DTI RESOLUTION NO. 01-19
INTER-AGENCY COMMITTEE (IAC) ON EXECUTIVE ORDER NO. 1016
"Approving the List of Prohibited and Regulated Products for Exports (December 2019 edition) referred to as Annex A of the Revised Rules and Regulations Implementing Presidential Decree No. 930 as well as Section 4 of the Rules and Regulations Implementing Executive Order No. 1016."
WHEREAS, Presidential Decree No. 930 (13 May 1976) simplified the export procedures and documentation by realigning functions of certain government-offices/agencies involved in processing export documents, by authorizing the issuance of periodic clearances, by adoption of standardized export documents, and for other purposes.
WHEREAS, pursuant to the Revised Rules and Regulations of PD No. 930, as amended, a List of Prohibited and Regulated Products for Exports was issued.
WHEREAS, Executive Order No. 1016 (25 March 1985) dispensed with all the inspection, commodity and export clearance requirements on generally all Philippine Commodity Exports.
WHEREAS, Section 4, Rule II of the Revised Rules and Regulations Implementing Presidential Decree No. 930, as amended, provided that no new products shall be added to the List of Prohibited and Regulated Products for Exports, without prior approval of the Inter-Agency Committee (IAC) on E.O. 1016.
WHEREAS, Section 3 of Rule III required that no new export clearances shall be imposed without the prior approval of the IAC on E.O. 1016.
WHEREAS, in adherence to the provisions of the aforementioned decree and executive order and to regularly update the List of Prohibited and Regulated Products for Exports, the IAC convened and reviewed the approved December 2018 edition of the List and deliberated on the proposed updates from concerned commodity agencies taking into account the product specifications, justifications and legal bases as follows:
1. Grains and Grain by-products — Removal from the List based on Republic Act (R.A.) No. 11203 on the abolition of National Food Authority (NFA) regulatory function for the exportation of rice;
2. Used Lead Acid Battery (ULAB) — Retention of Environmental Management Bureau (EMB) 2018 regulations for their failure to provide the result of public consultation for their proposed prohibited export of ULAB and Used Oils (except PCB oil) and regulated export of All Hazardous Wastes; and
3. Prohibited and Regulated List of products under Biodiversity Management Bureau (BMB) — Change the enumerated species to a statement that all the species as listed in the Department Administrative Orders (DAO), Republic Acts (R.A.), and Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).
WHEREAS, the IAC conducted the annual review of the said List on December 04, 2019.
NOW, THEREFORE BE IT RESOLVED, that the Inter Agency Committee on E.O. 1016 hereby approves and adopts the List of Prohibited and Regulated Products for Exports as of December 2019 Edition attached as Annex A, which forms as an integral part of this Resolution.
AND, BE IT FURTHER RESOLVED, that the Secretariat of the Inter-Agency Committee on E.O. 1016 furnishes the Bureau of customs (BoC), concerned Commodity Agencies, all exporters' organizations with the List of Prohibited and Regulated Products for Exports-December 2019 Edition.
