PROFESSIONAL REGULATORY BOARD FOR PROFESSIONAL TEACHERS RESOLUTION NO. 047-05
A RESOLUTION PROMULGATING THE NEW "RULES AND REGULATIONS IMPLEMENTING REPUBLIC ACT NO. 9293", AN ACT AMENDING CERTAIN SECTIONS OF REPUBLIC ACT NO. 7836, OTHERWISE KNOWN AS THE "PHILIPPINE TEACHERS' PROFESSIONALIZATION ACT OF 1994", REPEALING FOR THE PURPOSE BOARD RESOLUTION NO. 634, SERIES OF 2004
WHEREAS, on September 14, 2004, the Board for Professional Teachers promulgated Resolution No. 634, series of 2004, "A Resolution Amending Certain Sections of Board Resolution No. 95-01, the "RULES AND REGULATIONS IMPLEMENTING THE "PHILIPPINE TEACHERS' PROFESSIONALIZATION ACT OF 1994" IN VIEW OF REPUBLIC ACT No. 9293, AN ACT AMENDING CERTAIN SECTIONS OF REPUBLIC ACT No. 7836, OTHERWISE KNOWN AS THE "PHILIPPINE TEACHER'S PROFESSIONALIZATION ACT OF 1994".
WHEREAS, the Board Resolution No. 634, series of 2004 should be repealed, considering that all the provisions contained therein need to be amended in order to clarify the aforesaid provisions, and thus a new Rules and Regulations Implementing R.A. No. 9293, known as "AN ACT AMENDING CERTAIN SECTIONS OF REPUBLIC ACT NO. 7836, OTHERWISE KNOWN AS THE "PHILIPPINE TEACHER'S PROFESSIONALIZATION ACT OF 1994" should be established.
WHEREFORE, the Board RESOLVED, as it is hereby RESOLVES, to repeal Board Resolution No. 634, series of 2004, and promulgate the new Rules and Regulations Implementing R.A. No. 9293, as follows:
SECTION 1. Section 3, Article I of Board Resolution No. 95-01, series of 1995, is hereby amended to read as follows:

1. Civil Service Teacher Eligibles — refers to teachers who hold Guro Certificates or Civil Service Teacher's Eligibility issued by the Civil Service Commission.
SECTION 2. Section 16 (e), Article III of Board Resolution No. 95-01 is hereby amended to read as follows:
Section 16. Qualifications and Requirements for Examination of Professional Teachers of the Pre-school, Elementary, Secondary and Vocational/Technical Levels. — Any person who possesses the following qualifications may file an application to take the written examination for professional teachers of the preschool, elementary, secondary, and vocational/technical levels:
e. A graduate of a school, college or university recognized by the government and a possessor of the minimum educational qualifications, as follows:

1. For teachers in preschool, a bachelor's degree in early childhood education (BECED) or its equivalent;
2. For teachers in the elementary grades, a bachelor's degree in elementary education (BSEED) or its equivalent;
3. For teachers in the secondary grades, a bachelor's degree in education or its equivalent with a major and minor, or a bachelor's degree in arts and sciences with at least EIGHTEEN (18) UNITS in professional education; and
4. For teachers of vocational and two-year technical courses, a bachelor's degree in the field of specialization or its equivalent, with at least eighteen units (18) in professional education.
The duly accomplished application form shall be filed with the Application Division of the OFFICE FOR PROFESSIONAL TEACHERS accompanied by authentic copies of the following documents:
a. Certificate of Live Birth duly issued by the National Statistics Office in security paper or by the Local Civil Registrar duly authenticated by the National Statistics Office (NSO) in case of a negative certification of no record of birth issued by the NSO; and
b. Transcript of Records indicating therein the date of graduation, with Special Order, unless the said Special Order is dispensed with in accordance with law or rules and regulations issued by the Commission on Higher Education (CHED).
In the case of an alien, the application shall be accompanied with medical certificate, transcript of records and an alien certificate of registration. law2005cd
SECTION 3. Section 18, Article IV of Board Resolution No. 95-01, series of 1995, is hereby amended to read as follows:
Section 18. Registration of Professional Teachers without Examination. — Upon approval of the application and payment of prescribed fees, the Certificate of Registration and Professional Identification Card (PRC ID Card) as a Professional Teacher shall be issued without examination to a qualified applicant who is:
a. A holder of a certificate of eligibility as a teacher issued by the Civil Service Commission or the Department of Education, Culture and Sports (DECS); or
b. A registered professional teacher with the National Board for Teachers under the Department of Education, Culture and Sports (DECS) pursuant to Presidential Decree No. 1006.
