GAB RESOLUTION NO. 019-09
APPROVING POLICIES, RULES AND REGULATIONS IN THE SUPERVISION AND REGULATION OF THE BETTING ASPECT OF HORSE RACING, PARTICULARLY IN THE USE OF LATEST TECHNOLOGIES
WHEREAS, pursuant to EO 392, Series of 1951, RA 309 and PD 420, the Games and Amusements Board (GAB) is mandated to regulate and supervise the betting aspect of horseracing; AEIHCS
WHEREAS, in view of the proliferation of new technologies in communication such as internet, email, cellular phones, text messaging, satellite and other recent technologies and in order to cope with these, there are innovations made by the racing clubs and other organizations/associations engaged in the horse racing industry in regard to their betting operations;
WHEREAS, there is a need for the GAB to formulate new policies for it to adopt to the changing times and technology to effectively and efficiently perform its functions in the supervision and regulation of the betting aspect of horse racing;
NOW, THEREFORE, for and in consideration of the foregoing premises, RESOLVED that, as it is hereby RESOLVED that the Games and Amusements Board (GAB) hereby formulates the following policies, rules and regulations in the supervision and regulation of the betting aspect of horse racing particularly in the use of latest technologies, such as but not limited to the internet, email, cellular phones, text messaging, satellite, etc., to wit:
1. Coverage
A. Jockey/Racing Clubs, Organizations, Associations or Entities
This Rules and Regulations shall apply to all jockey/racing clubs, organizations, associations or entities, taking bets or conducting promos using the outcome of horse racing conducted inside or outside the Philippines as basis thereof, whether that club be domestic or foreign. ECSHAD
B. Nature of Betting
This resolution shall cover betting operations of horse racing done through internet, email, cellular phones, text messaging, satellite, and other facilities or the same nature;
II. Mechanics
Any jockey/racing club, organization, association or entity mentioned above that opts to do betting or promotional activities which solicits bets from the betting public for a prize based on horse racing results by means of internet, email, cellular phones, text messaging, satellite etc., shall submit to the Games and Amusements Board (GAB) the mechanics of their promos for approval.
III. Conduct of Entry/Promo
Any entry/promo aforementioned shall be conducted in accordance with the mechanics submitted to and approved by GAB and other applicable laws, rules and regulations, and shall be supervised by the GAB personnel assigned for the purpose.
IV. GAB Share
The Games and Amusements Board shall be entitled to three (3%) per centum share of the gross proceeds of the bets of a particular betting or promotional activities. It is the duty of the jockey/racing club, organization, association or entity conducting the entries/promos to report to the GAB the gross proceeds and remit to the GAB its shares on a daily basis.
It is the duty of the GAB personnel assigned to see to it that all entries and proceeds of the promo is duly reported and remitted to GAB. aDHCAE
Failure and/or refusal to remit the GAB's share or time or failure to remit the exact GAB's share shall subject the erring entity or individual to appropriate disciplinary action to include immediate cancellation of license to operate and closure of the establishment.
V. Penal/Administrative Sanctions
Any club, organization, association, entity or individual person conducting betting or promotional activities stated herein, who failed to comply or violated any of the provisions hereof, shall be subject to disciplinary action, including, but not limited to suspension or cancellation of the betting or promotional activities or its license denied by GAB, blacklisting, fines or forfeitures at the discretion of the Board without prejudice to the filing of criminal and civil action in the courts of law against erring owners or officers and employees of the club, organization or association. In cases of corporation or partnership, its officers, incorporators, directors and partners shall be held liable.
RESOLVED further that this Resolution shall take effect fifteen (15) days after its publication in the newspaper of general circulation or in the official gazette.
