DDB BOARD REGULATION NO. 1, S. 2019

SECTION 1. Scope.—
This Regulation shall apply to all Drug Rehabilitation Practitioners in the Philippines. cTDaEH
SECTION 2. Authority.—
This Regulation is issued to implement the provisions of Section 76 of Republic Act No. 9165 otherwise known as the "Comprehensive Dangerous Drugs Act of 2002," as amended, and other national issuances.
SECTION 3. Regulatory Agency.—
The Department of Health (DOH) shall exercise its regulatory power through the Health Facilities and Services Regulatory Bureau (HFSRB) in the accreditation of Drug Rehabilitation Practitioners, in coordination with the Dangerous Drug Abuse Prevention and Treatment Program (DDAPTP) of the DOH.
The DDAPTP shall perform the following:
1. Formulation of the standard training course and updating thereof, including recognition of trainings conducted by partners and other organizations;
2. Training on the standard courses on the assessment and management of drug dependence; and
3. Screening of applicants who will undergo the training. ITAaHc
SECTION 4. Definition of Terms.—
Accreditation — a formal authorization issued by the DOH to an individual meeting the accreditation requirements prescribed under this Regulation.
Bureau Director — refers to the Director of Health Facilities and Services Regulatory Bureau.
CHD — refers to Centers for Health Development, formerly known as DOH Regional Offices.
DDB — refers to the Dangerous Drugs Board.
DDAPTP — refers to the Dangerous Drugs Abuse Prevention and Treatment Program.
DOH — refers to the Department of Health.
Drug Dependency Examination — a medical examination conducted by a DOH-Accredited Physician to evaluate the extent of drug abuse of a person and to determine whether he/she is a drug dependent or not, which includes history taking, intake interview, determination of the criteria for drug dependency, mental and physical status, medical and psychiatric complications and co-morbidities, and the detection of dangerous drugs in body specimens through laboratory procedures.
Drug Rehabilitation Practitioner — a person working for the treatment and rehabilitation, aftercare and follow-up of people who use drugs and also provides behavioral interventions and services to drug dependents. cSaATC
Drug Dependent — a person suffering from drug dependence syndrome.
Drug Dependence — a cluster of physiological, behavioral, and cognitive phenomena of variable intensity, in which the use of psychoactive drug takes on a high priority thereby involving, among others, a strong desire or a sense of compulsion to take the substance and the difficulties in controlling substance-taking behavior in terms of its onset, termination, or levels of use.
HFSRB — refers to the Health Facilities and Services Regulatory Bureau, formerly known as the Bureau of Health Facilities and Services (BHFS) of the DOH.
Provisional Accreditation — refers to the temporary authorization issued by the HFSRB/CHD to a physician to conduct screening and assessment of a drug dependent.
Rehabilitation — a dynamic process including re-integration, aftercare and follow-up treatment directed towards the physical, emotional/psychological, vocational, social and spiritual change of a drug dependent to enable him/her to live without dangerous drugs, enjoy the fullest life compatible with his capabilities and potentials and render him/her able to become a law abiding and productive member of the community. SECTION 5. Accreditation of Drug Rehabilitation Practitioners.—
A. Accreditation Requirements
1. Provisional Accreditation of Physicians
The prescribed requirements for the provisional accreditation of a physician, who will conduct the screening and assessment of drug dependents, are the following:
i. Shall be registered with the Professional Regulatory Board of Medicine (PR-BOM) of the Professional Regulation Commission and duly licensed to practice in the country; and
ii. Shall have undergone the Training Course on the Provisional Accreditation of Physicians on the Screening and Assessment of Drug Dependency facilitated by DDAPTP/CHD.
2. Full Accreditation of Physicians
The prescribed requirements for the full accreditation of a physician, who will conduct the drug dependency examination and treatment of drug dependents, are the following: cHDAIS
i. Shall be registered with the Professional Regulatory Board of Medicine (PR-BOM) of the Professional Regulation Commission and duly licensed to practice in the country. He/She shall have attended the standard training (Basic Training Course for Physicians on the Assessment and Management of Drug Dependency) facilitated by DDAPTP/CHD; and
ii. For the Psychiatrist/Addiction Medicine Specialist: In lieu of the Basic Training Course, he/she may attend the orientation seminar on the laws, procedures, and programs related to drug dependency prevention, assessment and management facilitated by DDAPTP.
3. Accreditation of Other Drug Rehabilitation Practitioners
The prescribed requirements for the accreditation of Drug Rehabilitation Practitioners not falling under Section 5 (A) of this Regulation, who are engaged in the day-to-day operations of the treatment and rehabilitation facility, are the following:
i. Shall have been actively involved in the program/clinical management of drug dependents for at least one (1) year prior to the filing of application for accreditation. EATCcI
ii. Shall have undergone the Basic Training Course on Rehabilitation Management of Drug Dependents facilitated by the DDAPTP/CHD.
