EXECUTIVE ORDER NO. 161
TRANSFERRING THE OVERSIGHT OF THE FILM DEVELOPMENT COUNCIL OF THE PHILIPPINES FROM THE DEPARTMENT OF EDUCATION TO THE DEPARTMENT OF TRADE AND INDUSTRY
WHEREAS, Section 2 of Republic Act (RA) No. 9167 established the Film Development Council of the Philippines (FDCP) under the Office of the President, to encourage and undertake activities that will promote the growth and development of the local film industry, and to develop programs that will enhance the skills and expertise of Filipino talents necessary for quality film production, among others;
WHEREAS, Executive Order (EO) No. 837 (s. 2009) placed the FDCP under the oversight of the Department of Education (DepEd), in light of that Department's mandate to develop the country's educational system, including the advancement of film, music and the arts;
WHEREAS, the mandate of the FDCP includes developing the local film industry, promoting its participation in both domestic and foreign markets, and formulating and implementing policies and programs to upgrade the art and craft of filmmaking, as well as encourage the production of films for commercial purposes;
WHEREAS, EO No. 133 (s. 1987) vests in the Department of Trade and Industry (DTI) the mandate and function of: (i) planning, implementing and coordinating activities of the government related to trade, industry and investments; (ii) coordinating efforts for the formulation of long-term industry sectoral plans with the private sector; and (iii) implementing programs and activities geared towards the promotion of Philippine exports in overseas markets;
WHEREAS, through FDCP Resolution No. 28 (s. 2021), the members of the FDCP recommended the transfer of oversight powers over the Council from the DepEd to the DTI to streamline its programs and strengthen its function to develop the Philippine cinema as a globally competitive film industry that contributes to the economic development of the country;
WHEREAS, it is a policy of the government to strengthen and rationalize oversight functions in the Executive, and further streamline the relevant mandates of offices for more responsive collaboration and effective performance of functions; and
WHEREAS, Section 17, Article VII of the Constitution provides that the President shall have control of all executive departments, bureaus and offices;
NOW, THEREFORE, I, RODRIGO ROA DUTERTE, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:
SECTION 1. Placing the FDCP under the Oversight of the DTI. — Oversight of the FDCP is hereby transferred from the DepEd to the DTI. The DTI shall exercise its oversight over the FDCP under the terms governing the relationship of administrative supervision.
SECTION 2. Repeal. — All orders, rules, regulations and issuances or parts thereof, which are inconsistent with this Order, are hereby repealed or modified accordingly.
SECTION 3. Effectivity. — This Order shall take effect immediately.
DONE in the City of Manila, this 27th day of January, in the year of Our Lord, Two Thousand and Twenty-Two.
