Rules and Regulations Implementing R.A. No. 9268, Known as the Philippine Veterinary Medicine Act of 2004

PROFESSIONAL REGULATORY BOARD OF VETERINARY MEDICINE RESOLUTION NO. 010-04
IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT NO. 9268, "THE PHILIPPINE VETERINARY MEDICINE ACT OF 2004"
Pursuant to Section 8 (m), Article II and Section 36, Article IV of Republic Act No. 9268, "AN ACT TO REGULATE THE PRACTICE OF VETERINARY MEDICINE IN THE PHILIPPINES, REPEALING FOR THE PURPOSE REPUBLIC ACT NO. 382 AND FOR OTHER PURPOSES", known as the "PHILIPPINE VETERINARY MEDICINE ACT OF 2004", the Professional Regulatory Board of Veterinary Medicine hereby prescribes, adopts, and promulgates the following Rules and Regulations to carry out the provisions thereof.
RULE I
Title, Policy, Objectives, and Definition of Terms
SECTION 1. Title. — This Rules and Regulations shall be known as "THE RULES AND REGULATIONS IMPLEMENTING R.A. NO. 9268, KNOWN AS THE PHILIPPINE VETERINARY MEDICINE ACT OF 2004". This Resolution is also called the "IRR of the Philippine Veterinary Medicine Act of 2004".
SECTION 2. Declaration of Policy. — It shall be the policy of the State to upgrade the practice of veterinary medicine in the Philippines for the purpose of protecting the animal population in the country through safe and proper diagnosis, treatment and surgery of these animals. The state recognizes the important role of veterinarians in nation building and promotes the sustained development of veterinarians whose competence has been validated by honest and credible licensure examination and whose standards of professional practice and service are world-class and internationally recognized and globally competitive.
This "IRR of the Philippine Veterinary Medicine Act of 2004" shall be interpreted, construed, and carried out in the light of the Declaration of Policy in Sec. 2, Article I of R.A. No. 9268.
SECTION 3. Objectives. — This Resolution provides for the realization of the following objectives:
a. The administration and conduct of licensure examinations, registration and licensing of veterinarians;
b. The supervision and regulation of the practice of veterinary medicine;
c. The integration of veterinarians under an accredited veterinary professional organization; and
d. The development of the professional competence of veterinarians through Continuing Professional Education (CPE) programs in accordance with the guidelines set by the Professional Regulation Commission.
SECTION 4. Definitions of Terms. — As used in this "IRR of the Philippine Veterinary Medicine Act of 2004", the following terms are construed as follows:
a. Veterinarian — is a natural person who has been registered and issued a valid Certificate of Registration and Professional Identification Card by the Board of Veterinary Medicine in accordance with R.A. No. 9268. This definition shall also mean registered, licensed, and practising veterinarian, as they appear in many sections of this Resolution.
b. Accredited Professional Organization — refers to the legally constituted, professional organization of veterinarians and currently accredited by the Board of Veterinary Medicine and the Professional Regulation Commission.
c. Board — refers to the Professional Regulatory Board of Veterinary Medicine created by R.A. No. 9268.
d. Commission — refers to the Professional Regulation Commission created by R.A. No. 8981.
RULE II
Professional Regulatory Board of Veterinary Medicine
SECTION 5. Composition of the Professional Regulatory Board of Veterinary Medicine. — The Professional Regulatory Board of Veterinary Medicine, hereinafter referred to as the Board, created under R.A. No. 9268 is a collegial body composed of a Chairman and two {2} members each to be appointed by the President of the Philippines from among a list of three {3} recommendees for each position submitted by the Professional Regulation Commission from a list of five {5} nominees for each position submitted by the accredited professional organization of veterinarians and pursuant to the procedures prescribed under Executive Order No. 469. The Board is under the administrative supervision and control of the Professional Regulation Commission hereinafter referred to as the Commission as per R.A. No. 9268.
