GPPB RESOLUTION NO. 10-14
APPROVING AND ADOPTING THE LOCAL GOVERNMENT PROCUREMENT MANUAL (LGPM)
WHEREAS, Republic Act (RA) No. 9184 entitled "An Act Providing for the Modernization, Standardization and Regulation of the Procurement Activities of the Government and for Other Purposes," took effect on 26 January 2003, while its revised Implementing Rules and Regulations (IRR) took effect on 2 September 2009;
WHEREAS, Section 6 of RA 9184 and its IRR provide that to systematize the procurement process, avoid confusion and ensure transparency, the GPPB shall pursue the development and approval of generic procurement manuals and standard bidding documents and forms including those to be used for major procurement like drugs and textbooks. Once issued by the GPPB, the use of the Generic Procurement Manuals (GPMs), Philippine Bidding Documents (PBDs), and other standard forms shall be mandatory upon Procuring Entities (PEs). However, whenever necessary, to suit the particular needs of the PE, modifications may be made, particularly for major specialized procurement, subject to the approval of the GPPB;
WHEREAS, pursuant to Sections 63 (b) and (c) of the IRR of RA 9184, the GPPB is mandated to formulate and amend public procurement policies, rules and regulations, and amend the IRR, whenever necessary, and prepare a generic procurement manual and standard bidding forms for procurement;
WHEREAS, the GPPB approved and adopted the GPM through GPPB Resolution No. 13-2006 dated 14 June 2006 for adoption and official use of all branches, agencies, departments, bureaus, offices and instrumentalities of the Government, including government-owned and/or controlled corporations (GOCCs), government financial institutions (GFIs), state universities and colleges (SUCs), and local government units (LGUs), as a reference guide in the conduct of its actual procurement operations effective January 2007;
WHEREAS, the GPPB approved and adopted the LGPM, which was patterned after the GPM, through GPPB Resolution No. 30-2007 dated 29 November 2007, for adoption and official use of local government units, that is, provinces, cities, and municipalities. The LGPM was supported by the Asian Development Bank (ADB) and the World Bank (WB) in March 2008 through the harmonization of applicable procurement rules for ADB and WB funded projects;
WHEREAS, the LGPM has not been updated to reflect the changes in the revised IRR of RA 9184 issued on 2 September 2009;
WHEREAS, several amendments to the IRR of RA 9184 as well as Resolutions, Guidelines, and Circulars issued after 2 September 2009 also need to be incorporated in the LGPM.
WHEREAS, a Technical Working Group (TWG) on the revision of the LGPM, consisting of officials/representatives from the Department of Interior and Local Government (DILG), GPPB-Technical Support Office (GPPB-TSO), Leagues of Provinces, Municipalities, and Cities, ADB, Japan International Cooperation Agency (JICA), and WB was created in October 2013.
WHEREAS, several consultation meetings among the members of the TWG on the LGPM revision and representatives from the Leagues of Provinces, Municipalities, and Cities, and LGUs in Mindanao (Municipality of Panabo, Davao del Norte, and Barangays) were conducted to hear the comments of LGUs on the need to update the LGPM;
WHEREAS, during the 2nd Regular Meeting held on 13 May 2014, the salient features and amendments to the LGPM were presented to the members of the GPPB Inter-Agency Technical Working Group (IATWG), which recommended the approval and adoption of the revised LGPM by the GPPB;
WHEREAS, during its 3rd Regular Meeting held on 23 May 2014, the GPPB discussed and deliberated on the approval and adoption of the revised LGPM for official use of local government units, that is, provinces, cities, and municipalities;
NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on Us by law, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the revised Local Government Procurement Manual for adoption and official use of local government units, that is, provinces, cities, and municipalities.
This resolution shall take effect immediately.
