SUPREME COURT MEMORANDUM ORDER NO. 46-10

REORGANIZING THE SUB-COMMITTEE ON COMMERCIAL COURTS

WHEREAS, the enactment of RA 10142 1 (Financial Rehabilitation and Insolvency Act (FRIA) of 2010) has substantial implications on the 2008 Rules of Procedure on Corporate Rehabilitation promulgated by the Supreme Court on December 2, 2008;

WHEREAS, there is a need to revise and/or amend the Rules of Procedure on Corporate Rehabilitation in order to incorporate significant changes in corporate rehabilitation and insolvency proceedings brought about by the enactment of RA 10142;

WHEREAS, RA 10142 recognizes the power of the Supreme Court to promulgate rules of procedure that will govern the proceedings under the said law;

WHEREAS, there is a need to reorganize the Sub-Committee on Commercial Courts in view of the retirement, resignation, promotion and appointment of some justices, judges, officials and employees of the judiciary.

NOW, THEREFORE, the Sub-Committee on Commercial Courts is hereby reorganized as follows: ITSacC

The Chairperson, Members, Secretary and members of the Secretariat of the above Sub-Committee, including those who have rendered service as part of the said Sub-Committee prior to the issuance of this Memorandum Order, shall receive the usual expense allowances.

This Memorandum Order shall take effect upon its issuance this 30th day of September 2010.
