Quoted hereunder, for your information, is a resolution of the Court En Banc dated 28 September 2004
A.M. No. 03-05-03 SC — Declaring the Formal Organization of the Court of Appeals Three Divisions in Cebu City and Three Divisions in Cagayan de Oro City and For Other Purposes
On September 10, 2004, the Presiding Justice of the Court of Appeals (CA), Hon. Cancio C. Garcia, requested the upgrading of the salary, rank and privileges of the six Division Clerks of Court (DCCs) and two Assistant Clerks of Court (ACCs) in Cebu and Cagayan de Oro City to the same level as those stationed in Manila.
Per our en banc resolution dated August 25, 1999 (A.M. No. 99-5-18-SC), we upgraded the CA's original 17 positions of Executive Clerks of Court from Executive Clerk of Court II with salary grade (SG) 27 to Executive Clerk of Court III with salary grade (SG) 28, thereby giving them the rank, salary and privileges of a Metropolitan Trial Court Judge.
In the interest of justice and equity, and considering that the eight Executive Clerks of Court III, consisting of two Assistant Clerks of Court (ACCs) and six Division Clerks of Court (DCCs), who will be assigned to Cebu City and Cagayan de Oro City will be performing the same functions as their counterparts in the Court of Appeals in Manila, we hereby GRANT the request.
WHEREFORE, it is hereby ordered that the same rank, salary and privileges accorded to the Court of Appeals' Division Clerks of Court in Manila be extended to its Division Clerks of Court and Assistant Clerks of Court in the cities of Cebu and Cagayan de Oro. EcICDT
