Notarization of Affidavits of Service of Private Courier for the Case Decongestion Activity

OCA CIRCULAR NO. 148-13

 

WHEREAS, in a Resolution dated 16 April 2013 in A.M. No. 13-04-11-SC, the Supreme Court approved the full roll out of the Case Decongestion Activity implemented by The Asia Foundation (TAF) "in courts with more than 500 cases on their dockets";

WHEREAS, in 17 July 2013, the Case Decongestion Activity was formally launched in the Quezon City Hall of Justice with the Quezon City trial courts as pilot courts for the said project;

WHEREAS, one of the causes of case congestion and delay is the failure to efficiently serve judgments, resolutions, orders, notices and other papers emanating from the court; caADIC

WHEREAS, to speed up the decongestion of courts involved in the Case Decongestion Activity, TAF has engaged the services of LBC Express Inc. (LBC), a private courier service company, to personally serve court processes.

NOW THEREFORE, in the interest of justice, all clerks of court in all judicial regions are hereby authorized and directed to notarize, without additional fees, the necessary Affidavits of Service to be executed by individual servers from the LBC, in relation to the service of court processes covered by the Case Decongestion Activity.
