ACT NO. 3670

AN ACT MAKING APPROPRIATIONS FOR PUBLIC WORKS

SECTION 1. The following sums, or so much thereof as may be necessary, are hereby appropriated, out of any funds in the Insular Treasury not otherwise appropriated, to be at the disposal of the Director of Public Works, subject to the approval of the Secretary of Commerce and Communications and the provisions hereinafter set forth, for the purposes mentioned hereunder:

A. CONSTRUCTION, IMPROVEMENT, REPAIR, AND MAINTENANCE OF PUBLIC BUILDINGS AND OTHER UNCLASSIFIED PROJECTS

(a)	For the maintenance, improvement, alteration, and
	repair of public buildings, including adjacent grounds:
	Provided, That this fund shall not be used to improve,
	alter, or repair a building in such manner as to make it
	appear practically new	P300,000.00

	following agricultural schools in regularly organized provinces:

	1.	Agricultural school of Central Luzon, Nueva Ecija,

	each well requested before drilling operations are undertaken

	Provided, further, That any province or municipality which by
	virtue of the provisions of this Act shall incur the expense of an
	artesian well resulting in a failure, shall have the amount expended
	reimbursed from this appropriation.
(q)	For the construction of insular, provincial, and municipal
	waterworks, drainage and sewer system projects, whenever
	the province or municipality concerned shall appropriate
	funds to cover the cost of one-third of the work prior to the
	release of the insular aid authorized by this Act: Provided,
	That no municipality shall be entitled to receive more than
	P25,000 a year as aid: Provided, further, That in the case
	of a provincial or municipal project benefiting or covering
	two or more municipalities, each municipality concerned
	shall be entitled to said P25,000 aid	700,000.00

SECTION 2. All balances of the several appropriations made by this Act the destination of which has not been determined by proper authority on July thirtieth, nineteen hundred and thirty, and all balances of appropriations remaining unexpended on July thirtieth, nineteen hundred and thirty-one, shall revert to the unappropriated funds in the Insular Treasury, and thereafter shall not be available for expenditure except upon appropriation by the Legislature.

SECTION 3. The sums appropriated in paragraphs (a), (i), (p), (q), and (w) shall be distributed in the discretion of the Secretary of Commerce and Communications, but those appropriated in the other paragraphs, shall be available for immediate expenditure by the Director of Public Works.

SECTION 4. Appropriations for the construction of schools not in excess of three thousand pesos shall be transferred to the municipality concerned and disbursed subject to the approval of the division superintendent of schools, without necessity of the intervention of the Bureau of Public Works.

SECTION 5. This Act shall take effect on January first, nineteen hundred and thirty.

	Provided, That officers and employees of the Government
	may be appointed as gaugekeepers and rain observers under
	these projects and may receive extra compensation therefor,

	And provided, further, That persons appointed as gaugekeepers
	and rain observers under these projects who are not Government
	employees may be allowed to accept other Government
	employment, upon recommendation of the Director of Public
	Works, approved by the Secretary of Commerce and
	Communications, and may receive compensation therefor.
(m)	For the investigation of applications for the use of water for
	irrigation, water supply, and water power projects, and for the
	adjudication of water rights on streams designated by the

D. ARTESIAN WELLS AND WATERWORKS

(p)	For the drilling of artesian wells by the Bureau of Public Works,
	including the purchase and maintenance of well-
	drilling equipment		P150,000.00
	Provided, That funds shall be appropriated by the province
	or municipality concerned to cover one-third of the cost of
	each well requested before drilling operations are undertaken
	by the Bureau of Public Works, and that upon certification by
	the Director of Public Works of the cost of a well the province or
	municipality concerned shall pay its share into the Insular Treasury:
	Provided, further, That any province or municipality which by
	virtue of the provisions of this Act shall incur the expense of an
	artesian well resulting in a failure, shall have the amount expended
	reimbursed from this appropriation.
(q)	For the construction of insular, provincial, and municipal
	waterworks, drainage and sewer system projects, whenever
	the province or municipality concerned shall appropriate
	funds to cover the cost of one-third of the work prior to the
	release of the insular aid authorized by this Act: Provided,
	That no municipality shall be entitled to receive more than
	P25,000 a year as aid: Provided, further, That in the case
	of a provincial or municipal project benefiting or covering
	two or more municipalities, each municipality concerned
	shall be entitled to said P25,000 aid	700,000.00

	2.	For the maintenance of the insular piers, cargo sheds,
		breakwaters, and river and estero walls, Manila 140,000.00
	3.	For construction and improvement in the South Port
		Area, Manila, including necessary works and drains	30,000.00
		Provided, That subject to the approval of the Secretary
		of Commerce and Communications and with such security
		as he may require, material derived from dredging may be
		used for filling in private property at the request of any
		landowner, upon the condition that the cost thereof shall
		be paid by the owner of the land in annual instalments not
		to extend over more than five years: And provided,
		further, That in case of marine accidents the damages
		caused by any port equipment may be paid subject to
		like approval of the Secretary of Commerce and
		Communications. The total of such payments out of
		funds appropriated by this subsection shall not
