IMPLEMENTING RULES AND REGULATIONS OF RA 10815 "RIZAL, OCCIDENTAL MINDORO TESDA TRAINING AND ACCREDITATION CENTER ACT"
Pursuant to Section 8 of Republic Act (R.A.) No. 10815 "An Act Providing for the Establishment of a Technical Education and Skills Development Center in the Municipality of Rizal, Province of Occidental Mindoro to Be Known as the Rizal, Occidental Mindoro TESDA Training and Accreditation Center, and Appropriating Funds Therefor," the following Implementing Rules and Regulations (IRR) are hereby promulgated:
RULE I
Title and Establishment
SECTION 1. Short Title. — These rules shall be known as the Implementing Rules and Regulations of RA 10815 or the "Rizal, Occidental Mindoro TESDA Training and Accreditation Center Act."
SECTION 2. Establishment. — A Technical Education and Skills Development Center is hereby established in the Municipality of Rizal, Province of Occidental Mindoro, under the supervision of the Technical Education and Skills Development Authority (TESDA), to be known as the Rizal, Occidental Mindoro TESDA Training and Accreditation Center.
SECTION 3. Definition of Terms. — As used in this IRR, the following terms shall mean as:
a) Board shall refer to the Center Board;
b) Center/School shall refer to the Rizal, Occidental Mindoro TESDA Training and Accreditation Center;
c) CHED — Commission on Higher Education;
d) DepEd — Department of Education;
e) DOLE — Department of Labor and Employment;
f) DTI — Department of Trade and Industry;
g) IRR shall mean Implementing Rules and Regulations;
h) K to 12 means Kindergarten to 12 program that consists of Kindergarten, Six (6) years elementary, four (4) years Junior high school and two (2) years Senior high school;
i) LGU — local government unit;
j) Out-of-school youth (OSY) shall refer to persons aged 15 to 24 years who are not attending school, have not finished any college or post-secondary course, and are not working;
k) TESDA — Technical Education and Skills Development Authority;
l) TVET — Technical Vocational Education and Training.
RULE II
General Mandate
SECTION 4. General Mandate. — The Rizal, Occidental Mindoro TESDA Training and Accreditation Center shall primarily provide technical-vocational training and skills development programs to students from low-income families and out-of-school youth in the Municipality of Rizal and adjacent municipalities in the Province of Occidental Mindoro. It shall also play a pivotal role in helping the students become productive, self-reliant and to develop them into becoming globally-competitive middle-level skilled labor force so as to hasten the social and economic development of Occidental Mindoro, as well as meet the needs of both local and international labor markets.
The Rizal, Occidental Mindoro TESDA Training and Accreditation Center shall also serve as the assessment center for acquired competencies in technical-vocational skills in the whole Province of Occidental Mindoro. Further, as deemed necessary and practicable, in coordination with the Department of Education (DepEd), it shall render relevant teachers' training assistance and curriculum design support to the secondary schools in the Province of Occidental Mindoro which are offering technical-vocational education and training (TVET) track under the K to 12 Program of the DepEd.
RULE III
Curricular Offerings and School Site
SECTION 5. Curricular Offerings. — The Rizal, Occidental Mindoro TESDA Training and Accreditation Center shall offer short-term courses in preferred market-driven and relevant technical-vocational courses within its areas of specialization in consultation with the Department of Labor and Employment (DOLE) and such other relevant agencies, both local and international.
The DOLE shall provide the necessary labor market information on Key Employment Generators (KEGs) and hard to fill and in-demand occupations to serve as basis in the identification of priority programs.
The DTI shall provide information on current and emerging trends in the business sector that contribute to inclusive growth and employment generation.
The TVET curricular offerings shall be designed such that equivalent units will be credited as preparatory for baccalaureate programs subject to the joint policies of CHED and TESDA.
The Training and Accreditation Center may likewise establish research, service and training centers throughout the province to strengthen linkages between the industry and the technology programs.
SECTION 6. School Site. — The Rizal, Occidental Mindoro TESDA Training and Accreditation Center shall be established on a site in the Municipality of Rizal, Province of Occidental Mindoro to be donated by the concerned LGU, which is highly accessible pursuant to the purposes of this IRR and to the mutual agreement between the TESDA and the concerned local government unit (LGU).