The duly accomplished application form shall be accompanied with original or authenticated copies of the following:
1) Certified true copy of Report of Rating, or in the absence thereof, Certification of Rating or Guro Certificate issued by the Civil Service Commission;
2) Marriage Certificate issued by the National Statistics Office (NSO) in security paper (if applicable);
3) Certificate of Live Birth issued by the National Statistics Office (NSO) in security paper or by the Local Civil Registrar duly authenticated by the NSO in case of a negative certification of no record of birth issued by the NSO; and
4) Two (2) recent colored pictures (passport size in plain, white background, with complete nametag).
In the evaluation and approval of the application, the following procedures shall be observed:
1. Certificate of eligibility as Teacher under Category A shall be verified in the Master List of Eligible Teachers issued by the Civil Service Commission; and
2. Certificate of Registration as a Professional Teacher under Category B shall be verified in the Master List issued by the National Board for Teachers under the DECS pursuant to P.D. 1006.
Teachers who were allowed to register under Categories A and B and who have not practiced their profession for the past five (5) years prior to application date in the Department of Education to practice their profession shall take at least twelve (12) units of education courses, consisting of at least six (6) units of pedagogy and six (6) units of content courses, or the equivalent training and number of hours, to be chosen from a list of courses to be provided by the Board for Professional Teachers and the Department of Education, before they can be allowed to practice their profession in the country.
SECTION 4. Section 20, Article IV shall now read as follows:
Section 20. Issuance of Special Permit to an Expert. — Any person who has excelled and gained international recognition and is widely acknowledged as an expert in his or her respective field of specialization may be issued a Special Permit by the Board for Professional Teachers subject to the approval by the Professional Regulation Commission.
When applying for a Special Permit the following documents shall be submitted:
a) Certificate of award or recognition of international stature from international award giving bodies; and
b) Diploma/Certificate of expertise in his/her specialization or field of education.
The Board shall issue a Resolution subject to approval by the Professional Regulation Commission for the issuance of the Special Permit.
The Special Permit to Experts shall be valid for one (1) year upon payment of special permit fee, and may be renewed.
SECTION 5. Section 21, Article IV, Special/Temporary Permit for Para-Teachers of Board Resolution No. 95-01, series of 1995 is hereby amended to read as follows:
Section 21. Special Permit for Para-Teachers. — Any person who failed the licensure examination for teachers, with a rating of not lower than five (5) percentage points from the passing general average rating, shall be eligible as para-teachers in areas where there is a shortage or absence of a professional teacher, as identified and provided by the Department of Education and the Autonomous Region for Muslim Mindanao (ARMM) Education Department to the Board for Professional Teachers and to the Commission. The special permit shall indicate the area of assignment of the para-teacher. He/She may file his/her application for issuance of a Special Permit with the Application Division of the Office for Professional Teachers.
Together with the application, he/she shall submit the following documents:
1. A photocopy of Report of Rating with a general average of at least seventy percent (70%) in the Licensure Examination for Teachers (LET);
2. Two (2) recent colored pictures (passport size in plain, white background, with complete nametag); and
3. Certification issued by the Department of Education or the Secretary of Education for the Autonomous Region for Muslim Mindanao (ARMM) as to the existence of shortage or absence of professional teachers in their areas.
The Special Permit shall be issued upon compliance with and under the following conditions:
1) Rating in the examination shall be verified on the basis of the rating appearing on records;
2) The Department of Education (DepEd) and/or the Autonomous Region for Muslim Mindanao (ARMM) Education Department shall provide the Board with a list of areas where there is a shortage or absence of a professional teacher therein;
3) Special permit shall be issued through appropriate Board Resolution approved by the Professional Regulation Commission indicating therein the period and the area of assignment; and
4) The special permit shall be effective for two (2) years upon payment of the special permit fee, renewable for a non-extendible period of two (2) years.
Special permits issued to para-teachers by the Board for Professional Teachers and the Professional Regulation Commission shall be allowed to expire based on the period granted therein; provided, that only special permits with a validity of two (2) and three (3) years may be renewed upon expiration for a non-extendible period of two (2) years.
SECTION 6. Separability Clause. — If, for any reason, any section or provision of this Resolution, or the application of such section or provision to any person or circumstance is declared unconstitutional or invalid, no other section or provision of this Resolution shall be affected thereby.
SECTION 7. Effectivity. — This Resolution takes effect after fifteen (15) days following its complete and full publication in the Official Gazette or newspaper of general circulation.
SECTION 8. Repealing and Amendatory Clause. — Board Resolution No. 634, Series of 2004 is hereby expressly repealed. Other circulars, resolutions, orders, rules, and regulations whose provisions are inconsistent with the provisions of this Resolution are hereby repealed or modified accordingly.