B. Procedural Guidelines for Certificate of Accreditation
1. Provisional Accreditation of Physicians
i. The applicant shall submit the following documentary requirements to CHD:
Certified true copy of Professional Regulation Commission (PRC) Identification Card; and
Certificate of Training on the standard Training Course on the Screening and Assessment of Drug Dependence.
ii. If found to be compliant after evaluation, the CHD registers the physician and issues the Provisional Certificate of Accreditation.
iii. The CHD shall regularly submit to DDAPTP the list of physicians issued with the Provisional Certificate of Accreditation.
2. Full Accreditation of Physicians and Other Drug Rehabilitation Practitioners
i. DDAPTP shall provide HFSRB with the official list of physicians and other drug rehabilitation practitioners who completed the standard training on assessment and/or management of drug dependents. ISHCcT
ii. Applicant accomplishes the required application form and submits all the documentary requirements to HFSRB/CHD. The applicant pays the corresponding fees to the Cashier of the DOH in person or through postal money order.
Initial Accreditation
• Application Form filed with HFSRB/CHD;
• Certified true copy of appropriate Professional Regulation Commission (PRC) Identification Card (if applicable);
• Certificate of training on the standard training course on the treatment/management of drug dependents issued by DDAPTP/CHD or DOH-recognized training provider;
• For Psychiatrists, Certificate of Completion of Residency in Psychiatry;
• For Addiction Medicine Specialists, Board Certification; and
• Certificate of employment (if applicable).
Renewal of Accreditation
• Letter of endorsement from Regional DDAPTP Coordinator or from Local Health Officer (PHO/CHO) addressed to the CHD Director; DHITCc
• Certified true copy of current PRC Identification Card (if applicable);and
• Certificate(s) of continuing education trainings related to treatment/management of drug dependence provided by DDAPTP/CHD or DOH-recognized training provider (from time of accreditation to the time of expiry date).
iii. The HFSRB/CHD shall evaluate the submitted documents to determine compliance with the requirements.
iv. For initial accreditation, HFSRB/CHD shall approve/disapprove the issuance of Certificate of Accreditation.
If approved, the HFSRB/CHD shall register the drug rehabilitation practitioner and issue the Certificate of Accreditation.
If disapproved, the HFSRB/CHD shall send the findings and recommendations to the applicant for compliance. Failure to comply within thirty (30) days from receipt of the applicant of such findings and recommendations shall be a ground for denial of application.
v. For renewal of accreditation, application shall be filed with the CHD within the required period (from October 1 to December 15 of the current year).
If approved, the CHD registers the drug rehabilitation practitioner and issues a new Certificate of Accreditation. CAacTH
If disapproved, the CHD sends the findings and recommendations to the applicant for compliance. Failure to comply within thirty (30) days from receipt of the applicant of such findings and recommendations shall be a ground for suspension of accreditation.
C. Payment of Fees
a. The amount of Two Thousand Pesos (Php2,000.00) shall be paid for the accreditation of a physician, and One Thousand Pesos (Php1,000.00) for the accreditation of other drug rehabilitation practitioner, to the Cashier of the DOH.
b. HFSRB is authorized to adjust the schedule of fees from time to time.
c. No fees shall be collected for the provisional accreditation of physicians.
D. Content of Certificate of Accreditation
For the full accreditation of drug rehabilitation practitioners, the Certificate of Accreditation shall state on its face the name of the practitioner, the accreditation number, and validity period. It shall be signed by the HFSRB Director/CHD Director.
For the provisional accreditation of physicians, the Certificate of Provisional Accreditation shall follow the standard template (see Annex) and shall be signed by the CHD Director. cEaSHC
E. Monitoring
The DOH shall require all DOH-Accredited Physicians (Full and Provisional) to submit monthly statistical reports to the Dangerous Drugs Board Secretariat through the Anti-Drug Abuse Council (via Integrated Drug Monitoring and Reporting Information System).The report shall include, but is not limited to, the classification of risk for drug dependency and classification of severity of drug dependency.
F. Validity
The Certificate of Accreditation shall be valid for a period of five (5) years while the Certificate of Provisional Accreditation of a Physician shall be valid for a period of two (2) years. The Certificate of Provisional Accreditation is non-renewable and the physician shall obtain a Certificate of Full Accreditation before the former expires.
SECTION 6. Transitory Clause.—
A period of one (1) year from the approval of this Regulation shall be given to concerned Bureaus or offices of the DOH to facilitate the transfer of accreditation procedures of drug rehabilitation practitioners, and the list of active DOH-accredited drug rehabilitation practitioners to HFSRB. The latter shall assign individual accreditation numbers to active DOH-accredited drug rehabilitation practitioners. In effect, HFSRB shall issue a certification to active practitioners, indicating their respective individual accreditation number. IAETDc
SECTION 7. Separability Clause.—
In the event that any section, paragraph, sentence, clause or word of this order is declared invalid for whatever reason, other provisions thereof shall not be affected thereby.
SECTION 8. Repealing Clause.—
Board Regulation No. 4, Series of 2003 and Board Regulation No. 4, Series of 2008 are hereby repealed. Other Regulations or parts thereof inconsistent with this Regulation are hereby repealed or modified accordingly.
SECTION 9. Effectivity.—
This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after its registration with the Office of the National Administrative Register (ONAR),UP Law Center, Quezon City.