SECTION 6. Qualifications of Members of the Board. — The Chairperson and member of the Board must, at the time of nomination, recommendation, and appointment, comply with the requirements set forth under Section 6, Article II of R.A. No. 9268, to wit: — The members of the Board must at the time of nomination, recommendation, and appointment:
(a) Be a Filipino citizen and a resident of the Philippines for at least five (5) years immediately preceding nomination, recommendation and appointment;
(b) Be of good health, sound mind, good moral character and reputation and have not been convicted by final judgment of any crime involving moral turpitude;
(c) Be a registered veterinarian and holder of a valid Certificate of Registration and a valid Professional Identification Card;
(d) Be a member of good standing of the accredited professional organization;
(e) Not be a member of the faculty whether full time, part time or as lecturer, of any school, college or university where a regular course of veterinary medicine is taught, or be a member of a staff of reviewers in a review school or center, and not have any direct or indirect pecuniary interest in any such institution;
(f) Have practiced veterinary medicine for ten (10) years; and
(g) Not be an officer of the accredited professional organization at the time of nomination.
SECTION 7. Term of Office. — The Chairman and the two {2} members of the Board shall hold office for a term of three {3} years from the date of their appointments until their successors shall have been appointed and duly qualified and may be reappointed once. The member serving the last year of his/her term shall automatically become the Chairman of the Board. Vacancies in the Board shall be filled for the unexpired portion of the term only. The manner of nomination and recommendation of filling up of vacancies in the Board shall be the same with Section 6, Article II of R.A. No. 9268, Each member shall take the proper oath prior to assumption of duty. Upon effectivity of R.A. No. 9268, the incumbents whose terms have not yet expired or who are on holdover status shall be allowed to serve the unexpired portion of their terms.
SECTION 8. Powers, Duties and Responsibilities of the Board. — The Board shall have the following specific powers, functions, duties and responsibilities:
a. Enforce, administer, and implement the provision of R.A. No. 9268 and this "IRR of the Philippine Veterinary Medicine Act of 2004";
b. Determine and evaluate the qualifications of the applicants for examination, registration, and for issuance of Certificates of Registration and Professional Identification Cards and/or special permits pursuant to the provisions of R.A. No. 9268;
c. Prepare, adopt, issue or amend the syllabi for the subjects in the licensure examination, in consultation with the Commission on Higher Education (CHED), the academe and the accredited professional organization;
d. Register successful examinees in the licensure examination and issue corresponding Certificates of Registration;
e. Enrol in the registry book of veterinarians the names of successful examinees and issue corresponding Certificates of Registration and Professional Identification Cards;
f. Prescribe guidelines providing for the Continuing Professional Education (CPE) program for registered and licensed veterinarians upon recommendation of the accredited professional organization and in accordance with the procedures provided under a Commission's Resolution thereon;
The Board shall constitute a Council on Continuing Professional Education under Section 8 (f), Article II of R.A. No. 9268, and within the guidelines set forth by the Commission. The development of the professional excellence and competence of veterinarians through Continuing Professional Education (CPE) in accordance with the Commission's guidelines is one of the prime responsibilities of the Board;
g. Revoke Certificates of Registration of or suspend or reprimand registered and licensed veterinarians from the practice of his/her profession or to cancel special temporary permits after due notice and hearing;
h. Adopt and administer a Code of Ethics, Code of Good Governance, and a Code of Technical Standards for Doctors of Veterinary Medicine;
The Board shall convene and constitute a Council on Technical Standards that shall formulate the Code of Technical Standards for Doctors of Veterinary Medicine as stipulated under Section 8 (h), Article II of R.A. No. 9268;
i. Hear or investigate on its own or by delegation to a Board member and/or a legal hearing officer of the Commission cases arising from violations of R.A. 9268, this Resolution, Code of Ethics, and Code of Technical Standards issued thereunder and, in connection therewith, to issue subpoena ad testificandum and subpoena duces tecum to alleged violators or witnesses to compel their attendance and production of documents;
j. Look into the conditions affecting the practice of veterinary medicine in the Philippines through consultations with stakeholders, visits to clinics, hospitals, laboratories, plants, farms, schools, offices, and other facilities, and other activities as may be defined by the Board from time to time, adopt measures for the enhancement of the profession and the maintenance of high professional, technical and ethical standards of the profession;
k. Recommend to CHED, in coordination with the accredited professional organization, the prescribing, amending and/or revising of the collegiate course leading to the degree of Doctor of Veterinary Medicine;
l. Adopt the official seal of the Board;
m. Promulgate such rules and regulations or administrative orders and issuance as may be necessary to properly and fully carry out the provisions of R.A. No. 9268 and this Resolution; and
n. Perform such other functions and duties as may be necessary to implement R.A. No. 9268 and this Resolution.
