DENR MEMORANDUM CIRCULAR NO. 03-09

SUBJECT  Supplemental guidelines and procedures in the implementation of the Upland Development Program

 

In support of the government's Economic Resiliency Plan: Comprehensive Livelihood and Emergency Employment Program (CLEEP) and pursuant to DENR Memorandum Circular 2008-04 entitled "The 2009 Upland Development Program (Reforestation and Agroforestry)", as well as to guide UDP implementors and participants towards a common framework and understanding of the mechanics for implementation, the following supplementary guidelines and procedures are hereby issued:

SECTION 1. Objectives. — The Program's specific objectives are:

1.1 Create additional and immediate employment and incomes for poor upland households and people's organizations;

1.2 Pump-prime the local economy through the infusion of public investments in forestlands development;

1.3 Improve the productivity and soil and water conservation functions of forestlands currently cultivated as upland agricultural farms through agroforestry; reforestation, assisted natural regeneration and enrichment planting in public forestlands and protected areas;

1.4 Rehabilitate, effectively manage, and protect forests and forestlands, watersheds, mangroves, urban forest parks, coastal zones, protected areas, and protection forestlands considering the roles of these areas in providing water for irrigation, power, and municipal water systems, in the provision of vital forest-based goods and services, in the conservation of biodiversity resources, and in the mitigation of, and adaptation to, climate change;

1.5 Demonstrate measurable and verifiable improvements in the quality of life of upland communities, the provision of environmental goods and services, including increasing forest cover, enhancing food and fuelwood production in the uplands and coastal areas, improving water yield and quality of watersheds, soil conservation, biodiversity conservation and climate change mitigation and adaptation.

SECTION 2. Scope and Coverage. — This memorandum circular prescribes the procedures for the engagement of program implementors, the development planning process, cost standards, financial management and quality control, monitoring, assessment, reporting, program audit, and overall implementation.

2.1 Areas for development. The UDP development activities shall be directed mainly to the upland areas of the provinces identified as priority under the Accelerated Hunger Mitigation and Poverty Alleviation Program; the watersheds of major irrigation, power and municipal water systems; the headwaters of major river systems or river basins; highly vulnerable protection forestlands, mangroves, urban and coastal areas; areas affected by natural calamities, and degraded areas in protected areas. 1 These development activities shall comprise:

2.1.1 establishment and operations of fruit-bearing and forest tree nurseries by people's organizations (POs);

2.1.2 development of individual upland farms through the implementation of agroforestry techniques;

2.1.3 reforestation of grassland areas in the Community-Based Forest Management (CBFM) or Community-Based Natural Resource Management (CBNRM) area, as identified in the existing Comprehensive Development and Management Framework and work plans of the POs;

2.1.4 reforestation of degraded areas in priority watersheds and protected areas;

2.1.5 implementation of assisted natural regeneration (ANR) in appropriate areas of the CBFM/CBNRM areas, in priority watersheds, and in protected areas; DScTaC

2.1.6 conduct of enrichment plantings (EP) in sparsely-wooded grasslands, mangroves and tidal flats;

2.1.7 revegetation of streambanks through ANR or enrichment planting (ANR/EP), or both;

2.1.8 development of urban forest parks; and

2.1.9 maintenance and protection from fire, pest and diseases of the established tree plantations.

2.2 Implementing partners and scope of work. The program shall be implemented by engaging the following development partners/implementors, who shall not be related to DENR officials and employees up to 3rd degree of consanguinity provided, that this prohibition shall not apply to a farmer or group member who is an actual tiller of the area where the project is located, and is certified under oath by the concerned DENR official or employee that said relative depends solely on his/her farm for his/her livelihood: SDIACc

2.2.1 People's organizations (POs) 2 engaged in the Community-Based Forest Management (CBFM) strategy and in similar community-based natural resources management (CBNRM) work, which shall be provided financial and technical assistance to establish nurseries and to produce the tree seedlings for reforestation, agroforestry, or ANR/EP in their respective CBFM/CBNRM areas. These nurseries shall be maintained in the future to continue to produce the seedling requirements for their CBFM/CBNRM development work. The POs may tap the services of senior citizens and in- and out-of-school youth, who may or may not be members, in this undertaking.

2.2.2 Individual farmers who are active members of the PO cited above shall be provided financial assistance for the procurement of appropriate quality fruit tree seedlings, seeds of cash crops and high-value crops, and such other farm inputs as are necessary to develop their farmlots into agroforestry farms. 3 Forest tree seedlings for interplanting in their farmlots shall come from their nursery as stated in 2.2.1 above. AEDcIH

2.2.3 The PO engaged in 2.2.1 above and individual households shall also be contracted to reforest, through planting or in combination with ANR/EP, grasslands, sparsely wooded lands or degraded streambanks within their CBFM/CBNRM area including first cycle maintenance and protection. In order to attain more effective impact of the development undertaken, as well as to ensure better protection from wildfires, their areas to be developed should be clustered together. Forest tree seedlings for reforestation shall come from their nursery as stated in 2.2.1 above.

