Request of Ret. Justice Delilah Vidallon Magtolis that Her Services in PHILJA be Tacked in for Her Retirement Pension

Sirs/Mesdames :

Please take notice that the Court en banc issued a Resolution dated March 22, 2011, which reads as follows: IcSHTA

"A.M. No. 11-1-16-SC-PHILJA (Re: Request of [Ret.] Justice Delilah Vidallon Magtolis, Chief, Academic Affairs Office, PHILJA, that Her Services in the PHILJA be Tacked in for Purposes of Her Retirement Pension and SAJJ). — The Court Resolved, upon the recommendation of the Office of Administrative Services, to:

(a) DENY for lack of legal basis the request of Justice Delilah Vidallon Magtolis for the tacking in of her services in the PHILJA for purposes of adjusting her retirement pension and SAJJ;

(b) DENY for lack of legal basis the request of Justice Magtolis for the corresponding adjustment of her pension and SAJJ by another 5% effective January 2008;

(c) REFER to the COURT OF APPEALS, for comment or appropriate action within ten (10) days from notice hereof, the adjustment of Justice Magtolis' pension and SAJJ which are being paid by the said Court;

(d) AUTHORIZE Justice Magtolis' SAJJ to be replaced with a Special Allowance Equivalent to SAJJ for her present position as Chief of the Academic Affairs Office, PHILJA; and

(e) ORDER the SAJJ presently being received by the officials of the PHILJA to be replaced with a Special Allowance Equivalent to SAJJ." Mendoza, J., on leave. (adv113) DEcITS
