NOTICE

Sirs/Mesdames :

Please take notice that the Court en banc issued a Resolution dated August 28, 2012, which reads as follows:

"A.M. No. 05-7-18-SC (Re: Cagayan de Oro City Hall of Justice). — The Court Resolved to CONFIRM nunc pro tunc the approval by Senior Associate Justice Antonio T. Carpio of the Memorandum dated July 6, 2012 of the Bids and Awards Committee for the Halls of Justice relative to the Procurement of Consulting Services for the Preparation of the Detailed Architectural and Engineering Design of the Cagayan de Oro City Hall of Justice. In said Memorandum, the BAC-HOJ recommended the following:

(1) Referral of the proposed budgetary cost estimate of P371,152,265.32 for the Repair and Rehabilitation of the existing building and the construction of a new building within the lot to the SC-Fiscal and Management and Budget Office (SC-FMBO) to determine if there are enough funds for the said Project; and AEIDTc

(2) Once the SC-FMBO determines that there are sufficient funds available for the said Project, the Court shall direct the following:

(a) Approval of the Repair and Rehabilitation of the existing Building and the construction of another building within the lot of the Cagayan de Oro Hall of Justice Project;

(b) Referral of the July 6, 2012 Bids and Awards Committee for Halls of Justice (BAC-HOJ) Memorandum to the said Committee for the revision of the Terms of Reference and any other document preparatory to the procurement of the Detailed Architectural and Engineering Design Consultant and the ensuing Project Management Consultant and Works Contractor; and

(c) Cancellation and/or revocation of the May 28, 2012 Certificate of Availability of Funds of P6,883,904.00 for the Detailed Architectural and Engineering Design Consultant's Fee for the Repair and Rehabilitation of the Cagayan de Oro Hall of Justice that was issued by Ms. Estrella D. Eje, SC-FMBO, Chief Judicial Staff Officer.

The Court further Resolved to NOTE the

(a) Certification dated August 23, 2012 of the Fiscal Management and Budget Office, stating that the amount of Three Hundred Seventy-One Million One Hundred Fifty-Two Thousand Two Hundred Sixty-Five Pesos and Thirty-Two Centavos (P371,152,265.32) will be made available for the repair and rehabilitation of the existing building and the construction of another building within the lot of the Cagayan de Oro Hall of Justice from the savings from the regular appropriations of the Supreme Court in the Fiscal Autonomy Account; and

(b) Copy of the Memorandum dated July 6, 2012 of the BAC-HOJ relative to Procurement of a Consulting Services for the Preparation of the Detailed Architectural and Engineering Design of the Cagayan de Oro City Hall of Justice." Velasco, Jr., J., on official business. (adv121) AaCTID
