Recognition and Accreditation of Integrated Professional Organization of Real Estate Service Practitioners
On October 21, 2011, the Professional Regulatory Board of Real Estate Service passed Resolution No. 019-11, recognizing the Philippine Institute of Real Estate Service Practitioners, Inc. (PhilRES) as the sole Accredited and Integrated Professional Organization (AIPO) for real estate service practitioners in the Philippines. This decision follows the mandates of the Real Estate Service Act (R.A. No. 9646), which requires the integration of real estate service associations into a national body. PhilRES is tasked with registering members, issuing certification of good standing, and ensuring compliance with continuing education and regulatory obligations. The resolution takes effect 15 days after publication in the Official Gazette.

PRC BOARD OF REAL ESTATE SERVICE RESOLUTION NO. 019-11
RECOGNITION AND ACCREDITATION OF INTEGRATED PROFESSIONAL ORGANIZATION OF REAL ESTATE SERVICE PRACTITIONERS
WHEREAS, "Section 34, Article IV of Republic Act No. 9646, known as "Real Estate Service Act of the Philippines", states, to wit:
"Section 34. Accreditation and Integration of Real Estate Service Associations. — All real estate service associations shall be integrated into one (1) national organization, which shall be recognized by the Board, subject to the approval of the Commission, as the only accredited and integrated professional organization of real estate service practitioners.
A real estate service practitioner duly registered with the Board shall automatically become a member of the accredited and integrated professional organization of real estate service practitioners, and shall receive the benefits and privileges appurtenant thereto. Membership in the accredited and integrated professional organization of real estate service practitioners shall not be a bar to membership in other associations of real estate service practitioners." WHEREAS, the Professional Regulatory Board of Real Estate Service, had conducted a series of consultation meetings with different organizations of real estate service with publication, and had instructed them to submit their respective petitions for recognition and accreditation as the one and only registered and accredited professional organization together with the documents in support thereof and in compliance with PRC Res. No. 178, Series of 2004, as well as the criteria prescribed by the Board of Real Estate Service for the choice thereof; aASDTE
WHEREAS, two (2) petitioners filed their petitions for recognition and accreditation as permanent AIPO, namely: the Federation of Real Estate Association, Inc. (FRESA) and Philippine Institute of Real Estate Service Practitioners, Inc. (PhilRes);
WHEREAS, they were called to a series of meetings to discuss possible amendments to their respective Articles of the Incorporation and By-laws in compliance with the requirements prescribed in R.A. 9646;
WHEREAS, upon submission of the requirements to the Standards and Inspection Division of the Professional Regulation Commission, the latter prepared a matrix of the requirements to assist the Board in the choice of the Accredited and Integrated Professional Organization (AIPO) of Real Estate Service Practitioners from among the two (2) petitioners;
WHEREAS, the careful review and evaluation of the petitions with their documents in the light of PRC Res. No. 178, Series of 2004 and the criteria or parameters that had been agreed upon during the last meeting with two (2) petitioners held last 15 April 2011, paved the way for the selection of Philippine Institute of Real Estate Service Practitioners, Inc. (PhilRES) after it amendments; and IDcHCS
WHEREAS, the PhilRES has met substantially all the requirements set forth by the Board;
NOW, THEREFORE, the Board RESOLVES, as it is hereby resolved, to grant, subject to approval by the Commission, the PHILIPPINE INSTITUTE OF REAL ESTATE SERVICE PRACTITIONERS, INC'S. (PHILRES) petition for recognition and accreditation as the one (1) and only Accredited and Integrated Professional Organization (AIPO) of Registered and Licensed Real Estate Service Practitioners; and, accordingly, to issue a Certificate of Accreditation signed by the Chairman and Members of the Board and the Chairman of the Commission upon payment of the prescribed fee therefor.
FURTHER, RESOLVED, as the AIPO of Registered and Licensed Real Estate Service Practitioners, the PhilRES is enjoined:
1. To register as members thereof pursuant to Section 34, Art. IV of R.A. No. 9646 registered and licensed real estate service practitioners.
2. To issue certification of membership in good standing upon payment of fees or dues to the members thereof for presentation to the PRC for renewal of their professional identification cards.
3. To insure the accomplishment of the purposes, duties and responsibilities prescribed in R.A. No. 9646 and its IRR and the Articles of Incorporation and By-laws of the PHILRES.
4. To keep and make up-to-date its roster/roll/registry of members.
5. To charge and collect reasonable fees from its members and to provide them the benefits and privileges they are entitled to, pursuant to the Articles of Incorporation and By-laws of the PHILRES. TCaEAD
6. To motivate the members to undergo the Continuing Professional Education (CPE) programs, activities, courses, etc. provided by the PHILRES or by other duly accredited providers.
7. To observe the relevant Rules in Res. No. 2004-178, Series of 2004, particularly Rule 4 thereof (Cancellation of Accreditation) which reads, to wit: "A certificate of accreditation of an accredited professional organization shall be cancelled or suspended by the Commission or by any concerned professional regulatory board upon approval or concurrence by the Commission ONLY AFTER DUE HEARING UNDER ANY OF THE FOLLOWING GROUNDS/CAUSES", such as "5. The Accredited Professional Organization has not renewed its certificate of accreditation after a lapse of an unreasonable period from date of its renewability . . .";
8. Not to bar their automatic, mandatory, registered members from joining any other affiliate organization/s of real estate practitioners.
RESOLVED, FINALLY, this Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or in any major daily newspaper of general circulation in the Philippines.
Let copy hereof be furnished to the UP Law Center, PHILRES, and other affiliate organizations of real estate service practitioners for their information and guidance.
