AMENDING PROCLAMATION NO. 1159 DATED SEPTEMBER 8, 2006 BY TRANSFERRING THE OWNERSHIP OF THE 78 HECTARES OF LAND ALLOTED FOR GOVERNMENT HOUSING PURPOSES TO THE NATIONAL HOUSING AUTHORITY AND DIRECTING ITS CONVEYANCE THROUGH SALE AS A PRIORITY MODE OF DISPOSITION AND UTILIZATION

WHEREAS, Proclamation No. 1159 (s. 2006) declared portions of the New Bilibid Prison (NBP) Reservation, in Barangay Poblacion, Muntinlupa City, embracing an aggregate area of 366.7 hectares, more or less, open for disposition and development in conformity with the approved land use plan for the NBP and NBP Master Development Plan; TcCSIa

WHEREAS, as part of the Government's shelter strategy, occupational and sectoral housing is instituted for better beneficiary targeting and delivery;

WHEREAS, under said Proclamation, the qualified employees of the Office of the President (OP), Department of Justice (DOJ)/Bureau of Corrections (BUCOR) and Department of Environment and Natural Resources (DENR) are given priority to and will share in the disposition of 780,000-square meter or 78 hectares land allotted for government housing purposes;

WHEREAS, there is a need to transfer ownership over said 78 hectares of land to the National Housing Authority (NHA) for disposition to qualified beneficiaries mentioned in Proclamation No. 1159 (s. 2006) through sale as a priority mode of utilization and disposition of the property;

NOW, THEREFORE, I, GLORIA MACAPAGAL ARROYO, President of the Republic of the Philippines, do hereby order that Proclamation No. 1159 be amended as follows:

The ownership of the Seven Hundred Eighty Thousand (780,000) square meters or 78 hectares of land in New Bilibid Prison (NBP) Reservation, Barangay Poblacion, Muntinlupa City, and alloted for government housing purposes shall be transferred to the National Housing Authority (NHA), subject to private rights, if there be any, and to final ground survey.

The NHA shall immediately dispose the property declared and allotted for government housing purposes to qualified beneficiaries mentioned in Proclamation No. 1159 through sale as a priority mode of disposing and conveying the same.

The NHA shall be exempted from the payment of income and real taxes as well as payment of documentary stamp tax and registration fees, including fees required for the issuance of transfer certificates of titles as provided for in Section 19, Republic Act No. 7279 (Urban Development and Housing Act of 1992). For purposes of formulating and adopting the implementing guidelines for the proper disposition of the property, the Inter-Agency Steering Committee created under Proclamation No. 1159 (s. 2006) is hereby retained.

The DENR, in coordination with the NHA and the Inter-Agency Steering Committee, shall conduct or supervise the actual boundary and subdivision survey of the abovementioned 78-hectare land.

The Department of Finance shall set the equitable land valuation guidelines for disposing the aforementioned property on the basis of the market value reflected in the tax declaration and taking into consideration the raw status of the land.

Except in favor of the Government or any of its branches or institutions, lands disposed of under this Proclamation, including all improvements already existing or introduced after such disposal, shall not be subject to encumbrance or alienation from the date of the award of the property for a period of ten (10) years from the issuance of the transfer of certificate of title, in case of sale, or execution of contract, in case of lease, nor shall they become liable for satisfaction of any debt contracted prior to the expiration of said period; but the same may be mortgaged to the Government Service Insurance System (GSIS), Home Development Mutual Fund or Pag-IBIG Fund, or to any government financial institutions, whichever is applicable.

All issuances, rules and regulations inconsistent herewith, are deemed repealed or modified accordingly.
