RESERVING FOR SLUM IMPROVEMENT AND RESETTLEMENT (SIR) PROGRAM PURPOSES OF THE CITY OF DAVAO AND FOR PARK AND PLAYGROUND PURPOSES CERTAIN PARCELS OF LAND OF THE PUBLIC DOMAIN SITUATED IN THE FORESHORE AREA OF PIAPI DISTRICT, POBLACION, CITY OF DAVAO, AND THEREBY AMENDING PROCLAMATION NO. 275 DATED MARCH 17, 1956

WHEREAS, the Government is committed to the proposition that human settlements is an integrated concept embracing the interdependence of man's environment, shelter and structure, and the design and organization of human communities consistent with national framework plan, to attain the people's well being;

WHEREAS, Letter of Instructions No. 555 dated June 11, 1977 mandated a nationwide Slum Improvement and Resettlement Program and Letter of Instructions No. 557 of the same date adopts slum improvement as a National Housing Policy and a recognized approach to meet the housing needs of the country and the primary strategy in dealing with slums and squatter areas and other blighted communities in urban center;

WHEREAS, the City of Davao as an identified regional growth center in Region XI, has promulgated and adopted a slum improvement and resettlement program for all the slum and squatter areas within its territorial jurisdiction;

WHEREAS, certain disposable parcels of public land also situated in the foreshore area of Piapi District, Davao City, were chosen, among others within the area, by the City Government of Davao with the conformity of the National Housing Authority as most suitable and ideal site for the establishment of a slum improvement and resettlement project in the area;

WHEREAS, certain parcels of land of the public domain located at Piapi District, Davao City, which have been reserved for park and playground purposes under Proclamation No. 275 dated March 17, 1956, have been effectively occupied and inhabited for the last thirty (30) years by marginal income families in communities that have developed into slums which have been identified as a slum improvement and resettlement project for the Slum Improvement and Resettlement Program of Davao City, with the conformity of the National Housing Authority; and

WHEREAS, in or about the immediate vicinity of the said parcels of land, are several uninhabited parcels of land of the public domain which can be utilized and reserved for park and playground purposes as integral components of the said slum improvement and resettlement projects;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby withdraw from sales and resettlement and reserve for slum improvement and resettlement project under the administration and disposition of the City of Davao, subject to private rights, if any there be, Lot 1, Lot 2, and consolidated Lots 1, 2, 5, 475-B, 475-C, 475-E, 475-G, 475-H, 475-I, and 70-B-9 (Davao Townsite), and for park and playground purposes also under the administration of the City of Davao, Lot 3 and Lot 4, all of the public domain and situated in the foreshore area of Piapi District, Poblacion, City of Davao, which parcels of land are more particularly described as follows:

Proclamation No. 275 dated March 17, 1956 which reserved certain parcels of land of the public domain for park and playground purposes is hereby amended to delete therefrom the above-described consolidated Lots 1, 2, 5, 475-B, 475-C, 475-E, 475-G, 475-H, 475-I and 70-B-9 (Davao Townsite).

The Proclamation is subject to the condition that the free patent applicants occupying portions of the above-mentioned parcels of land, if any, shall be compensated for the value of their respective portions and existing improvements thereon. prcd

In order to facilitate the early development of the area for slum improvement and resettlement program purposes, the City of Davao, in coordination with the Bureau of Lands, is hereby ordered to immediately conduct the necessary subdivision survey of the same into appropriate homelots, roadlots and other lots for public purposes. The City of Davao is hereby given the authority to develop and administer the disposition of these lots in accordance with the guidelines of the Slum Improvement and Resettlement Program.