The policies, resolutions, and rules and regulations issued or promulgated by the Board shall be subject to review and approval of the Commission. However, the Board's decisions, resolutions or orders, which are not interlocutory, rendered in an administrative case, shall be subject to review only if on appeal with the Commission. The decision of the Board and/or the Commission may be appealed to the Court of Appeals in accordance with the Rules of Court.
SECTION 9. Compensation of Chairperson and Members of the Board. — The Chairman and Members of the Board shall receive compensations and allowances comparable to the compensation and allowances received by existing regulatory boards under the Commission as provided for in the General Appropriations Act.
SECTION 10. Removal of Board Members. — The Chairman and members of the Board may be removed from office by the President of the Philippines, upon recommendation of the Commission on the following grounds, to wit:
(a) Neglect of Duty;
(b) Incompetence;
(c) Violation of Republic Act No. 6713, otherwise known as "The Code of Conduct and Ethical Standards for Public Officials and Employees," and "The Code of Ethics of the Veterinary Medicine Profession;"
(d) Manipulation or rigging of the veterinary licensure examination results;
(e) Disclosure of the examination questions or similar secret information;
(f) Tampering of the grades therein; and
(g) Final conviction by the court of criminal offense involving moral turpitude.
The Commission in the conduct of the investigation shall be guided by the provision of Section 7 (s) of R.A. No. 8981.
SECTION 11. Administrative Supervisions of the Board, Custodian of its Records, Secretariat and its Support Services. — The Board shall be under the administrative and executive management of the Commission. All records of the Board, including applications for examination, minutes of deliberations, CPE and Technical Standards Councils records, administrative and other investigative cases shall be under the custody of the Commission. The Commission shall designate the Secretary of the Board and shall provide the secretariat and support services to implement the provisions of R.A. No. 9268.
SECTION 12. Annual Report. — The Board, through the Office of the Secretariat, shall submit an annual report to the Commission at the end of each calendar year giving the detailed report of its activities and proceedings during the year and embodying such recommendations as the Board may desire to make. The Board shall furnish other information or data that may be requested by the Commission as the need arises.
RULE III
Examination and Registration of Veterinarians
SECTION 13. Examination Required. — Except as otherwise specifically allowed under R.A. No. 9268, all applicants for registration as veterinarians shall be required to undergo and pass an examination to be given by the Board and the Commission in such places and dates as the Commission may designate in accordance with R.A. No. 8981 subject to the compliance with the requirements prescribed by the Commission.
SECTION 14. Subjects Covered by the Examination. — The subjects for the licensure examination, shall cover the following:
(1) Veterinary Anatomy;
(2) Veterinary Physiology;
(3) Veterinary Pathology;
(4) Veterinary Parasitology;
(5) Veterinary Pharmacology;
(6) Veterinary Microbiology and Veterinary Public Health;
(7) Veterinary Medicine (including Ethics, Surgery, Animal Welfare and Jurisprudence); and
(8) Zootechnics (including Animal Behavior and Environmental Health).
