GPPB RESOLUTION NO. 04-16
DESIGNATING THE GOVERNMENT PROCUREMENT POLICY BOARD-TECHNICAL SUPPORT OFFICE (GPPB-TSO) EXECUTIVE DIRECTOR AND DEPUTY EXECUTIVE DIRECTORS AS PRINCIPAL AND ALTERNATIVE REPRESENTATIVES, RESPECTIVELY, TO THE NEGOTIATING PANEL ON GOVERNMENT PROCUREMENT IN FREE TRADE NEGOTIATIONS
WHEREAS, Republic Act (RA) No. 9184, otherwise known as the "Government Procurement Reform Act" and its revised Implementing Rules and Regulations (IRR) took effect on 26 January 2003 and 2 September 2009, respectively;
WHEREAS, Section 63 of RA 9184 and its IRR provides that the Government Procurement Policy Board (GPPB) shall protect the national interest in all matters affecting public procurement, having due regard to the country's regional and international obligations;
WHEREAS, the GPPB, through its Technical Support Office, upon invitation by the Department of Trade and Industry (DTI), participated in the Negotiating Panel, specifically on the Chapter on Government Procurement in the Free Trade Agreement (FTA) negotiations between the Philippines and the European Free Trade Association (EFTA). Accordingly, the Executive Director of the GPPB-TSO was designated as lead negotiator and principal representative, while the Deputy Executive Directors were designated as alternates to the PH-EFTA FTA Negotiations;
WHEREAS, DTI has requested the GPPB for representatives in preparation for the upcoming FTA negotiations with the European Union (EU) and lead the negotiations on Government Procurement. Likewise, the GPPB has been informed that the Government of the Philippines (GOP) may engage in other bilateral (i.e., PH-Chile) and multilateral (i.e., Trans Pacific Partnership) FTA negotiations involving Government Procurement;
WHEREAS, in view of the foregoing, the GPPB, after due deliberation, approved to designate the GPPB-TSO Executive Director and Deputy Executive Directors as Principal and Alternate Representatives, respectively, in all bilateral and multilateral free trade negotiations involving Government Procurement upon invitation by the DTI or other lead government agencies;
NOW, THEREFORE, for and in view of all the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law and other executive issuances, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the following:
DESIGNATE the Executive Director and the Deputy Executive Directors of the GPPB-TSO as principal and alternate negotiators and representatives, respectively, to bilateral and multilateral free trade negotiations involving Government Procurement upon invitation by the Department of Trade and Industry or other lead government agencies.
This Resolution shall take effect immediately.
