GAB RESOLUTION NO. 020-09
APPROVING RULES AND REGULATIONS IN THE IMPOSITION OF DISCIPLINARY ACTION AGAINST THOSE ERRING LICENSEE/S IN HORSE RACING
WHEREAS, the Board in the exercise of its regulatory and supervisory power over the betting aspect of horse racing, is requiring and issuing licenses to those personnel involve and performing functions related to the betting aspect of the sport;
WHEREAS, in consonance with the exercise of its supervisory and regulatory powers, there is a need for the Board to promulgate rules and regulations in the imposition of disciplinary action against those erring licensee/s;
WHEREAS, on several occasions, the Board received adverse comments with regard to the conduct and behavior of tellers and other personnel in the exercise of their duties as such;
NOW, THEREFORE, for and in consideration of the foregoing premises, the Board hereby RESOLVES, as it is hereby RESOLVED that the following shall constitute grounds for disciplinary action to be imposed against erring GAB licensee/s involved in the betting aspect of horse racing, to wit: aEcSIH
I. Scope
1. Manager
2. Assistant Manager
3. Supervisor
4. Assistant Supervisor
5. Cashier
6. Assistant Cashier
7. Teller
8. Clerk
9. Technician
10. Encoder
11. Computer Operator
12. Dividend Verifier
13. Paymaster
14. Gater
15. Utility Runner CTEacH
Any person or personnel engaged in or is involved in the betting aspect of horse racing that requires a GAB license and shall engage or involve himself/herself in such activity knowing fully well that he/she has an expired GAB license, shall be liable to pay a fine depending on when said GAB license had expired.
Any person or personnel engaged in or is involved in the betting aspect of horse racing that requires a GAB license and shall engage or involve himself/herself in such activity knowing fully well that he/she has no GAB license, shall be blacklisted and shall not be eligible for issuance of said GAB license. The racing club that employs or hires said person or personnel shall also be liable to pay a fine to be determined by the Board.
II. Grounds
The Board may revoke or suspend a license after it has been granted to any person engaged and/or involved in the betting aspect of horse racing for any of the following reasons:
1. Any material misrepresentation made on the application for license filed with the GAB;
2. Engaging in fraudulent practices, such as but not limited to:
a. Deduction of any amount from bettor's winnings;
b. Unauthorized cancellation of tickets;
c. Refusal to accept bets; and
d. Accepting bets from minors.
3. Continued or flagrant violation of any of the rules or regulations of the Board, including:
a. Rude conduct or behavior toward bettors;
b. Working under the influence of alcohol or forbidden drugs;
c. Drinking alcoholic beverage during work hours;
d. Failure to open betting terminals one hour before post time of the first race;
e. Unauthorized used of ID/password; and
f. Sharing of ID/password. DSEIcT
4. Final conviction by a court of law for any crime involving moral turpitude.
5. Failure to meet or maintain the conditions and requirements necessary to qualify for the issuance of a license.
6. Sabotaging betting operations by refusing to work although present in the work of assignment without any valid reason.
7. Participating in any illegal action or protest resulting into great prejudice to the industry and government.
8. Deliberately absenting himself/herself with the intention of causing injury to the OTB of his/her assignment.
9. Any conduct that caused injury to the Racing industry and the government.

IV. Rules of Procedures
The Board shall promulgate the rules of procedures to be followed in filing and imposing disciplinary actions against erring licensees aforementioned.
RESOLVED further that this Resolution shall take effect fifteen (15) days after its publication in a newspaper of general circulation or in the Official Gazette.