The Board may amend, modify, or exclude any of the subjects in the syllabi and add new ones as technological need arises subject to the approval of the Commission.
SECTION 15. Qualifications of Applicant for Examination. — In order to be admitted to the examination for veterinarians, an applicant shall establish to the satisfaction of the Board the following requirements, to wit:
(a) he/she is a citizen of the Philippines or a foreigner whose country has reciprocity with the Philippines in the practice of veterinary medicine as provided for in Sec. 31, Art. IV of R.A. No. 9268 and Sec. 31, Rule IV of this "IRR of the Philippine Veterinary Medicine Act of 2004";
(b) he/she is in good health and moral character, and sound mind;
(c) he/she has not been convicted by final judgment of an offense involving moral turpitude by a competent court; and
(d) he/she is a holder of a Degree in Veterinary Medicine from a recognized accredited College of Veterinary Medicine by the Commission on Higher Education (CHED).
The following documents shall be submitted in support of the above requirements:
(1) Certificate of Live Birth in National Statistics Office (NSO) Security Paper
(2) Marriage Contract in NSO Security Paper for married female applicants
(3) College Diploma with indication therein of date of graduation and Special Order Number unless it is not required
(4) Transcript of Records with indication therein of date of graduation and Special Order Number unless it is not required
(5) National Bureau of Investigation (NBI) Clearance
(6) Other documents that the Board may require.
SECTION 16. Report of Ratings. — The Board shall, within ten (10) days or earlier after the date of examination, report the rating obtained by each candidate to the Commission for official release and publication.
SECTION 17. Ratings in the Examination. — In order to pass the examination, a candidate must obtain a weighted average of at least seventy-five percent {75%} with no rating below sixty percent {60%} in any subject. A candidate who obtains a weighted average rating of seventy-five percent {75%} or higher but gets a rating below sixty percent {60%} in any subject shall be allowed to take a re-examination in only those subjects in which the candidate obtained a rating below sixty percent {60%}. Re-examination shall be taken on the next scheduled licensure examination. Should the candidate fail to obtain seventy-five percent {75%} in the reported subject or subjects, the candidate's examination shall be considered failed, and the candidate is required to take all the subjects in the succeeding licensure examination.
SECTION 18. Issuance of Certificate of Registration and Professional Identification Card. — All applicants who passed the examination and those who apply for registration without examination shall, upon payment of the prescribed fees of the Commission, shall be issued a Certificate of Registration as a Veterinarian containing the full name of the registrant, serial number, date of issuance, registration number, bearing the signatures of the Commission Chairperson and the Chairman and members of the Board, and the official seals of the Board and the Commission.
A Professional Identification Card bearing the full name of the registrant, serial number, date of issuance, registration number, expiry date, and duly signed by the Commission Chairperson shall likewise be issued to every registrant who has paid the prescribed fee of annual registration for three (3) years; Provided, that, the reissuance or the renewal of said card shall be subject to payment of the annual registration fees for another and every after three (3) years.
SECTION 19. Fees for Examination, Registration and License. — Applicants for examination and registration and for the issuance of Professional Identification Card shall pay the fees prescribed by the Commission.
SECTION 20. Oath. — All successful examinees and registrants without examination shall be required to take a professional oath before any member of the Board or before any official authorized by the Commission or any government official authorized by law before they start their practice.
SECTION 21. Refusal to Register. — The Board shall refuse to register an applicant as a veterinarian and to issue his/her Certificate of Registration and Professional Identification Card if the applicant is convicted of any criminal offense involving moral turpitude or found guilty of immoral or dishonorable conduct, or the applicant is declared by the court to be of unsound mind or have violated R.A. No. 8485, the "Animal Welfare Act of 1998". The Board shall furnish the applicant a written statement setting forth the reasons for its action. The record of refusal to register shall be incorporated in the records of the Board and the period for the deferment of the registration if the offense or act committed does not call for indefinite period and/or perpetual deprivation of the chance to register.
