GPPB RESOLUTION NO. 30-07
APPROVING AND ADOPTING THE LOCAL GOVERNMENT PROCUREMENT MANUAL
WHEREAS, Republic Act No. 9184 (RA 9184) entitled "An Act Providing for the Modernization, Standardization and Regulation of the Procurement Activities of the Government and for Other Purposes" was enacted into law on 10 January 2003 and took effect fifteen (15) days after its publication or on 26 January 2003; TCIEcH
WHEREAS, Section 63 of RA 9184 and 63.1 of its Implementing Rules and Regulations (IRR-A) mandate the GPPB to formulate and amend public procurement policies, rules and regulations, and amend, whenever necessary, the IRR-A;
WHEREAS, numerous requests have been received by the GPPB Technical Support Office (GPPB-TSO) from various local government units (LGU) for the development of a procurement manual which will be more responsive and specifically adaptable to the local government setting;
WHEREAS, in response to the appeal made by the LGUs, technical assistance from the Asian Development Bank was sought for the purpose of drafting a procurement manual for the specific use of local government units; cDCEHa
WHEREAS, in the drafting of the LGU Procurement Manual the salient provisions of the Local Government Code, including the local budget and finance guidelines by the Department of Budget and Management were considered to ensure the LGUs' compliance with RA 9184 and its IRR-A;
WHEREAS, the GPPB, through Resolution No. 26-2007 delegated to its Inter-Agency Technical Working Group (IATWG) the authority to review and thereafter approve the Local Government Procurement Manual;
WHEREAS, the IATWG during its 11th regular meeting, held last 16 November 2007, duly reviewed and approved the Local Government Procurement Manual, subject to certain revisions;
WHEREAS, a final presentation of the LGU Procurement Manual for local government units was made last 22-23 November 2007 in Panglao, Bohol; DCcHIS
NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to approve and adopt, as WE hereby approve and adopt the Local Government Procurement Manual for adoption and official use of local governments, specifically, provinces, cities, and municipalities.
This resolution shall be effective a day after its publication.
