BI OPERATIONS ORDER NO. SBM-2015-021
REGULATIONS ON BACKDATING OF ARRIVAL STAMPS
Pursuant to the rule-making power of the Commissioner under Section 3, C.A. No. 613 or the Philippine Immigration Act of 1940, as amended, and in the interest of clarifying the use of BI Border Stamps (BIBs), specifically on the backdating of arrival stamps, the following are hereby ordered: TAacHE
1. Backdating of Arrival Stamp. — Backdating of arrival stamp refers to the stamping of arrival at a later date from the date of actual arrival.
2. Prohibition Against Backdating of Arrival Stamp. — Backdating of arrival stamp at the port of entry is strictly prohibited in case the Immigration Officer failed to stamp the passenger's arrival in his passport or travel document on the date of his actual arrival.
In this case, the POD shall inform the passenger to proceed to the Immigration Regulation Division to process his request for stamping of his arrival in his passport or travel document, in accordance with existing policies and procedures.
3. Exception: Recall Exclusion Cases. —
a. Backdating of arrival stamp at the port of entry shall only be allowed in Recall Exclusion cases. The Recall Exclusion Order (REO) signed by the Commissioner or his duly authorized representative shall constitute sufficient authority to stamp the passenger's arrival in his passport or travel document, subject to the following:
i. Waiver of Exclusion Fees (WEF) and other fines or penalties, if any, are fully paid with corresponding Official Receipts; and,
ii. The date of admission shall be the issue date of the REO. HDICSa
b. Authority to Backdate. — Only the Officer of the Day (OD) shall be authorized to stamp the passenger's arrival in his passport or travel document.
c. Place of Payment of Fees, Fines, or Penalties. — Payment of WEF and other fines or penalties shall be made at the BI Main Office during regular office hours.
Payment of said fees, fines, or penalties shall only be allowed at the port of entry in case the passenger or his authorized agent fails to pay the same at the BI Main Office during regular office hours.
4. Sanctions. — Non-compliance with the foregoing shall be administratively dealt with, without prejudice to any civil or criminal liability.
5. Implementation. — The Chief, POD and Chief, IRD shall implement this Order. IDaEHC
