PHILRACOM RESOLUTION NO. 70-15
WHEREAS, Presidential Decree No. 420 gives the Commission exclusive jurisdiction and control over all aspects of the conduct of horse racing, including the framing and scheduling of races, the construction and safety of horse racing, the allocation of prizes, and the security of racing;
WHEREAS, the same law gives the Commission the power to prescribe additional rules and regulations not otherwise inconsistent therewith and to impose fines, penalties and forfeitures to erring parties under the rules and regulations of the Commission, which fines, penalties and forfeitures shall accrue to the funds of the Commission;
WHEREAS, PR 69 of the Philracom Rules and Regulations on Horse Racing imposes penalty on horses that run below their normal standard and usual pattern of racing or perform a disappointing run;
WHEREAS, upon consultation with the Board of Stewards of the different racing clubs it was agreed upon to further amend PR 69;
NOW THEREFORE, the Commission RESOLVES, as it is hereby RESOLVED that P.R. 69 be further amended as follows:
"PR 69. Disappointing Run
All horses that run below their normal standard and usual pattern of racing, or perform a disappointing run, shall carry a minimum suspension of forty eight (48) or a maximum suspension of seventy two (72) racing days. Horses suspended under this rule shall retain their handicap weight and grouping. This rule shall not cover horses running under the Maiden races.
The Board of Stewards shall take the following into consideration before making a decision:
A. Time difference of two (2) seconds or more from the immediate previous outing;
B. Must have run within a period of twenty-one (21) days immediately preceding the race.
The Board of Stewards shall order the immediate examination of the horse after the race by both the PHILRACOM veterinarian and club veterinarian."
RESOLVED FURTHER, that this resolution repeals the previous resolution regarding this rule; CAIHTE