SECTION 22. Revocation of Certificate of Registration and Suspension from the Practice of Veterinary Medicine and Cancellation of Special Permit. — The Board shall have the power to reprimand or suspend any person from the practice of veterinary medicine, revoke the Certificate of Registration of a registered veterinarian or to cancel a special permit issued upon any of the following grounds:
a. Any of the causes mentioned in Section 21 of this Resolution;
b. Unprofessional and unethical conduct;
c. Gross incompetence, gross negligence, gross ignorance or any other acts of malpractice resulting in the disability, disfigurement or death of an animal;
d. Use of fraud, deceit, or false statements in obtaining registrations, Certificate of Registration, Professional Identification Card, or Special Permit and failing to inform the Board of any disciplinary action by the licensing board of another country;
e. For chronic inebriety or habitual use of or addiction to drugs or regulated and/or prohibited substances;
f. Having professional connection with or lending one's name to an illegal practitioner of veterinary medicine and various branches thereof and permitting, aiding, or abetting an unlicensed person to perform activities requiring a license;
g. Fraud or dishonesty in applying, teaching or report on any laboratory test and research findings;
h. False and/or misleading advertising, having for its purpose or intent to deceive or to defraud and/or using the term "specialist" or an equivalent without being board-certified;
i. Knowingly and deliberately concealing or failing to report as required by law, or making false report, the spread of zoonotic, contagious, or infectious diseases;
j. Violation of the rules and regulations, Code of Ethics, Code of Technical Standards and other policies issued by the Board and the Commission pursuant to R.A. 9268; and
k. Practicing his/her profession during the period of his/her suspension from the practice of his/her profession.
SECTION 23. Rights of Respondent. — The respondent veterinarian shall be entitled to counsel, a speedy public hearing, and to confront and cross-examine witnesses against the respondent.
SECTION 24. Administrative Investigation. — Within five {5} days after filing of written charges under oath, respondent registered veterinarian shall be furnished a copy thereof requiring him to answer the same. Failing to respond within the prescribed period shall constitute a waiver on the part of the respondent. The Board shall conduct an administrative investigation or any of its members as may be designated by the Chairman of the Board and a legal or hearing officer of the Commission, on cases involving the practice of the profession; Provided, however, that the Board should promulgate the decision.
The rules on administrative investigation issued by the Commission shall govern hearing or investigation of the case, subject to applicable provisions of R.A. No. 9268, R.A. No. 8981, and the Rules of Court.
SECTION 25. Appeal. — The decision on the denial or refusal to issue Certificate of Registration, the revocation or suspension of the Certificate of Registration, and the cancellation of special permit by the Board shall be final unless appealed to the Commission within fifteen (15) days from receipt of the decision. The decision of the Board and/or Commission may be appealed to the Court of Appeals.
SECTION 26. Reinstatement. — Subject to the approval of the Commission, a person may apply to the Board for reinstatement of his/her Certificate of Registration any time after the expiration of one (1) year from the date of revocation of said certificate. The application shall be in writing and shall conform to the requirements provided by the Board. No certificate shall be reinstated unless the Board is satisfied that a good cause exists to warrant such reinstatement.
The Board shall issue a resolution, subject to the approval by the Commission, in granting a petition for reinstatement to the practice of veterinary medicine.
SECTION 27. Indication of Certificate of Registration andProfessional Identification Card and the Professional Tax Receipts. — A registered and licensed veterinarian shall indicate his/her Certificate of Registration/Professional Identification Card number with date of issue and expiry and the Professional Tax Receipt (PTR) number which the City/Municipal Treasurer shall issue thereto, on the prescription, vaccination certificate, health certificate, veterinary drug order, and other documents that he/she signs, uses, or issues in connection with the practice of his/her profession.