2.2.4 Other upland farmer households, senior citizens, in- and out-of-school youth may also be contracted individually to undertake reforestation including first cycle maintenance and protection, in other untenured forestlands within the same barangay where UDP development activities are directed, provided that they are bona fide residents of that barangay. In order to attain more effective impact of the development undertaken, as well as to ensure better protection from wildfires, their areas to be developed should be clustered together. Forest tree seedlings for their reforestation shall be initially sourced out from DENR nurseries, or from the nurseries of POs as stated in 2.2.1. However, seedlings sourced out from DENR shall be replenished by the PO contracted to raise the seedlings.

2.2.5 Barangay LGUs and civil society organizations may be provided technical and material inputs for the establishment of urban forest and tree parks in their respective localities.

2.3 Technical and support services from DENR. Technical and support services shall include, but not be limited to:

2.3.1 conduct of consultation meetings among and between members of CBFM/CBNRM people's organizations, upland households, barangay officials, LGU executives and agricultural officers of the municipal and provincial governments, and representatives of other agencies and organizations, colleges and universities, business and religious groups and other civil society organizations, who may be able to support upland farmers and other implementors of this program.

2.3.2 conduct of ground surveys and mapping of the areas identified by the participating POs, farmers and organizations for development; these surveys and maps shall be part of the inputs to the preparation of area development agreements and work and financial plans with the POs, farmers and implementing organizations;

2.3.3 provision of technical extension services on nursery and reforestation techniques, agroforestry methods, assisted natural regeneration and forest enrichment planting practices, and forest fire management; 4

2.3.4 capacity building, monitoring, assessment and reporting, documentation and mapping of development accomplishments.

DENR field offices and program implementors shall, when appropriate and applicable, link agroforestry production activities in the locality to the raw material requirements identified by the Department of Trade and Industry and the local government units under the "One Town One Product" (OTOP) concept.

SECTION 3. Program Targets, Area and Budget Allocation. — The UDP budget shall be utilized for the development of areas identified in Section 2 and Annex B hereof, provided, that project areas already being supported by development resources from donor agencies and local funding shall not be included.

DENR personnel shall be guided by the program objectives of hunger mitigation, employment and income generation for upland farmers, and pump-priming of the rural economy, coupled with the principle of achieving maximum economic and environmental impacts for public resources invested in this program. For these reasons, the distribution of resources and development targets under UDP shall, as much as possible and as appropriate at the watershed landscape level, be as follows: aSTHDc

3.1 forty percent (40%) for agroforestry development of upland farms

3.2 forty percent (40%) for reforestation of grasslands; and

3.3 twenty percent (20%) for assisted natural regeneration, enrichment planting, stream bank revegetation, and mangrove plantings, or combinations thereof, and urban forest parks development.

The above distribution shall apply at the provincial level or watershed level, and not necessarily at the individual project site level. At the site (CBFM/CBNRM area) level, the distribution will depend on the development requirements as set out in the CBFM/CBNRM development frameworks (CRMF) and work plans, or through consensus among the PO members and other participating implementors guided by technical inputs of DENR field staff based on overall development needs of the watershed or protected area within which the development activities shall be implemented. DENR field implementors should recognize that the mix of development approaches decided on for a province, watershed, or protected area have major cost (and resulting target areas and employment) implications because of the variance in unit development costs across approaches. SECTION 4. Organization and Pre-Development Activities. —

4.1 Organizational arrangements within the DENR

The Regional Executive Director (RED) shall organize a regional task force composed of staff from the various sectoral services and support units of the regional office. The regional task force shall render planning and financial management support, as well as provide guidance and technical manuals, publications and similar material, to the Provincial Environment and Natural Resources Offices (PENROs), Community Environment and Natural Resource Offices (CENROs), provincial UDP task forces and PO implementers, upland households and other implementing organizations.

The REDs shall likewise initiate the organization of provincial UDP task forces, composed jointly of PENRO and CENRO staff 5 which shall be dedicated to undertaking the field activities in the implementation of the program. These task forces shall be under the direct supervision of the PENRO while the CENROs shall oversee the day-to-day work of these task forces in their respective areas of jurisdiction. DHTCaI

At least one provincial task force shall be organized to undertake the following activities:

i. identification of final areas 6 to be developed, and the POs, individual PO member, other upland farmer households, barangay council and other civil society organizations who will be engaged 7 in the development of these areas;

ii. consultations with the POs and participating organizations in the watersheds, protected areas and other areas decided upon in (i), in order to get their concurrence and commitment to implement the program, and decisions on the land development mode(s) to be implemented in their respective areas;

iii. joint formulation of detailed development work and financial plan with the PO, households or participating organizations, the finalization of Letters of Agreement, and other requisite documentation, for the commencement of development work;

iv. continuous provision of technical advice and coaching to ensure that the development work set out in the development work and financial plan is undertaken by the PO and other implementors according to schedule and standards set out in these guidelines;

v. assistance to PO and other implementors in documentation to support payment requests for the land development activities implemented.

