OCA CIRCULAR NO. 240-2022

| SUBJECT | : | Filling up of the Maintenance Unit of the Halls of Justice |
This is to authorize the filling up of the vacant positions in the Maintenance Unit (MU) in all Halls of Justice owned and/or maintained by the Supreme Court.
The primary function of the MU is to take charge and perform all works in connection with the preventive maintenance and minor repairs of the Halls of Justice owned and/or maintained by the Supreme Court.
The staffing pattern of the MU has been reorganized 1 and the Qualification Standards have been amended, in order that Halls of Justice may be properly maintained by a complement of qualified personnel.
Staffing Pattern
The staffing pattern of the MU for each hall of justice varies depending on the number of courts and offices housed thereat, among others.
The effectivity of the amendment of the staffing pattern shall be DEFERRED for the affected positions with incumbent personnel until the said positions shall become vacant by reason of non-renewal of casual appointment, resignation, retirement or death.
Thus, the employment of the following incumbent personnel whose positions are affected by the amendment shall CONTINUE, to wit:
a) All personnel holding Utility Worker II and Clerk II positions, unless their service is discontinued on the grounds of non-renewal of casual appointment, resignation, retirement or death; and
b) All Construction Maintenance General Foreman in Halls of Justice with two (2) to four (4) courtrooms, unless their service is discontinued on the grounds of non-renewal of casual appointment, resignation, retirement or death.
Qualification Standards
The Qualification Standards for the MU personnel under the new staffing pattern are as follows, to wit:

Procedure in Hiring of Personnel in the
The procedures in filling up the vacant positions under the new staffing pattern in the MU of the Halls of Justice shall be as follows:
1. Considering that the staffing pattern for the different Halls of Justice varies, the Executive Judge of the multi-sala Regional Trial Courts or the Presiding Judge of the single-sala court in SC owned or maintained Hall of Justice shall send a request for the staffing pattern or list of the MU personnel to the Office on Halls of Justice, Office of the Court Administrator (OHJ-OCA) through electronic mail at [email protected]. The request shall be accompanied by the following information:
a) Name and position of current MU personnel in the Hall of Justice; and
b) List of the courts and offices housed in the Halls of Justice.
2. Upon receipt of the notification or reply from the OHJ-OCA, the Executive Judge/Presiding Judge shall post the Notice of Vacant Position/s in the Maintenance Unit of the Hall of Justice in at least three (3) conspicuous places in the premises of the Hall of Justice for a period of at least ten (10) calendar days, indicating therein the Qualification Standards for the position/s, list of documentary requirements and the deadline for the submission of applications with the Office of the Clerk of Court (multi-sala station) and/or Presiding Judge (single-sala station).
The list of documentary requirements are as follows:
a) Application Letter specifying the position applied for
b) Latest and duly accomplished (notarized) Personal Data Sheet (CS Form 212, Rev. 2017)
c) Official Transcript of Records (certified by the school Registrar) or Any Proof of Completion of Required Educational Attainment (certified by the school)
d) Certificate of Previous Employment and/or Certification by the Applicant as to his/her Relevant Work Experience
e) Certified True Copy 2 of the Certificate of Training
f) Authenticated Certificate of Required Eligibility
g) Performance Rating for the last 2 rating periods (if applicable)
3. Within ten (10) working days from the deadline of the submission of the application/s, and after evaluation of the same, the Executive Judge/Presiding Judge shall forward to the OHJ-OCA, via private courier, the recommendation letter in favor the qualified and chosen applicant for the vacant position, together with the complete documentary requirements, and Certification by the Executive Judge/Presiding Judge that the Notice of Vacant Positions in the Maintenance Unit of the Hall of Justice had been posted in at least three (3) conspicuous places in the premises of the hall of justice for a period of at least ten (10) calendar days.
While the application and documents of the other applicants need not be submitted, a comparative table summarizing the names, education, experience, training, and eligibility of all other applicants for the position/s should be appended to the recommendation letter.
If no application was submitted during the given 10-calendar day period, the Executive Judge/Presiding Judge shall immediately repost the Notice of Vacant Positions. In such event, the concerned Executive Judge/Presiding Judge shall notify the OHJ-OCA of such reposting.
4. If it is determined that the procedures were complied with and that the recommended applicant meets the minimum qualifications for the position applied for and the complete documentary requirements have been submitted, the OHJ-OCA shall indorse to the Office of Administrative Services, Office of the Court Administrator all the documents for the processing of the appointment within three (3) calendar days from receipt of the recommendation letter.
5. The concerned court shall immediately notify the OHJ-OCA, through electronic mail at [email protected], of the actual date of the assumption to office of the appointed applicant.
