RESOLUTION APPROVING AND ADOPTING THE IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 9442, AN ACT AMENDING REPUBLIC ACT NO. 7277, OTHERWISE KNOWN AS THE "MAGNA CARTA FOR PERSONS WITH DISABILITY AS AMENDED, AND FOR OTHER PURPOSES", SUBJECT TO SOME CORRECTIONS AND EDITING

WHEREAS, the President, Her Excellency GLORIA MACAPAGAL-ARROYO signed into law on April 30, 2007, Republic Act No. 9442, an Act Amending Republic Act No. 7277, Otherwise known as the "Magna Carta for Persons with Disability as amended, and For Other Purposes" Granting Additional Privileges and Incentives and Prohibitions on Verbal, Non-verbal Ridicule and Vilification Against Persons with Disability.

WHEREAS, Section 5 states that the Department of Social Welfare and Development (DSWD), the National Council for the Welfare of Disabled Persons (NCWDP), and the Bureau of Internal Revenue (BIR), in consultation with the concerned Senate and House Committees and other agencies, organizations, establishments shall formulate an Implementing Rules and Regulations pertinent to the provisions of this Act after its publication in two (2) newspapers of general circulation; HIAcCD

WHEREAS, this Implementing Rules and Regulations is the result of a series of consultations with concerned National Government Agencies, Organizations of Persons with Disability and Non-government Organizations with the special participation of representatives from the leagues of cities and municipalities and the business sector;

WHEREAS, this Implementing Rules and Regulations considers the Implementing Rules and Regulations of Republic Act No. 9257 known as the "Expanded Senior Citizens Act of 2003" as a reference.

NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, by the Board of the National Council for the Welfare of Disabled Persons to approve and adopt the Rules and Regulations Implementing Republic Act No. 9442, otherwise known as an 'Act Granting Additional Privileges and Incentives and Prohibitions on Verbal, Non-verbal Ridicule and Vilification Against Persons with Disability Amending for the Purpose Republic Act No. 7277, Otherwise known as the "Magna Carta for Persons with Disability as amended, and For Other Purposes", subject to some corrections and editing;

RESOLVED FURTHER that these Implementing Rules and Regulations shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation and filed with the Administrative Registrar, University of the Philippines Law Center as required under the Administrative Code of 1987.