Another provincial task force shall be organized and dedicated to (1) undertake ground survey and mapping of the areas identified and agreed upon for development, 8 in accordance with standards for forest surveys of DENR; (2) prepare maps and related documents to support the final Letters of Agreement executed by and between the PO and other implementing organizations or households, and DENR as facilitated by the provincial task force referred to previously; (3) integrate the survey results and maps into the FIS and GIS control maps in the CENRO, PENRO and regional offices; and (4) during implementation of land development work, undertake ground validation and documentation of work accomplished by POs and other implementors, to support their payment requests.

4.2 Determination of areas and selection of participant-implementors

The priority areas for development, their locations, and the prescribed land development modes are listed in Annex B (see footnote #7). The determination of specific areas, locations, implementing organizations and development modes shall be through the following process:

4.2.1 The PENRO, through the provincial UDP task force, shall issue an invitation for submission of letters of intent 9 to undertake UDP development in the barangays identified in the aforementioned long-list of areas. Such call for letters of intent shall be in writing, preferably in the local dialect, and posted in the respective barangay halls, municipal halls and other public places where the long-listed areas are located (see Annex C-1 to C-4 format of call for letters of intent). The PENRO shall also inform other government officials concerned of such undertaking.

4.2.2 The call for letters of intent shall, among others, contain the following:

4.2.2.1 The extent (area) of the pre-identified (in the long-list) development site;

4.2.2.2 The indicative extent (area) for reforestation, agroforestry, ANR/EP, etc., within the area;

4.2.2.3 The express condition that submissions by POs involved in community-based forest or protected areas management in the locality, shall be given high preference. These POs are:

i. holders of active tenurial instruments in CBNRM (e.g., CBFMA, PACBNRMA, CSC, CCFS, FLMA, etc.), or

ii. are in the process of acquiring the appropriate tenurial instrument in CBNRM, and actively engaged in CBFM/CBNRM implementation in the uplands.

iii. duly-registered organizations in the context of the community-based forest or resource management (CBFM/CBNRM) strategy (EO 263).

iv. indigenous people's groups with valid ancestral domains claims, or ancestral domains titles, under the IPRA.

v. in case the long-listed area is located within the CBFM/CBNRM areas of the submitting PO (in the case of items i to iii above), or within CADC/CADT areas of the submitting IP organization (as in the case of item iv above), the submission of the PO/IP concerned will be accepted first. Only if the PO/IP or group concerned expressly indicates, in writing by their Board of Directors, Council of Elders, or their governing body, that they are allowing another organization to signify its intention over the area, may the outsider organization's submission be accepted. ECDaTI

vi. for urban forest parks development, high priority shall be accorded to the barangay LGUs who have jurisdiction over these areas.

4.2.2.4 Provision for non-CBFM/CBNRM organizations, out-of-school youth and individual heads of households in the barangay who may opt to participate;

4.2.2.5 A pro forma letter of intent (see Annex D-1 to D-4) which the submitting organizations and other partners could easily accomplish and submit to DENR.

4.2.3 The call for letters of intent shall indicate the deadline for submission, which should be within 30 calendar days from the date of posting, or the immediately succeeding working day if the 30th day is a non-working day. aETADI

4.2.4 It should be explicitly stated in the call for letter of intent that such should be submitted to, and officially received and acknowledged by, the records office of the CENRO which has jurisdiction over the area, to be forwarded to the Provincial Task Force.

4.3 Appraisal of letters of intent to undertake UDP

Within seventy-two (72) hours from the closure of acceptance of letters of intent, the PENRO shall convene and chair a joint meeting of the Provincial UDP Task Force and the Regional UDP Task Force to appraise the submissions of letters of intent for one or several long-listed UDP areas in the province. Representatives of the municipal and provincial development offices and agriculture offices, local civil society and religious organizations shall be invited as observers. The result of the appraisal shall be the decision on the final sites and areas, development modes to be undertaken in the chosen site(s), and the implementor(s).

The outcome (decision on areas, 10 development modes and implementor) requires that a set of criteria should have been formulated way beforehand. For this purpose, the Regional Task Forces shall prepare, and the RED shall approve, the criteria and evaluation methods to be used uniformly throughout the region. A region-specific set of criteria and methods is appropriate since there are region-specific factors that need to be considered, such as but not limited to: (1) within-region priorities between the various watersheds and river systems, (2) relative levels of upland poverty in the different municipalities and barangays, (3) the priorities set out in the Regional Investment Plan for the Philippine Forestry Master Plan and other related ENR plans in the regions and provinces, (4) level of current and future support to upland development by the local governments concerned, and (5) priorities on where forest rehabilitation and forestland management should be focused. cHaICD

These criteria and evaluation methods should likewise be posted in local government and barangay centers, and in other public places.

