AMENDING PROCLAMATION NO. 1049 DATED APRIL 7, 2006, WHICH SEGREGATED A PORTION OF CAMP ROBERT EDWARD LUCERO IN BARANGAYS POBLACION AND NASAPIAN, MUNICIPALITY OF CARMEN, PROVINCE OF COTABATO, ISLAND OF MINDANAO, FROM THE COVERAGE OF PROCLAMATION NO. 1804 DATED NOVEMBER 23, 1978 FOR SOCIALIZED HOUSING SITE PURPOSES

Upon the recommendation of the Secretary of the Department of Environment and Natural Resources (DENR) and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 1049 dated April 7, 2006, which segregated a portion of Camp Robert Edward Lucero Military Reservation located in Barangays Poblacion and Nasapian, Municipality of Carmen, Province of Cotabato, Island of Mindanao, from the coverage of Proclamation No. 1804 dated November 23, 1978 and reserved the same for socialized housing as follows: ACTIcS

Paragraph two, three, four and five of Proclamation No. 1049 are hereby amended to read as follows:

"Thirteen (13) hectares or One Hundred Thirty Thousand and Two (130,002) square meters of the area herein reserved shall be disposed of to the actual occupants thereof by the Department of Environment and Natural Resources (DENR) in accordance with the provisions of the Public Land Act, Republic Act No. 730 and other applicable rules and regulations and shall be under the administration of the Municipal Government of Carmen, Province of Cotabato. This area shall be subject to actual ground survey and is more particularly described as follows:

A PARCEL OF LAND, (a portion of Lot 3179, Pls-217) situated in Barangay Poblacion, Municipality of Carmen, Province of Cotabato, Island of Mindanao. Bounded on the NE., and SE., along lines 1-2-3 by road; and along lines 3-4-5 by Lot 3179-C, Pls-217; on the SW., and NW.; along lines 5-6-7-8-1 by Lot 3179-B, Pls-217 of the Subdivision Plan: Beginning at a point marked '1' on the plan being N. 58-25' W., 1,357.83 m. BLLM No. 2, Pls-217, Carmen Public Land Subdivision, Thence:

N. 83-33' E., 495.08 m. to point 2;

S. 06-27' E., 255.91 m. to point 3;

N. 84-40' W., 199.89 m. to point 4;

N. 62-19' W., 295.05 m. to point 6;

N. 09-54' W., 182.02 m. to point 7;

N. 86-54' W., 40.67 m. to point 8;

N. 06-26' E., 40.00 m. to point of

beginning, containing an area of ONE HUNDRED THIRTY THOUSAND AND TWO (130,002) SQUARE METERS, more or less, as per Sketch Plan prepared by Emelda F. Blanco, Geodetic Engineer.

The remaining area of Seven (7) hectares or Seventy Thousand and Two (70,002) square meters shall be used as Armed Forces of the Philippines (AFP) Off-Base Housing for active and retired Military personnel, to be administered by the Housing and Urban Development Coordinating Council (HUDCC)/National Housing Authority (NHA), and shall be disposed of in accordance with the provisions of Republic Act 7279, otherwise known as the Urban Development and Housing Act (UDHA) of 1992. This area shall also be subject to actual ground survey and is more particularly described as follows:

A PARCEL OF LAND, (a portion of Lot 3179, Pls-217) situated in Barangay Poblacion, Municipality of Carmen, Province of Cotabato, Island of Mindanao. Bounded on the NE., and SE., along lines 10-1 by road; and along lines 1-2-3-4-5 by Lot 3179-A, Pls-217, and along line 5-6 by Lot 3179-C, Pls-217; on the SW., and NW., along lines 6-7-8-9 by Lot 3179-C, Pls-217 and along line 9-10 by road. Beginning at a point marked '1' on the plan being N. 58-25' W., 1,357.83 m. BLLM No. 2, Pls-217, Carmen Public Land Subdivision, Thence:

S. 06-27' E., 40.00 m. to point 2;

S. 86-51' E., 40.67 m. to point 3;

S. 09-54' E., 182.02 m. to point 4;

S. 62-19' E., 295.00 m. to point 5; TAScID

S. 06-27' E., 102.37 m. to point 6;

N. 62-27' W., 363.58 m. to point 7;

N. 09-11' W., 244.70 m. to point 8;

S. 81-51' W., 503.46 m. to point 9;

N. 06-29' W., 63.70 m. to point 10;

N. 83-34' E., 521.14 m. to point of

beginning, containing an area of SEVENTY THOUSAND AND TWO (70,002) SQUARE METERS, more or less, as per Sketch Plan prepared by Emelda F. Blanco, Geodetic Engineer."

Paragraph seven is hereby amended to read as follows:

"A Local Inter-Agency Committee (LIAC) is hereby created to be chaired by the Local Government of Carmen and Co-Chaired by the representatives from the NHA and the AFP Housing Board with DENR and HUDCC as members. The LIAC is hereby empowered to issue and promulgate the implementing rules and regulations (IRR) for the two (2) lots covered by this proclamation."

Paragraph nine is hereby amended to read as follows:

"The DENR is hereby authorized to issued Sales Patent in favor of the qualified civilian occupants for the 13 hectares, while for the 7 hectares, the DENR Secretary is authorized to issue the Special Patent in favor of NHA. The NHA shall remit to the National Treasury thru the DENR the value of the lot based on the appraisal as determined by the DENR."
