NAPOLCOM MEMORANDUM CIRCULAR NO. 08-11

AMENDING SECTION 3, PARAGRAPH (b) (1) OF NAPOLCOM MEMORANDUM CIRCULAR NO. 2007-007 ENTITLED "RULES, POLICIES, PROCEDURES AND GUIDELINES IN THE ESTABLISHMENT OF SENIORITY LINEAL LIST (SLL) FOR POLICE COMMISSIONED OFFICERS (PCOs)"

WHEREAS, the Commission issued Memorandum Circular No. 2007-007 which provides the rules, policies and guidelines in the establishment of Seniority Lineal List (SLL) for Police Commissioned Officers (PCOs); HTcADC

WHEREAS, the SLL serves as a principal reference in determining the zone of consideration in the promotion, assignment and designation to positions of responsibility of PCOs.

WHEREAS, Section 3, paragraph (b) (1) thereof provides for the significant data on the PCO's background and qualifications in establishing the relative seniority according to chronological importance, which is quoted hereunder:

"b. Criteria in Determining Seniority

1) X x x

a) Status of present appointment or rank;

b) Date appointed to present rank (original or promotional);

c) Date appointed in previous rank;

d) Date appointed as Commissioned Officer in the AFP, INP or PNP;

e) Date entered the Military or Police Service (as Cadet/EP/INP/PNCO); and

f) Order of Merit/Ranking upon Commissionship or entry into the police service."

WHEREAS, the PNP submitted for consideration of the Commission proposed amendments to the said Memorandum Circular in view of the defects noted in the abovecited provisions particularly on the following items:

d) Date appointed as Commissioned Officer in the AFP, INP or PNP

 PMA/PNPA graduates whose graduation was delayed by one (1) year or more when they were cadets were unduly benefited. This is so because they are listed ahead of the original members of their class especially those who ranked higher than them in the graduation merit roll which should have been the primary basis in determining their rank in the SLL.

e) Date entered the Military or Police Service (as Cadet/EP/INP/PNCO)

 The words used create confusion because there were officers in the AFP who were commissioned as officers in the Reserve Force but were call-to-active duty at a later date or year. The basis of officer service shall be the date when the AFP Reserve Officer was called-to-active duty and not the date he or she was commissioned in the AFP Reserve Force.

WHEREAS, after consideration of the said amendments, the Commission finds the same to be in order;

NOW, THEREFORE, the Commission in the exercise of its constitutional mandate to administer and control the PNP, HAS RESOLVED TO AMEND, AS IT HEREBY AMENDS, Section 3, paragraph (b) (1) of NAPOLCOM Memorandum Circular No. 2007-007 to read as follows:

"b. Criteria in Determining Seniority

1. The following significant data on the PCO's background and qualifications shall be the criteria in establishing the relative seniority according to their chronological importance:

a) Status of present appointment or rank;

b) Date appointed to present rank (original or promotional);

c) Date appointed in previous rank;

d) Date appointed as Police Commissioned Officer (PNP and INP) or called-to-active duty as officer in the AFP and; DETACa

e) Order of Merit/Ranking upon Commissionship or entry into the police service."