The joint task forces shall complete their appraisals for each session (involving one, several, or all sites in the province) within forty-eight (48) hours upon convening. A complete set, and copies, of documentation of the submissions, appraisal and evaluation process, and final decisions on area, location, development modes and implementors shall be distributed immediately as follows: originals on file at the PENRO and a complete set of certified copies for the CENRO concerned, regional office and FMB. Simultaneously, the joint task forces shall prepare communications to all submitting parties: (1) to the proponents who were chosen to be implementors, informing them likewise that they and the provincial UDP task force should immediately convene to prepare the detailed implementation plans and Letter of Agreement (LOA) for UDP implementation; (2) to the proponents whose proposals were not considered, informing them of the reasons for not having been chosen, but likewise informing them that their proposals will be kept open for consideration in the future when additional UDP resources are available. These communications shall be signed by the PENRO as convening chairperson, and all members of the joint task forces that convened. These communications should be sent immediately to the parties concerned, preferably through the DENR messengerial services, or by special registered mail.

4.4 Area development planning and final agreements

Within five (5) working days from the promulgation of the decisions of the joint regional and provincial task forces, the two provincial task forces shall be mobilized by the PENRO to undertake consultations, ground planning, surveys and mapping, and other predevelopment activities with the organizations and implementors (see para 2: Organizational arrangements within DENR above). The task forces should organize their deployment and work assignments so that this phase of the work would be completed within 5 days for each PO or group of implementor in a site.

 

The final output of this activity shall be a work plan together with the supporting maps, physical target specifications, and financial disbursement schedules. This should be confirmed jointly by the members of the task force(s) and the appropriate representatives of the implementing POs or organizations. A Letter of Agreement to implement the agreed-upon plan shall likewise be prepared (see LOA templates, Annexes E-1 to E-4) to be signed by the implementor and the CENRO. The LOA for individual PO members shall be supported by a certification by the PO chairman of their membership. A Notice to Proceed shall then be issued to the PO or other implementors by the CENRO within two (2) days after signing of the LOA.

The CENRO, PENRO and Regional Office shall prepare a registry of all agreements or contracts entered into by and between the DENR and implementors for submission to the National Program Management and Advisory Committee (NPMAC) through the National Technical Working Group (NTWG). These lists shall also be provided to local chief executives of the municipalities/provinces as well as to religious organizations and academic institutions where the development projects are located. The lists shall likewise be posted in public places such as municipal and barangay halls. The posting shall include among others, the names of partner implementors, location, activities to be undertaken, timetable and development cost. CHTAIc

4.5 Quality control and safety nets

4.5.1 Establishment and operations of a nursery for each project site. This nursery shall cater to the planting requirements of reforestation, agroforestry, ANR, enrichment plantings, mangrove rehabilitation and streambank protection. It shall be strategically located within the target planting site in the CBFMA, PACBRMA or similar tenurial instrument area. The nursery shall have a facility for composting. To improve the quality of seedlings and ensure high survival rate, 4 X 6 polyethylene plastic bags shall be used.

4.5.2 Production of quality planting materials. 11 Seeds shall be sourced, as much as possible, from selected mother trees or seed stands identified by the DENR-ERDS. Use of indigenous species is highly encouraged, especially for assisted natural regeneration and enrichment planting. When appropriate and available, the use of cloned-planting materials is encouraged. Seedlings produced shall be distributed to both PO-members who are participating, and to non-member implementing households, provided, that the cost of seedlings provided to the latter from these PO nurseries should be reimbursed to the PO out of the contract cost of the non-PO member.

4.5.3 Use of indigenous species, where appropriate. Subject to the requirements in accordance with the Wildlife Resources Conservation and Protection Act (RA 9147), collection of wildlings may be allowed provided that appropriate and acceptable collection techniques with least or no detrimental effects to the wildlife population and their habitats shall be employed. The collected wildlings shall be planted only within the natural range of the species to enhance its wild population.

4.5.4 Procurement of high quality planting materials for agroforestry. Procurement of quality propagated planting stocks of fruit trees and seeds for short term agricultural crops and other high value agronomic crops for agroforestry development shall be provided for in the development phase of agroforestry farms. The implementor(s) shall be encouraged and trained to raise their preferred agroforestry planting materials for the subsequent phases. IHDCcT

4.5.5 Outplanting. For reforestation species the prescribed site preparation methods, spacing, and planting (4m x 4m, 4m x 3m, 3m x 3m, 2m x 4m or 2m x 3m) depending on the species and site condition shall be followed. For agroforestry, the spacing for fruit trees and nitrogen fixing trees shall range from 5m x 5m to 10m x 10m depending on the species. The planting of nitrogen-fixing hedgerows (e.g., kakawate, ipil-ipil, kadios, calliandra, etc.), fuelwood, food crops and high value agronomic crops should be emphasized in agroforestry. 12

4.5.6 Protection and maintenance of plantations. Protection of the plantations against pest and diseases, astray animals and forest fire shall also be of high priority. First cycle maintenance and protection shall include ring weeding, application of organic fertilizer, replacement of mortality, construction of firelines/firebreaks. Forest protection patrols, fire prevention and fire suppression shall be provided by the PO members as their counterpart inputs. A minimum survival rate of ninety-five percent (95%) for all trees planted shall be required.