SECTION 28. Automatic Registration. — All veterinarians whose names appear in the roster of veterinarians shall be automatically or ipso facto registered as veterinarians under R.A. No. 9268.
RULE IV
Practice of Veterinary Medicine
SECTION 29. Acts Constituting the Practice of Veterinary Medicine. — A person who is authorized to practice veterinary medicine under RA 9268 shall append or cause to be appended to his name the letters D.V.M. (Doctor of Veterinary Medicine), V.M.D. (Veterinary Medical Doctor), D.V.S. (Doctor of Veterinary Science), or the words "Veterinarian", "Veterinary Surgeon", "Veterinary Dentist", or "Veterinary" or any other initial or title implying qualification to practice, offer or render, for a fee or otherwise, services such as:
a) the examination and/or diagnosis, treatment, surgery of, or the prescribing and dispensing of any remedy for, any injury to or disease, ailment or deformity of animals;
b) attesting for official or commercial purpose to the health, of any terrestrial or aquatic, domestic or non-domestic animals;
c) rendering of veterinary technical services which directly or indirectly bear upon the health and welfare of human beings and animals;
d) attesting to the fitness for human consumption of animal products and by-products;
e) holding of any job or position in a public or private entity, which requires knowledge of or skill in veterinary medicine; or
f) teaching or lecturing of veterinary clinical subjects in the curriculum of the degree in veterinary medicine.
Provided, That the enumeration of the above practices or services in this Section shall not be construed as excluding any other work requiring knowledge and application of professional veterinary medicine which the Professional Regulatory Board of Veterinary Medicine may specify upon recommendation of the accredited professional organization of veterinarians.
SECTION 30. Unlawful Practice of Veterinary Medicine. — It shall be unlawful for any person to practice veterinary medicine and any of its allied branches, including veterinary dentistry, without a valid Certificate of Registration and Professional Identification Card issued by the Board and the Commission.
SECTION 31. Foreign Reciprocity. — No foreigner shall be admitted to the examination or be registered as veterinarian under R.A. No. 9268 unless he/she proves that the country of which he/she is a citizen of, either permits Filipino citizens to practice veterinary medicine without need for registration, without restriction, or allows them to practice after an examination on terms of strict and absolute equality with nationals of said country.
A person who is not a citizen of the Philippines at the time he/she applies to take the examination shall not be allowed to take the licensure examination unless he/she can prove, in the manner provided by the Rules of Court that, by specific provision of law, the country of which he/she is a citizen, subject or national either admits citizens of the Philippines to the practice of the same profession without restriction or allows them to practice it after passing an examination on terms of strict and absolute equality with citizens, subjects or nationals of the country concerned, including the unconditional recognition of prerequisite degrees/diplomas issued by the institutions of learning duly recognized for the purpose by the Government of the Philippines.
A foreign citizen, whether he studied in the Philippines or not, who desires to take the licensure examination for Veterinarians through reciprocity shall initiate the establishment of reciprocity between his country/state and the Philippines by presenting/submitting a letter or any document signed and under official seal by the appropriate official of his country/state requesting the Board and the Commission to allow the foreign applicant to take the licensure examination for veterinarians that by express provision of the law of his country/state, Filipino citizens shall be allowed to take the licensure examination for Veterinarians and to register as Veterinarians in his country/state on terms of strict and absolute equality with the citizens, subjects or nationals of said country/state including the unconditional recognition of prerequisite degrees issued by institutions of higher learning duly recognized or established by the Government of the Republic of the Philippines attaching/appending thereto an authentic or authenticated official copy of said law officially translated in the English language.
