Excluding from the Mariquina Watershed Reservation Certain Parcels of Land Embraced Therein

PRESIDENTIAL DECREE NO. 324

EXCLUDING FROM THE MARIQUINA WATERSHED RESERVATION UNDER THE ADMINISTRATION OF THE FORMER NATIONAL WATERWORKS AND SEWERAGE AUTHORITY, NOW METROPOLITAN WATERWORKS AND SEWERAGE SYSTEM, CERTAIN PARCELS OF LAND EMBRACED THEREIN AND OPENING THE SAME TO EXPLOITATION UNDER THE PROVISIONS OF THE PUBLIC LAND ACT

WHEREAS, the Government has embarked on a program of increased agricultural production in order to improve and augment the stock of food necessary for our expanding population;

WHEREAS, certain parcels of land in the municipalities of Teresa and Baras, province of Rizal, have been reserved for watershed purposes under Executive Order No. 33, dated July 26, 1904, as amended by Executive Order Nos. 14 and 16, both series of 1915, known as the Mariquina Watershed Reservation;

WHEREAS, certain portions of said reservation are more suited to agricultural and woodland purposes and are partly developed for such ends;

WHEREAS, investigation conducted by the Bureau of Lands disclosed that the said portions could be excluded from the reservation without in the least impairing the effectiveness of the watershed; and

WHEREAS, it will be in the best interest of the agricultural economy of the country if the said parcels of land are excluded from the watershed reservation and declared open to disposition under the provisions of the Public Land Act;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines and pursuant to Proclamation No. 1081 dated September 21, 1972, General Order No. 1 dated September 22, 1972, and the provisions of Republic Act No. 3092, do hereby decree and exclude from the operation of the Mariquina Watershed Reservation established under Executive Order No. 33 dated July 26, 1904, as amended by Executive Order Nos. 14 and 16, both series of 1915, certain portion of land embraced therein and open the same for exploitation under the provisions of the Public Land Act, subject to private rights, if any there be, which parcel of land is more particularly described as follows: casia

"A parcel of land (being a portion of plan In-12, L.R.C. Record No. ____), situated in the Barrios of Pinugay and Kayumbay, Municipalities of Teresa and Baras, Province of Rizal. Bounded on the W., along line 1-2 by property of M.R. Mountain Resort Inc. Lot 1 and MILESTONE FARMS INC. Lot C (LRC) Psd-24882, on the NW., and W., along lines 2-3-4-5 by property of JOMEL DEVELOPMENT CORPORATION and Foremost Farm; on the N., along line 5-6 by Public Land; on the E., along line 6-7-8 by property of Jose Jose et al (Lot II-B (LRC) Psd-25839); along line 8-9-10 by Lot 10, Psu-103291; along lines 10-11-12-13 by property of Kayumbay Non-Christian Reservation; on the S., along lines 13-14-15 by property of Philcomsat; on the SW., along lines 15-16-1 by property of Calaxio Agro-Industrial Corp. (Lot 8-B (LRC) Psd-17939). Beginning at a point marked "1" on plan, being S. 49 deg. 54' E., 2272.19 m. from B.L.L.M. No. 1, Montalban, Rizal;

thence N. 51 deg. 54' W., 2120.73 m. to point 2; thence N. 47 deg. 28' W., 500.72 m. to point 3; thence No. 10 deg. 28' W., 3300.00 m. to point 4; thence N. 6 deg. 10' E., 1200.00 m. to point 5; thence S. 78 deg. 47' E., 2730.95 m. to point 6; thence S. 45 deg. 44' W., 872.24 m. to point 7; thence S. 11 deg. 35' E., 2196.50 m. to point 8; thence S. 11 deg. 13' E., 1454.37 m. to point 9; thence S. 11 deg. 13' E., 394.14 m. to point 10; thence S. 10 deg. 28' E., 406.14 m. to point 11; thence S. 53 deg. 30' E., 2282.03 m. to point 12; thence S. 26 deg 30' E., 1340.00 m. to point 13; thence WEST 1400.00 m. to point 14; thence N. 84 deg. 49' W., 753.87 m. to point 15; thence N. 51 deg. 54' W., 1407.29 m. to point of beginning; containing an area of seventeen million two hundred eighty seven thousand four hundred sixty (17,287,460 or 1,728,7460 has.) square meters. All points referred to are indicated on the plan and marked on ground as follows: points 6, 7, 8, by Old PLS Cyl. Mons; point 16, by Masungit rock; and the rest by P.S. Cyl. Conc. Mons.; bearing true; date of preparation, June 10-15, 1973."

NOTE: These data are subject to future survey and verification on the ground.

This Decree shall take effect immediately.
