GPPB RESOLUTION NO. 03-16

DESIGNATING THE CHAIRPERSON AND ALTERNATE CHAIRPERSON FOR THE GPPB REVIEW COMMITTEE FOR CALENDAR YEAR 2016

WHEREAS, Executive Order (EO) No. 423, series (s.) of 2005, repealing EO 109-A, s. 2003, prescribes the rules and procedures on the review and approval of all government contracts to conform with Republic Act No. 9184, otherwise known as the "Government Procurement Reform Act;"

WHEREAS, Section 4 of EO 423 was amended by EO 645, s. 2007, which mandates the approval by the Government Procurement Policy Board (GPPB) of government contracts to be procured through any of the alternative procurement modalities involving an amount of at least Five Hundred Million Pesos (PhP500,000,000.00), after its determination that the proposed procurement undertaking falls within the exceptions from public bidding and that the proposed alternative method of procurement is appropriate;

WHEREAS, the GPPB issued Resolution No. 11-2006, approving and adopting the internal rules for its exercise of the approval power mandated under EO 423, as amended;

WHEREAS, Section 3 of GPPB Resolution No. 11-2006 provides for the creation of a Review Committee, to be known as the GPPB Review Committee (GRC), which is tasked to assist the GPPB in carrying out its functions, as mandated by EO 423, as amended, specifically, in making recommendations as to whether the contemplated procurement undertaking falls within the exceptions from public bidding;

WHEREAS, Section 5 of GPPB Resolution No. 11-2006 mandates the GPPB to designate a GRC Chairperson and Alternate Chairperson, who shall at least be an Assistant Secretary of any of the Departments comprising the GPPB, preferably with knowledge, experience, and/or expertise in the field of government procurement. The Chairperson and the Alternate Chairperson of the GRC will serve a renewable term of one (1) year from the time of appointment, unless his/her designation as committee member is sooner revoked by his Department Head or his/her service is discontinued, temporarily or permanently, by reason of death, resignation, retirement, suspension or leave;

WHEREAS, on 11 March 2016, the Board, as the agency mandated under RA 9184 to formulate and amend public procurement policies, rules and regulations, approved the designation of Department of Trade and Industry and Department of Health as Chairperson and Alternate Chairperson of the GPPB — Review Committee, respectively, for the calendar year 2016.

NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the designation of the representatives of the Department of Trade and Industry and the Department of Health, as Chairperson and Alternate Chairperson, respectively, of the GPPB Review Committee for calendar year 2016.

This resolution shall take effect immediately.