SECTION 5. Development Cost Standards. —

The standard costs for the first year implementation of the three (3) development modes are presented below:

5.1 Nursery establishment and management — one hectare nursery at PhP50,000.00 or a fraction thereof, for every 100 hectares planned for reforestation and agroforestry development at each PO site, or the proportionate nursery size if the development area is less than 100 hectares.

5.2 Planting stock production — costed at PhP5.00 per seedling based on requirement for the reforestation area development, and for forest trees for agroforestry. This cost of production shall include cost of organic fertilizer and botanic pesticide for nursery use. DENR technical field staff should explicitly indicate in the nursery contracts the specifications (root collar diameter and height) of seedlings as final output, based on the species used. 13 The seedlings to be produced should be at least one (1) cm diameter at root collar and forty (40) cm high at the time of outplanting.

N.B.: Labor wage rates prevailing in the region shall be adopted, and the contract cost adjusted accordingly

5.4 The Project Management and Support Services which shall not exceed 15% of the development cost shall be allocated to cover the cost for survey, progress monitoring of the specific area to be developed and GIS-mapping (amounting to PhP1,500 per hectare). There shall be an amount allocated for the purchase of fire suppression tools and equipment 14 amounting to PhP400.00 per hectare. This is to ensure protection from wildfires of the established forest plantations, ANR/enrichment planting and agroforestry areas.

Purchase of fire suppression tools and equipment shall be undertaken by the PENRO concerned based on the needs of specific sites and in accordance with government procurement procedures.

5.5 The cost of services (labor) in the conduct of the abovementioned activities is subject to 7% VAT which shall be deducted from every payment made to the implementor(s).

The three-year costs of site development are attached as Annexes F1-F6 to be used as bases in forward programming of budget requirements for succeeding years for the areas developed in 2009.

SECTION 6. Funds Management. — Upon issuance of the Notice to Proceed (see Section 4, paragraph 4.5), the PENRO shall release a mobilization fund not exceeding fifteen percent (15%) of the contracted development cost through a check issued in the name of the PO, implementing organization or head of household.

 

The mobilization fund shall be used exclusively to start up activities identified in the work and financial plan which forms part of the LOA.

Succeeding payments shall be made through progress billings based on the results of performance evaluation (see section 4, item 4.1, paragraph 3). The schedule of payments, outputs and milestones of activities shall be as follows:

a. Nursery establishment and seedling production:

c. Reforestation

The PO, implementing organization or household shall submit request for progress payments to the CENRO concerned which shall be accompanied by the following supporting documents: 15

6.1 Progress and statement of work accomplishment (SWA) reports (see annexes 2A and 2B)

6.2 Sketch map indicating the areas developed, geographically referenced by using GPS receivers

6.3 Photo documentation of the area developed

The provincial task force #2 shall assist the implementor in the preparation of the above supporting documents.

The PENRO shall create an Inspection and Acceptance Committee (IAC) to be composed of personnel from PENRO and CENRO wherein a representative of the PENRO shall act as Chair, and CENRO representatives as members. The IAC shall perform the following functions: AcSHCD

i. Validate and inspect the accomplishments of the implementor in consonance with the approved work and financial plan within five (5) working days from receipt of the request for payment.

ii. Submit an Inspection and Acceptance Report (IAR) and other supporting documents to the PENRO within three (3) days after inspection for processing and payment of the progress billing.

iii. If the recommendation of IAC is for payment, the PENRO Accountant shall process the voucher within three (3) working days from receipt of the Inspection Report.

iv. If there are deficiencies in the accomplishment, the payment shall be deferred until such time that the PO has fully complied with the deficiencies pursuant to the provisions of the LOA, which shall not exceed two (2) months. IHCSET

The Task Forces and the IAC shall assume full responsibility (administrative, civil, or criminal liability) for the veracity, accuracy and authenticity of the supporting documents submitted, including entries therein to support the payment for the progress billing. Based on the said documents the PENRO Accountant shall process the Disbursement Voucher (DV) immediately. If there are deficiencies in the computation and supporting documents, the PENRO Accountant shall notify the concerned parties in order for them to comply with the requirements.

SECTION 7. Grounds for Suspension or Cancellation of LOA.

