swo-01-02-00001 (Lot 3, Swo-01-02-00001, Amd.).

The development of the area herein reserved for relocation site purposes is subject to the following conditions:
1. Final development should be confined on the ridge and engineering measures to protect the slope adjoining the creek/gully must be put in place;
2. Proper drainage lay-out must be in place to ensure minimal contact of water with the underlying limestone; and
3. As the area is moderately sloping, light structures are recommended to protect the slope stability.
The disposition of the land herein reserved is subject to repayment by the beneficiaries following the provisions of R.A. 7279 otherwise known as the Urban and Housing Development Act.
The Secretary of the Department of Environment and Natural Resources is hereby authorized to issue Special Patent in favor of the Municipal Government of La Trinidad, Benguet. aDcTHE
This Proclamation is subject to the minimum road right of way requirements of the Department of Public Works and Highways pursuant to E.O. No. 621.
