PROCLAMATION NO. 2115

RESERVING FOR SLUM IMPROVEMENT AND RESETTLEMENT (SIR) PROGRAM OF THE CITY OF DAVAO A CERTAIN PARCEL OF LAND OF THE PUBLIC DOMAIN SITUATED IN THE CITY OF DAVAO, ISLAND OF MINDANAO

WHEREAS, the Government is committed to the proposition that human settlements is an integrated concept embracing the interdependence of man's environment, shelter and structure, and the design and organization of human communities consistent with a national framework plan, to attain the people's well being;

WHEREAS, Letter of Instructions No. 555 dated June 11, 1977 mandates a nationwide Slum Improvement and Resettlement Program and Letter of Instructions No. 557 of the same date adopts slum improvement as a National Housing policy and recognized approach to meet the housing needs of the country and the primary strategy in dealing with slums, squatter areas and other blighted communities in urban centers;

WHEREAS, the City of Davao is an identified regional growth center in Region XI and has formulated and adopted a slum improvement and resettlement program for all the slum and squatter areas within its territorial jurisdiction; and cdt

WHEREAS, a certain disposal public land situated in New Matina, Talomo, Davao City was chosen by the City Government of Davao with the conformity of the National Housing Authority as the most suitable and ideal site for the establishment of its slum improvement and resettlement pilot project;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby withdraw from the sale of settlement and reserve for slum improvement and resettlement project under the administration of the City of Davao, a certain parcel of land of the public domain situated at New Matina, Talomo District, City of Davao, Island of Mindanao, which parcel is more particularly described as follows:

A parcel of land (accredited land-formerly portion of Davao River), situated in the Barrio of Matina, Talomo District, City of Davao, Island of Mindanao. Bounded on the N., along line 1-2 by Lot 395, Cad-102 and Lot C, Pcs.-21993 TCT No. 57306); along line 2-3-4 by lot C, Pcs.-21993 TCT No. 57306); and Lot B, Pcs-21993 (TCT No. 57305); along line 4-5 by Lot A, Pcs-21993 (TCT No. 57304); along line 5-6 by Lot 397, B-2-B-1 (TCT No. 19077); on the NE., E., and SE., along lines 6-7-8-9- 10-11-12-13-14-15-16 by Davao River; and on the W., along lines 16-17-1 by Lot 395, Cad-102.

Beginning at a point marked "1" on Plan, being S. 15 deg. 25'W., 907.73 m. from Mon. No. 22, Davao Townsite thence:

Containing an area of One Hundred One Thousand Nine Hundred and Ninety-One (101,991) square meters, more or less. All points referred to are indicated on the plan and are marked on the ground as follows: Points 1, 2, 3, 4, 5, 6, 16 and 17 by Old Points, and the rest by Stakes. Bearing true. This survey was executed in accordance with law and existing regulations promulgated thereunder, by the Bureau of Lands.

This proclamation is subject to the condition that the free patent applicants occupying portions of the above-described parcel of land shall be compensated for the value of their respective portions and existing improvement thereon.