The RED concerned shall have the power and authority, after giving the implementor sufficient notice and opportunity to be heard, to suspend, cancel or rescind the LOA entered into for any of the following grounds:

7.1 Fraud, misrepresentation or omission by the implementor of material facts in obtaining the LOA which otherwise would have disqualified the PO or implementing organization;

7.2 Failure to start the project on the date specified in the LOA without just and reasonable cause;

7.3 Abandonment of the project area, or of the work stipulated in the LOA, for a period of at least one month from the date of discovery by DENR of such fact; or

7.4 Violation of, or failure to comply with, the terms and conditions of the agreement, the pertinent provisions of these Guidelines, and other ENR rules and regulations.

These provisions shall not preclude the Secretary from exercising his power and authority to rescind any agreement if, subject to due process, any of the above grounds for cancellation exist, without prejudice of imposing additional penalties such as, but not limited, to reimbursement to DENR of funds already disbursed to the implementor; blacklisting of the implementor from any future DENR or other government projects, and other applicable legal sanctions and penalties.

In the event of cancellation, the DENR shall have the right to enter into an agreement with another qualified implementor to continue the development of the area.

SECTION 8. Completion and/or Termination of LOA.

LOAs executed under this Circular shall be deemed concluded upon completion of the stipulated services or project in a manner acceptable to both parties.

SECTION 9. Program Management.

The management of the program shall be undertaken pursuant to DENR Memorandum Circular No. 2008-04, Special Order No. 2008-765 and Government Procurement Policy Board Resolution No. 31 dated December 14, 2007 approving the customized procurement manuals of the DENR specifically volume 3.

9.1 Project Management and Support Services (PMSS)

 The cost for the provision of program and project management and support services shall be proportionate to the target area for development, equivalent to 15% of the total development costs of all projects. This shall be sub-allocated as follows: 40% to the CENRO, 35% to the PENRO, 20% to the Regional Office, and 5% to the Central Office. ADaSET

 The Central Office PMSS shall be shared by the DENR Central Office, Forest Management Bureau (FMB), Ecosystems Research and Development Bureau (ERDB) and Protected Areas and Wildlife Bureau (PAWB) in such manner as shall be needed by each office as indicated in their respective UDP work and financial plans.

 The PMSS fund shall be used exclusively for the conduct of survey and GIS-mapping, consultations with stakeholders and development partners, provision of technical assistance, information, education/capacity building and communication, research and development in support of UDP implementation, and monitoring and evaluation.

9.2 Monitoring, Assessment and Reporting (MAR) System

 The UDP National Technical Working Group (NTWG) shall develop a MAR system for the program.

 The UDP National Program Operations Group (NPOG) shall conduct a mid- and year-end monitoring and evaluation of program implementation in coordination with DENR regional and provincial offices.

 DENR field offices together with PAMB, as in the case of protected areas, shall conduct periodic monitoring and evaluation of program physical accomplishments. The CENRO, PENRO and Regional Office shall prepare monthly progress reports for submission to the National Program Management and Advisory Committee (NPMAC) through the NTWG. The NTWG shall consolidate reports and process information for submission to the NPMAC.

 

 The DENR Planning and Policy Studies Office (PPSO) shall initiate a program impact audit to determine the program's outcomes and impacts vis-a-vis the objectives of UDP and the goal of sustainable development of the government. ASEIDH

 Independent organizations, such as religious organizations, academe, professional organizations and other relevant groups, shall be tapped to undertake third party peoples' audit to assess the efficiency and effectiveness of UDP implementation. For this purpose, the DENR shall ensure that full disclosure and transparency shall be observed at all times.

SECTION 10. Support from Other Institutions and Partners. — The DENR offices shall engage technical expertise from other institutions and partners to effectively implement the Program such as the Municipal and Provincial Agricultural Offices, academic institutions and civil society organizations on technologies needed for UDP implementation including capability building of POs. The DENR may pursue resource mobilization initiatives tapping the support of the corporate business sector, development partners and synergistic cooperation of government agencies (i.e., Gender and Development, Accelerated Hunger Mitigation, Convergence, etc.).

SECTION 11. Development Partnership with the Agribusiness and Forest Industry Sectors. — The development of areas through partnerships with agribusiness and industry sectors shall continue to be encouraged and supported by the DENR as part of UDP, in accordance with DENR Memorandum Circular 98-08 Guidelines on Contracting inside Community Based Forest Management Areas.

SECTION 12. Applicability. — This memorandum circular shall also serve as basis in implementing similar projects in the uplands.

SECTION 13. Repealing Clause. — This Circular supersedes other issuances inconsistent herewith.

SECTION 14. Effectivity Clause. — This Circular shall take effect fifteen (15) days upon publication in a newspaper of national circulation and submission of copy to the Office of the National Administrative Register (ONAR).