RULE IV
Administrative and FinancialProvisions
SECTION 7. Administration. — The Rizal, Occidental Mindoro TESDA Training and Accreditation Center shall be headed by a Vocational School Administrator III under the supervision of the TESDA. The Vocational School Administrator III shall be appointed by the TESDA Director General in accordance with TESDA guidelines, the civil service rules and regulations and the qualification requirements of the TESDA.
The Vocational School Administrator III shall render full-time services and shall be responsible for the administration and operation of the Rizal, Occidental Mindoro TESDA Training and Accreditation Center.
SECTION 8. Center Board. — The Center Board shall be composed of the following:
Chairperson: TESDA Provincial Director
Members:
— Duly elected member of the House of Representatives of the Lone District of Occidental Mindoro or his/her authorized representative
— Provincial Governor or his/her representative
— Municipal Mayor of Rizal, Occidental Mindoro or his/her representative
— Representative from industry
— Representative from DOLE
— Representative from DTI
— Representative from DepEd
— Vocational School Administrator
The Board may also appoint prominent citizens from the private sectors such as alumni of the school, civil society organization who have distinguished themselves in their profession or trade craft, as member.
Representatives from other sectors or groups can be added as deemed necessary.
Secretariat support to the Board shall be rendered by the designated personnel of the school.
SECTION 9. Powers and Functions of the Board. — The Board which shall serve as policy making body shall perform the following functions:
1) Promulgate after due consultations with stakeholders school policies, plans, programs and guidelines;
2) Organize and constitute standing committees, technical working groups and other bodies for the efficient implementation and monitoring of school programs and activities;
3) Enter into, make and execute contracts in behalf of the Center subject to existing laws and regulations;
4) Allocate resources in accordance with the approved institutional development plan.
SECTION 10. Staffing Pattern. — TESDA shall prepare the structure and staffing pattern of the institution. The school personnel shall be appointed in accordance with the existing TESDA guidelines, civil service rules and regulations and qualifications standards for the positions.
SECTION 11. Institutional Development Plan. — The Board shall formulate a 5-year Institutional Development Plan that will define the activities towards the full operationalization and continuous development of the Center.
SECTION 12. Appropriations. — The TESDA Director-General shall include in the Authority's program the implementation of the law, the funding of which shall be included in the annual General Appropriations Act as a line item budget under TESDA.
The Provincial Government of Occidental Mindoro and the Municipal Government of Rizal, Occidental Mindoro shall allocate annual funds to support the operations of the Center as determined by the Board.
SECTION 13. Other Sources of Funds. — The Center is allowed to collect training fees following the standard rates prescribed by NEDA and approved by the TESDA Board, engage in income generating projects, enter into public-private partnership (PPP), and technical consulting activities. All income derived from these activities shall be deposited in the Trust Fund of the Center which shall be maintained in an authorized government depository bank. The Center can spend the income for administrative purposes, physical and system improvement, capability building programs and other purposes as deemed necessary for the efficient and effective delivery of its core functions, all subject to the standard government accounting and auditing rules, regulations and procedures.
The Center shall also be authorized to receive legacies, gifts, and donations of real and personal properties of all kinds and to administer and dispose the same when necessary for education and training purposes and for the benefit of the Center subject to the limitations, directions and instructions of the donor, if any, as well as to the standard government accounting and auditing rules, regulations and procedures.
RULE V
Final Provisions
SECTION 14. Separability Clause. — If, for any reason, any section of this IRR shall be deemed unconstitutional or invalid, the other sections or provisions hereof shall not be affected and shall thereby remain in force and effect.
SECTION 15. Repealing Clause. — All provisions of existing laws, executive orders, decrees, instructions, rules and regulations which are contrary to or inconsistent with any provision of this IRR are hereby repealed or modified accordingly.
SECTION 16. Effectivity. — This Implementing Rules and Regulations shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation in the Philippines.
This IRR shall be registered with the Office of the National Administrative Register at the University of the Philippines Law Center, UP Diliman, Quezon City.
