DELEGATING TO THE INTER-AGENCY TECHNICAL WORKING GROUP OF THE GOVERNMENT PROCUREMENT POLICY BOARD THE AUTHORITY TO REVIEW AND APPROVE THE LOCAL GOVERNMENT PROCUREMENT MANUALS
WHEREAS, Section 63 of Republic Act (R.A.) No. 9184, otherwise known as the "Government Procurement Reform Act" and Section 63.1 of its Implementing Rules and Regulations Part A (IRR-A) mandate the GPPB to formulate and amend public procurement policies, rules and regulations, and amend, whenever necessary, the IRR-A; aIEDAC
WHEREAS, Section 6 of R.A. 9184 provides that to systematize the procurement process, avoid confusion and ensure transparency, the Government Procurement Policy Board (GPPB) shall pursue the development of generic procurement manuals and standard bidding forms for mandatory use by all government agencies;
WHEREAS, there have been many requests for the GPPB to issue a procurement manual which is more adaptable to the local government setting;
WHEREAS, the issuance of a Local Government Procurement Manual, which takes into consideration the salient provisions of the Local Government Code (R.A. 7160), including local budget and finance guidelines by the Department of Budget and Management and Department of Finance, will provide better guidance to local governments and hopefully improve their compliance with R.A. 9184 and its IRR-A;
WHEREAS, the preparation and finalization of the Local Government Procurement Manuals is supported by a technical assistance from the Asian Development Bank (ADB) which terminates on 30 November 2007;
WHEREAS, approval of the Local Government Procurement Manual by the GPPB is a condition for the completion of the technical assistance;
WHEREAS, for purposes of expediency, the GPPB-Technical Support Office recommends that authority be delegated to the Inter-Agency Technical Working Group of the GPPB to review and approve the Local Government Procurement Manuals in time for the closing of ADB's technical assistance;
NOW, THEREFORE, for and in view of all the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to delegate to the Inter-Agency Technical Working Group of the GPPB the authority to REVIEW and thereafter APPROVE the LOCAL GOVERNMENT PROCUREMENT MANUALS.
This resolution shall take effect immediately.