If the letter/document and the copy of the law submitted by the applicant is satisfactory to the Board, the foreign applicant shall be allowed to take the licensure examination for Veterinarians by requiring him to file an application to take the licensure examination and by submitting the following documents that shall accompany the application:
a. The original or certified copy of any official document issued by the Bureau of Immigration and Deportation allowing the applicant to enter and reside in the Philippines;
b. Present his passport for examination and for photocopying of pertinent information about the applicant;
c. Original or authenticated copy of transcript of records or equivalent document of the course for licensure examination issued by the institution of higher learning where he studied, duly authorized or accredited by his country/state; and
d. Other documents which may be required to be submitted by the Board.
SECTION 32. Roster or Record of Veterinarians. — The Board shall keep a roster or record of the names, residences and office address of all registered and licensed veterinarians. The said roster or record shall be made available to the public upon request and payment of prescribed fees therefor.
SECTION 33. Penal Provisions. — The following persons shall be punished:
(a) Any person who shall practice veterinary medicine within the meaning of RA 9268 without a valid Certificate of Registration and a valid Professional Identification Card or a valid special permit issued in accordance herewith;
(b) Any person presenting or using as his/her own Certificate of Registration or Professional Identification Card of another;
(c) Any person who shall give any false or forged evidence or misinformation of any kind to the Board or the Commission in obtaining registration;
(d) Any person who shall falsely impersonate any registrant with like or different name;
(e) Any registered and licensed veterinarian who shall abet or assist illegal practice of a person who is not lawfully qualified to practice veterinary medicine;
(f) Any person who shall attempt to use a revoked or suspended Certificate of Registration or an invalid or unexpired Professional Identification Card or a cancelled Special Permit;
(g) Any person assuming, using or advertising any title, description tending to convey the impression that he/she is a registered and licensed veterinarian; or
(h) Any person who violates any provisions of R.A. No. 9268 and this Resolution shall upon conviction, be punished by a fine of not less than fifty thousand pesos (P50,000.00) nor more than one hundred thousand pesos (P100,000.00) or by imprisonment of not less than one (1) year nor more than five (5) years, or both fine and imprisonment for each and every offense at the discretion of the court.
SECTION 34. Enforcement. — The Commission shall implement the provisions of this Resolution, enforce this "IRR of the Philippine Veterinary Medicine Act of 2004", and assist the Board in the investigation of complaints against violators of this Act, its rules and regulations, and other policies of the Board.
The Commission shall call upon or request any department, instrumentality, office, bureau or agency of the government including local government units to render such assistance as it may require to coordinate or cooperate in order to carry out, enforce or implement the provisions of this Resolution.
SECTION 35. Funding Provision. — The Chairperson of the PRC shall immediately include in the Commission's programs the implementation of R.A. 9268, the funding of which shall be included in the annual General Appropriations Act.
The amount necessary to carry out the initial implementation of R.A. No. 9268 shall be charged against the current year's appropriations of the Commission. Thereafter, such sums as may be necessary for the continued implementation of R.A. No. 9268 shall be included in the annual General Appropriations Act (GAA).
SECTION 36. Implementing Rules and Regulations. — Within sixty (60) days after the effectivity of R.A. No. 9268, subject to the approval of the Commission, the Board in coordination with the accredited professional organization, shall promulgate the "IRR of the Philippine Veterinary Medicine Act of 2004", which shall be effective after fifteen (15) days following its publication in the Official Gazette or newspaper of general circulation.
SECTION 37. Separability Clause. — If any part of this Resolution is declared unconstitutional, the remaining parts not affected thereby shall continue to be valid and operational.
SECTION 38. Repealing Clause. — Any provisions of the rules and regulations, codes, orders, resolutions, measures and other policies or parts thereof issued and promulgated pursuant to R.A. No. 382, P.D. No. 223 (as amended), R.A. 8981 and other laws which are inconsistent with this Resolution, known as the "IRR of the Philippine Veterinary Medicine Act of 2004", are hereby superseded, repealed or amended accordingly.
SECTION 39. Effectivity. — This "IRR of the Philippine Veterinary Medicine Act of 2004" shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or national newspaper of general circulation.
