SUBJECT : Guidelines in the Registration of Three-Wheeled Vehicles Mounted with Cargo Box/Carriage Tray/Cabin

 

Pursuant to Batas Pambansa Bilang 43 and 74, Republic Act 4136 (Land Transportation and Traffic Code), Republic Act 8794 (MVUC Law), Administrative Order Number 3, and Administrative Order No. 91-005, the following rules and regulations are hereby promulgated for the registration of three-wheeled motor vehicles (TWVs) falling under the L5 category of the Philippine National Standard (PNS).

SECTION 1. Definition of Terms.

1. Three-Wheeled Vehicle — is a motor vehicle with three wheels symmetrically arranged in relation to the longitudinal median plane and with an engine cylinder capacity (L5 category, PNS-UN ECE 1891-2006).

2. Provincial Roads — these are roads that connect cities and municipalities without traversing national roads; roads that connect national roads to barangays through rural areas; and roads that connect to major provincial government infrastructure.

3. Municipal and City Roads — these are roads within the poblacion; roads that connect to provincial and national roads; and roads that provide inter-barangay connections to major municipal and city infrastructure without traversing provincial roads.

4. Barangay Roads — these roads refer to other public roads within the barangay.

5. Highways — mean every public thoroughfare, public boulevard, driveway, avenue, park, alley and callejon, but shall not include roadway upon grounds owned by private persons, colleges, universities, or other similar institutions. EHTSCD

SECTION 2. Types of TWV.

For purposes of this issuance, TWV excludes those that are not motorized or propelled by other means like the use of pump boat or other motors not originally designed and manufactured for "motor vehicles." Examples of TWV are:

Type I three-wheeled vehicle similar to urban delivery tricycle,
    most often of the tadpole configuration, with cargo box
    (platform, etc.) permanently mounted between
    symmetrically arranged rear wheels and is primarily used
    for the carriage of goods, cargo, freight;
     
Type II three-wheeled vehicle mounted with an enclosed cabin
    with seats for the carriage of more than 3 passengers to
    a maximum six (6) passengers (excluding the driver)
    depending on the number of seats provision; and
     
Type III three-wheeled vehicle, relatively similar to the size of a
    conventional motorcycle with sidecar, mounted with a
    small cabin for the driver in the front and seating for three
    in relative comfort in the rear.

SECTION 3. Classification of Three-Wheeled Vehicles (TWV).

Three-wheeled vehicle (TWV) shall be classified under the "non-conventional MC (motorcycle)."

SECTION 4. Inspection.

Three-wheeled vehicle or TWV is subject to roadworthiness inspection of the Motor Vehicle Inspection Station (MVIS) of the Land Transportation Office (LTO) and shall be subject to gaseous emission testing for spark ignited (SI) engine and smoke emission testing for compression ignited (CI) based on existing emission standards prior to registration. TWV which is run solely by electricity (fuel cell or battery) is, however, exempted from smoke emission test until such time that standards for smoke emission, if any, for electric motor vehicles are available.

SECTION 5. Motor Vehicle User's Charge.

The collectible motor vehicle user's charge (MVUC) for three-wheeled vehicle shall be:

1. For TWV whose design and configuration fall under type I, an MVUC equivalent to the rate for trucks shall be collected; and

2. For TWV whose configuration falls under either type II or III, an MVUC equivalent to the rate for utility vehicles shall be collected.

SECTION 6. Coverage and Restriction of Operation.

The operation of TWV, like motorcycle with sidecar or locally known as "tricycles," shall be limited within or along barangay roads only. It can only pass the main thoroughfares, highways or national road for purposes of crossing only when the barangay road is divided by a highway, main thoroughfares, or the national toad; provided, however, that TWV shall yield the right of way to all oncoming traffic that constitute an immediate hazard, or if the main thoroughfares, highways, or national road has been designated and posted as open for travel by TWV by concerned government agencies. Speed limit for TWV is 40 kph.

SECTION 7. Restriction on Width, Dimension, and Loads.

TWV is prohibited from being operated with its load extended beyond its registered and/or authorized width and height of its cargo box/platform/carriage tray and or over its allowable maximum load. Modification of its cargo box/platform/carriage tray/cabin in order to allow heavier or bigger load shall in no case be allowed unless such is authorized and certified safe by its manufacturer, Bureau of Product Standards-Department of Trade and Industry, and the Land Transportation Office-Department of Transportation and Communications (DOTC) and covered with a new Certificate of Conformity for emission issued by the Department of Environment and Natural Resources (DENR).

SECTION 8. Markings, Plates and Stickers Assignment.

TWV shall be issued a regular plate and sticker intended for motorcycles with sidecar and the same shall be attached and/or conspicuously displayed at the rear side of its cargo box/platform/carriage tray/cabin. A marking with this message "AUTHORIZED ALONG BARANGAY ROADS ONLY" should be painted and centered on both sides of the cargo box/platform/carriage tray/cabin.

Each letter or character of the text "AUTHORIZED ALONG BARANGAY ROADS ONLY" must be equal or greater than 20 mm (>20mm) in height, equal or greater than 15 mm (>15mm) in width, and colored in contrast of its background.

SECTION 9. Additional Documentary Requirements for Stock Reporting.

1. Copy of the Certificate of Conformity (COC) to emission issued by the Department of Environment and Natural Resources (DENR); and

2. Copy of the Certificate of Conformity (COC) from the country of origin with specifications including the speed restriction.

SECTION 10. Additional Documentary Requirements for Initial Registration.

Certificate of Guaranty or product-liability undertaking issued by either the manufacturer or the importer that the TWV has already been tested and found to be safe for its intended use and the manufacturer or the importer takes full responsibility or shall be held liable for accident resulting from manufacturing defect/s covering at least one year from its initial usage on the road or its registration. (This requirement shall not apply to TWVs locally customized or rebuilt by individuals)

SECTION 11. Effectivity.

These guidelines shall take effect fifteen (15) days after publication in a newspaper of general circulation. DHTECc

The Land Transportation Office shall issue its implementing rules and regulations for the registration of the TWV and for effective implementation and/or enforcement of this Order.
