SUPREME COURT MEMORANDUM ORDER NO. 25-05
RECONSTITUTING THE BIDS AND AWARDS COMMITTEE FOR INFRASTRUCTURE PROJECTS
WHEREAS, on 12 January 2001, Administrative Circular No. 7-2001 was issued creating the Ad Hoc Bid and Award Committee pursuant to Presidential Decree No. 1594, as amended, and its Implementing Rules and Regulations (IRR) to conduct the pre-qualification or eligibility screening of interested bidders, bidding, evaluation of bids and post-qualification, as well as to submit the recommendation for the award of contracts for the construction of new buildings or expansion of old or existing buildings within the Supreme Court compound; AcIaST
WHEREAS, Republic Act No. 9184, otherwise known as the Government Procurement Reform Act, and its Implementing Rules and Regulations Part A (IRR-A) provide for the constitution of Bids and Awards Committee (BAC) and the organization of separate BACs according to the nature of procurement, i.e., infrastructure projects, goods, and consulting services;
WHEREAS, under R.A. No. 9184 and IRR-A, the members of the BAC shall have a fixed term of one year from the date of appointment, renewable at the discretion of the head of the procuring entity;
WHEREAS, the IRR-A provides that two observers representing (1) a duly recognized private group in a sector or discipline relevant to the works subject of procurement and (2) a non-government organization should be invited by the BAC to sit in during its proceedings, but does not include an observer with the appropriate technical experience and expertise from a government infrastructure department or agency who can lend assistance to the BAC during the stages of procurement involving complex technical issues and process; and
WHEREAS, in view of the foregoing considerations and the provisions of R.A. No. 9184 and IRR-A, there is a need to reconstitute the Supreme Court's Bids and Awards Committee for infrastructure projects.
NOW, THEREFORE, the Ad Hoc Bids and Awards Committee for infrastructure projects is hereby renamed as SC BID AND AWARD COMMITTEE FOR INFRASTRUCTURE PROJECTS (SC-BAC-IP) and reconstituted as follows:

To ensure transparency of the procurement process, the Ad Hoc SC-BAC-IP shall invite, in addition to the representative from the Commission on Audit (COA), one observer from a duly recognized private group in a sector or discipline relevant to the works subject of procurement and another observer from a non-government organization. It may also invite an observer from a government infrastructure department or office who can assist it during the stages of procurement involving complex technical issues and process.
The Committee shall designate its Secretary and Assistant Secretary.
The Chairperson, Vice-Chairperson, Members, Secretary, and Assistant Secretary of the Committee shall be entitled to receive the expense allowance prescribed in Administrative Circular No. 13-99, dated 30 September 1999, for Ad Hoc Committees ADCETI
This Memorandum Order shall take effect immediately.
