NAPOLCOM MEMORANDUM CIRCULAR NO. 15-98

AMENDING NAPOLCOM MEMORANDUM CIRCULAR NO. 98-02, DATED JANUARY 2, 1998, ENTITLED "GUIDELINES IN THE MANNER OF PROMOTION AND ASSIGNMENT OF PNP PERSONNEL"

WHEREAS, the Commission in the exercise of its administration and control functions over the Philippine National Police (PNP), had issued Memorandum Circular No. 98-02, defining the extent of its authority on PNP personnel actions, such as appointment, promotion, assignment, and re-assignment, the procedural guidelines of which are embodied in NAPOLCOM Memorandum Circular No. 98-07;

WHEREAS, the Chief, PNP, in a communication dated October 12, 1998 to the Commission, requests that the aforementioned Circular be amended "to suit present practical conditions to make the PNP more effective and efficient," especially with the enactment of RA No. 8551, otherwise known as the "Philippine National Police Reform and Reorganization Act of 1998";

WHEREAS, the Commission views the appeal of the Chief, PNP as impressed with merit;

NOW THEREFORE, the Commission, concomitant to its Constitutional mandate to administer and control the PNP, has resolved to amend, as it hereby amends, the provisions of NAPOLCOM Memorandum Circular No. 98-02, dated January 2, 1998, to read as follows:

1. The personnel action of Appointment or Promotion shall be effected in the following manner:

a. Police Officer 1 to Senior Police Officer IV — Appointed or promoted by the PNP Regional Director for regional personnel, or by the Chief, PNP, for national headquarters personnel, subject to endorsement by NAPOLCOM, and attestation by the Civil Service Commission.

 The personnel action required at the regional level from the Commission is hereby delegated to the NAPOLCOM Regional Directors concerned.

b. Inspector to Superintendent — Appointed or promoted by the Chief, PNP, as recommended by their immediate superiors, and passed by their respective Promotions Board subject to endorsement by the NAPOLCOM en banc, and attestation by the Civil Service Commission.

c. Senior Superintendent to Deputy Director General. — Appointed or promoted by the President upon recommendation of the Chief, PNP, and of the NAPOLCOM en banc, and proper endorsement by the Chairman of the Civil Service Commission.

d. Director General — Appointed or promoted by the President from among the senior officers down to the rank of Chief Superintendent in the service, on recommendation or endorsement by the NAPOLCOM en banc.

2. The assignment or designation of PNP Provincial Directors and Chiefs of Police shall be effected in accordance with the procedure prescribed under Section 51, RA No. 6975, as amended. The guidelines set forth in NAPOLCOM Memorandum Circulars Nos. 93-13 dated September 7, 1993 and 94-009 dated March 2, 1994, relative thereto must be strictly observed.

3. The assignment, reassignment or transfer of all PNP officers to positions calling for the rank of Senior Superintendent and higher shall be subject to prior recommendation and/or approval by the Commission, except when such personnel action is so directed by the President, in which case, the same shall be implemented forthwith with notice to the NAPOLCOM.

All other NAPOLCOM issuances, or portions thereof, contrary to, or inconsistent with, this Circular are hereby modified or repealed accordingly.

This Memorandum Circular shall take effect immediately.