LETTER OF AGREEMENT

1. Introduction

The Department of Environment and Natural Resources (hereinafter referred to as "DENR"), will make available to the (pls. specify Peoples Organization Name) (hereinafter referred to as "Recipient Organization") a financial assistance from the Upland Development Program (hereinafter referred to as "the Program") in the amount of PhP [please specify amount in letters] (Ph Peso) [please specify amount in figures], in support of the implementation of the 2009 Upland Development Program in (specify location of the project) for the period of (please specify inclusive months covered) 2009. 2. Purpose

2.1 The activities for which funds provided by DENR under this Letter of Agreement (LOA) shall be used, are the following: (please indicate only whichever is/are appropriate to the PO)

A. Establish and manage a ______ hectare/s nursery within the CBFM/CBRM area for the production of planting materials for the project;

B. Produce ________ quality planting materials with allowance for mortality;

2.2 The work and financial plan (Annexes 1-A, and 1-B), GIS-generated maps are attached and shall form as integral part of this Agreement.

3. General Conditions

3.1 Funds provided by the UDP under this Agreement shall be used by the Recipient Organization exclusively for the conduct of said activities consistent with the work and financial plan. acIASE

3.2 This Agreement shall be governed by general principles of law, the DENR Memorandum Circular No. 2008-04, and any other pertinent laws, rules and regulations governing the implementation of the Upland Development Program and other ENR rules and regulations.

3.3 The DENR shall have the right to terminate this Agreement, through a written notice to this effect, if it considers that the continued implementation of the Agreement is not practicable:

3.3.1 Force majeure for unforeseen causes beyond the control of the DENR or the recipient organization;

3.3.2 In the event of a default on the part of the Recipient Organization:

3.3.2.1 Fraud, misrepresentation or omission by the implementer of material facts in obtaining the LOA which would otherwise disqualify the PO;

3.3.2.2 Failure to start the project on the date specified in the LOA without just cause;

3.3.2.3 Abandonment of the project area, or of the work stipulated in the LOA, for a period of at least one month from the date of discovery by the DENR of such fact; or

3.3.2.4 Violation of, or failure to comply with the terms and conditions of the agreement, and the pertinent provisions of the UDP Guidelines and other ENR rules and regulations.

3.4 In the event of the Recipient Organization's non-compliance or partial compliance with the terms of this Agreement, after having been subjected to due process, it shall refund to the DENR any payment already received in respect to activities that have not been performed by the Recipient Organization in accordance to a standard considered acceptable to the DENR.

3.5 In the event of termination by the DENR for unforeseen causes beyond its control, the DENR shall complete all payments due to the Recipient Organization for activities already conducted.

3.6 The Recipient Organization as well as its members shall not assign, in whole or in part, this Agreement nor the rights and obligations hereunder to non PO member. In case of default of individual member to satisfy his/her obligations under the Agreement, the Recipient Organization may assign to other PO member the work of defaulting member. SAHaTc

4. Reporting

The Recipient Organization shall submit to the CENRO _______ (pls. specify CENRO name and location) through channel, the following documents and reports:

4.3 List of PO member-beneficiaries and the internal implementation mechanisms and guidelines within one month after signature of the Agreement by both parties.

4.4 Progress Report, on a quarterly basis, sketch map of area developed, photo documentation on the implementation of the activities, and statement of work accomplishment (SWA) (Annexes 2-A and 2-B) based on the work and financial plan (certified by the Treasurer of the Recipient Organization), which shall serve as bases for the release of payments.

4.5 Final report accompanied with a map indicating the areas developed, list of actual recipients and their respective areas developed, and photo documentation within one (1) month after the completion of the Agreement. ETDAaC

5. Terms of Payment

5.3 For the execution of the project under this Agreement, the DENR shall make available financial assistance of PhP [please specify amount in letters followed by amount in figures]. The payments shall be made as follows:

5.2 The DENR shall make the above-mentioned payments through checks in favor of the Recipient Organization/Peoples Organization.

6. Settlement of Disputes

Any dispute between DENR and the Recipient Organization arising out of the interpretation or execution of this Agreement shall be settled by mutual agreement. If DENR and the Recipient Organization are unable to reach an amicable agreement on any question in dispute or on a mode of settlement other than arbitration, either party shall have the right to request arbitration in accordance with the Arbitration Rules, as at present in force. The DENR and the Recipient Organization agree to be bound by any arbitration award rendered in accordance with the above, as the final adjudication of any such dispute.

7. Amendments

Any amendment to this Agreement shall be effected only on the basis of written mutual consent by the Parties.

8. Effectivity

8.1 This Agreement shall take effect upon signature by both Parties.

8.2 The Recipient Organization shall sign this Agreement in duplicate and return one original copy to the DENR.

6. Settlement of Disputes

Any dispute between DENR and the Recipient PO member arising out of the interpretation or execution of this Agreement shall be settled by mutual agreement. If DENR and the Recipient PO member are unable to reach an amicable agreement on any question in dispute or on a mode of settlement other than arbitration, either party shall have the right to request arbitration in accordance with the Arbitration Rules, as at present in force. The DENR and the Recipient PO member agree to be bound by any arbitration award rendered in accordance with the above, as the final adjudication of any such dispute.

