Suspension of the Commitment Orders for the Transfer of Persons Deprived of Liberty (PDLs) from the Jail Facilities of the Bureau of Corrections
OCA Circular No. 125-2020 temporarily suspends the issuance of commitment orders for the transfer of Persons Deprived of Liberty (PDLs) from the Bureau of Jail Management and Penology (BJMP) to the Bureau of Corrections (BuCor) until August 31, 2020. This measure aims to prevent the spread of COVID-19 among PDLs and minimize their movement between facilities. All convicted PDLs who would have been transferred to BuCor will remain in BJMP during this period. The circular is addressed to all judges of first and second level courts nationwide for guidance and compliance.

Considering the letter of Usec. Gerald Q. Bantag, Director General, Bureau of Corrections, Department of Justice, dated 22 July 2020, "respectfully request(ing) to temporarily suspend as well the issuance of Commitment Order to the Director General of the Bureau of Corrections (BuCor) for the transfer of convicted PDL (Person Deprived of Liberty) from the Bureau of Jail Management and Penology (BJMP) to the BuCor, from this date up to August 31, 2020," "to prevent the further contamination of COVID-19 among PDL and to minimize the movement of PDL from BJMP to the Bureau of Corrections," and consistent with OCA Circular No. 121-2020 which temporarily suspended the issuance of commitment orders to the BJMP jail units until 31 August 2020, the issuance by the courts of commitment orders from the BJMP jail units to the BuCor is HEREBY SUSPENDED, effective today until 31 August 2020. All convicted PDLs who should have otherwise been committed to the BuCor shall in the meantime remain and be committed in the BJMP jail units.
