SUPREME COURT ADMINISTRATIVE CIRCULAR NO. 13-00
AMENDING ADMINISTRATIVE CIRCULAR NO. 5-2000 AND DEFINING FURTHER THE AUTHORITY OF THE PREQUALIFICATION, EVALUATION AND AWARDS COMMITTEE FOR CONSULTANCY (PEAC)
WHEREAS, Administrative Circular No. 5-2000 creating the PEAC and naming its Chairperson, Executive Officer and Members was issued pursuant to the Implementing Rules and Regulations (IRR) on the Procurement of Consulting Services for Government Projects set by the National Economic and Development Authority (NEDA) and the Resolutions of 15 August 2000 and 12 September 2000 in Administrative Matter No. 99-12-08-SC (Re: Proposed Renovation of the Session Hall, En Banc and Division Conference Rooms, Main Lobby and Other Areas Located in the Main Building of the New Supreme Court Compound) wherein the Court resolved to create the Prequalification, Evaluation and Awards Committee for Consultancy (PEAC);
WHEREAS, Administrative Circular No. 5-2000 defines the scope of the PEAC's authority as encompassing the Supreme Court's "plans to construct new buildings or expansion of old or existing buildings, such as, but not limited to, (a) multi-purpose building under the Memorandum of Agreement between the Supreme Court and the Court of Appeals; (b) a new building of the UP side at the back of the old SC building; (c) a new building between the Judicial Records Office and the offices of Mr. Justice A. R. Melo and Mme. Justice M. P. G. Reyes; and (d) an extension of the main Library; (e) small buildings on the side of the Supreme Court building toward the DOJ compound; (f) additional floor for the Printing Services building; and (g) cottages in Baguio City";
WHEREAS, Section 2.2.2.1 of the said IRR defines "consulting services" as "services requiring adequate technical expertise and financial capability in undertaking the following types of services": (a) advisory and review services; (b) pre-investment or feasibility studies; (c) design; (d) construction supervision; (e) management and related services; and (f) other technical services or special studies; aDcETC
WHEREAS, under Administrative Circular No. 5-2000, the authority of the Court's PEAC is circumscribed by the enumerated projects and/or those related to such projects to the exclusion of other consulting services; and
WHEREAS, the Supreme Court shall undertake projects that are not covered by projects enumerated in Administrative Circular No. 5-2000 but are included in the definition of "consulting services" under the said IRR;
NOW, THEREFORE, Administrative Circular No. 5-2000 is amended as it is hereby amended to authorize the PEAC to take jurisdiction over all consulting services provided for by Section 2.2.2.1 of the Implementing Rules and Regulations on the Procurement of Consulting Services for Government Projects.
This Circular shall take effect immediately.