7. Amendments

Any amendment to this Agreement shall be effected only on the basis of written mutual consent by the Parties.

8. Effectivity

8.1 This Agreement shall take effect upon signature by both Parties.

8.2 The Recipient PO member shall sign this Agreement in duplicate and return one original copy to the DENR.

1. Introduction

2. Purpose

2.1 The activities for which funds provided by DENR under this Letter of Agreement (LOA)

shall be used to establish ________ hectares through planting or in combination of assisted natural regeneration or enrichment planting within appropriate areas in CBFM/CBRM or CADC/CADT;

2.2 The work and financial plan (Annexes 1-A, and 1-B), GIS-generated maps are attached and shall form as integral part of this Agreement.

3. General Conditions

3.1 Funds provided by the UDP under this Agreement shall be used by the Recipient Organization exclusively for the conduct of said activities consistent with the work and financial plan.

3.2 This Agreement shall be governed by general principles of law, the DENR Memorandum Circular No. 2008-04, and any other pertinent laws, rules and regulations governing the implementation of the Upland Development Program and other ENR rules and regulations. cDSAEI

 

3.3 The DENR shall have the right to terminate this Agreement, through a written notice to this effect, if it considers that the continued implementation of the Agreement is not practicable:

3.3.1 for unforeseen causes beyond the control of the DENR;

3.3.2 in the event of a default on the part of the Recipient Organization.

3.3.2.1 Fraud, misrepresentation or omission by the implementer of material facts in obtaining the LOA which would otherwise disqualify the PO;

3.3.2.2 Failure to start the project on the date specified in the LOA without just cause;

3.3.2.3 Abandonment of the project area, or of the work stipulated in the LOA, for a period of at least one month from the date of discovery by the DENR of such fact; or

3.3.2.4 Violation of, or failure to comply with the terms and conditions of the agreement, and the pertinent provisions of the UDP Guidelines and other ENR rules and regulations.

3.4 In the event of the Recipient Organization's non-compliance or partial compliance with the terms of this Agreement, after having been subjected to due process, it shall refund to the DENR any payment already received in respect to activities that have not been performed by the Recipient Organization in accordance to a standard considered acceptable to the DENR.

3.5 In the event of termination by the DENR for unforeseen causes beyond its control, the DENR shall complete all payments due to the Recipient Organization for activities already conducted.

3.6 The Recipient Organization as well as its members shall not assign, in whole or in part, this Agreement nor the rights and obligations hereunder to non PO member. In case of default of individual member to satisfy his/her obligations under the Agreement, the Recipient Organization may assign to other PO member the work of defaulting member.

4. Reporting

The Recipient Organization shall submit to the Regional Executive Director, DENR Region ______ (pls. specify Regional Office No. and location) through channel, the following documents and reports: DcITaC

4.1 List of PO member-beneficiaries and the internal implementation mechanisms and guidelines within one month after signature of the Agreement by both parties.

4.2 Progress Report, on a quarterly basis, sketch map of area developed, photo documentation on the implementation of the activities, and statement of work accomplishment (SWA) (Annexes 2-A and 2-B) based on the work and financial plan (certified by the Treasurer of the Recipient Organization), which shall serve as bases for the release of payments.

4.3 Final report accompanied with a map indicating the areas developed, list of actual recipients and their respective areas developed, and photo documentation within one (1) month after the completion of the Agreement.

5. Terms of Payment

1. Purpose

2. For purposes of the UDP, the term PO as used in these guidelines shall include Indigenous Peoples (IP) organizations acknowledged as such by the National Commission on Indigenous Peoples (NCIP), local religious organizations, local women's organizations, and the like.

3. DENR staff should allocate areas to implementor partners keeping in mind to equitably involve as many households as possible to satisfy the poverty and hunger mitigation program of UDP.

7. Lists of priority watersheds, protected areas, and other priority development areas, together with People's Organizations in these areas, and the indicative targets, were previously submitted by the field offices to the Central Office. These were matched with GIS analysis of identified priority areas and watersheds and other prioritization parameters of UDP. The indicative 2009 UDP targets are given in Annex B.

8. The survey and mapping of areas shall commence only after the process of choosing the final areas and implementors is completed, as described in the subsection Determination of areas for and participant-implementors.

9. The letters of intent to participate is just that, an expression of interest to implement UDP in the area subject of the call. It is NOT a detailed, or even an indicative, development plan; the latter will be undertaken jointly between DENR staff and the implementing organization or household when the area and the organization is finally chosen as a UDP area.

10. The task forces should note that there are indicative area allocations by development modes per province, either derived from the FMB iterations presented beforehand to the REDs or the final provincial targets set by the ORED.

11. For reforestation, ANR and enrichment planting, and for production of forest tree species in agroforestry only. Fruit trees for agroforestry will be purchased from commercial growers, while trees and plants for urban forest parks will be sourced from DENR and LGU nurseries.
