OCA CIRCULAR NO. 246-2022

| SUBJECT | : | Resolution Dated 16 August 2022 in A.M. No. 22-08-87-RTC |
Please be advised that in the appended Resolution dated 16 August 2022 in A.M. No. 22-08-87-RTC, the Court, upon the recommendation of the Office of the Court Administrator (OCA), resolved, among others, to:
1) ALLOW convicts, unless those entitled to recognizance, who have not posted bail in criminal cases, to do so pending (i) submission of the Post-Sentence Investigation Report of the concerned Investigating Officer of the Parole and Probation Administration and (ii) resolution of his/her application for probation, to prevent his/her prolonged detention and facilitate his/her immediate release; and
2) DIRECT concerned trial court judges to resolve applications for bail within two (2) days from receipt thereof, or not more than five (5) days if the application is set for hearing, pending resolution of the application for probation.
Any prior Circular from the OCA on the matter which is contrary to the foregoing is hereby deemed superseded.
This Circular takes effect immediately.
