Suspension of Commitment Orders for the Transfer of Persons Deprived of Liberty to the Different Jail Facilities
OCA Circular No. 149-2020 extends the suspension of commitment orders for transferring Persons Deprived of Liberty (PDLs) to various jail facilities until September 30, 2020, in light of ongoing COVID-19 community quarantine measures. This follows previous circulars that halted the issuance of such orders for newly arrested and convicted PDLs unless the local Bureau of Jail Management and Penology could accommodate them. The circular aims to ensure the safety and health of both the PDLs and the facilities during the pandemic. All judges of the First and Second Level Courts nationwide are instructed to comply with this guidance.

Considering that the country remains to be in different levels of Community Quarantine due to the COVID-19 pandemic, OCA Circular No. 121-2020, which suspended the issuance of commitment orders for newly arrested Persons Deprived of Liberty (PDLs) to the local Bureau of Jail Management and Penology (BJMP) jail units unless the said BJMP jail units are already able to admit newly arrested PDLs, and OCA Circular No. 125-2020, which suspended the issuance of commitment orders for convicted PDLs to the Bureau of Corrections, are BOTH HEREBY EXTENDED until 30 September 2020.
