In its Resolution dated 9 September 2014 in A.M. No. 13-11-07-SC, the Supreme Court En Banc resolved to HOLD IN ABEYANCE the transfer of inmates from various detention facilities from Region IV-A and the issuance of the corresponding mittimuses and commitment orders by concerned courts. Further, the said inmates, in the meantime, shall continue to be detained in their respective detention facilities until further notice from the Court or the Court Administrator, with notice to the court.
In OCA Circular No. 118-2014, all concerned were informed of the said 9 September 2014 Resolution of the Court. Thereafter, in OCA Circular 70A-2016, acting on the request of the Bureau of Jail Management and Penology (BJMP), the OCA lifted the suspension of the transfer of inmates to the National Bilibid Prisons (NBP), except those who are detained in Calamba City, Laguna.
In his 6 February 2017 letter, Jail Superintendent Princessito F. Heje, City Jail Warden, BJMP, Calamba City, requests for the lifting of suspension of transfer of Calamba City Jail detainees to decongest the said detention facility.
Accordingly, after a thorough evaluation and considering that serious security threats concerning inmates have reportedly been abated, OCA Circular No. 118-2014, dated 9 September 2014, which suspended the transfer of inmates convicted by trial courts from detention facilities in Region IV-A to the NBP is hereby LIFTED. Further, all concerned judges are DIRECTED to immediately issue the corresponding mittimuses for the respective inmates detained in Calamba City, Laguna.
This being the last circular on this matter, all judges in Region IV-A are ENJOINED TO OBSERVE OCA Circular Nos. 40-2013 and 163-2013 directing the issuance of mittimuses and commitment orders of national prisoners immediately after their conviction.
