DOTC Administrative Order No. 001-06 establishes guidelines for the registration of Light Electric Vehicles (LEVs) in the Philippines. LEVs are defined as two- or three-wheeled battery-powered vehicles with specific power restrictions and must be classified as private motorcycles, prohibited from commercial use. The operation of LEVs is limited to certain road types and a maximum speed of 30-35 mph, with safety regulations including helmet use for riders. Registration requirements include the presentation of various documents and the stamping of a Vehicle Identification Number, with LEVs receiving distinct orange plates for identification. The order will take effect 15 days after approval by the Department of Transportation and Communications.

SUBJECT : Guidelines in the Registration of Light Electric Vehicles (LEV)

 

Pursuant to the provisions of Batas Pambansa Bilang 43 and 74, Republic Act 4136, Republic Act 8794 and Administrative Order Number 3, the following rules and regulations are hereby promulgated for the observance of all concerned. DTCSHA

SECTION 1. Definition of Terms.

1. Light Electric Vehicle. Adopting the definition of "moped" under Administrative Order No. 3, which is defined as "two-wheeled" or "three-wheeled" vehicle that is powered by a small motor of less than fifty (50) cubic centimeters piston or cubic centimeters displacement, light electric vehicle shall be defined as two-wheeled or three-wheeled vehicle that is powered by a battery-powered motor with no more than 36 voltage output and with amps per hour ranging from 10 to maximum of 60.

2. Provincial Roads. These are roads that connect cities and municipalities without traversing national roads; roads that connect national roads to barangays through rural areas; and roads that connect to major provincial government infrastructure.

3. Municipal and City Roads. These are roads within the poblacion; roads that connect to provincial and national roads; and roads that provide inter-barangay connections to major municipal and city infrastructure without traversing provincial roads.

4. Barangay Roads. These roads refer to other public roads within the barangays.

SECTION 2. Classification of Light Electric Vehicle. — Light electric vehicles shall be classified as private motorcycles without sidecar. They shall not be used for commercial purposes or be hired to transport goods and passengers. Any attachment similar to a sidecar as that of tricycle is likewise not permitted. Rider is required to wear an approved helmet.

SECTION 3. Motor Vehicle User's Charge. — Pursuant to Republic Act 4136 or the "Act Imposing a Motor Vehicle User's Charge on Owners of all Types of Motor Vehicles and for other Purposes", the computation of the Road User's Tax for light electric vehicles shall be similar to that of the "motorcycle" as provided under R.A. 8794. SECTION 4. Coverage and Restriction of Operation. — The operation of light electric vehicles shall be restricted to a limited speed of up to 30-35 mph (about 50-55 km/hr). It can be operated only along provincial roads, municipal/city roads and barangay roads defined in this Administrative Order. It can pass along the main thoroughfares, highways or national road for purposes of crossing only when the provincial or municipal/city, or barangay road is divided by a highway, main thoroughfares, or the national road, provided however that the LEV rider shall yield the right of way to all oncoming traffic that constitute an immediate hazard, or if the main thoroughfares, highways, or national road has been designated and posted as open for travel by LEVs by concerned government agencies.

SECTION 5. Registration Requirements. — The following shall be the guidelines in the registration of LEVs at the LTO District offices:

1. Stamping of the Vehicle Identification Number (VIN).

The VIN shall be stamped at the frame of the LEV. Those LEVs that are already manufactured and sold in the Philippines without VIN shall be stamped with VIN within three months upon the issuance of this Administrative Order, at the LTO District Offices nearest to the LTO Regional Offices. The Land Transportation Office shall authorize one (1) District Office per region to conduct the stamping of the VIN.

The VIN that will be stamped to the LEV shall be of the format described as follows:

Note: The initials of the manufacturer/imported trade name must first be approved by the LTO to avoid duplication.

All LEVs which shall be imported into the country upon the issuance of this Administrative Order shall have the VIN already stamped by the LEV manufacturer.

2. Presentation by the registrant of the following documents:

The following documents shall be submitted by the registrant to the LTO District Office to effect the registration of the LEV:

a. Certificate of Conformity (COC) issued by DENR;

b. Commercial Invoice of the vehicle issued by the country of origin;

c. Type approval from the country of origin with specifications including the speed restriction;

d. Motor vehicle inspection report for road worthiness and smoke emission compliance. LEVs shall not be allowed registration, unless it is equipped with brake in good operating condition, head lights, left and right signal lights, hand brake, brake activated tail light, side mirrors and power switch. e. Appropriate motor vehicle insurance cover;

f. Certificate of payment issued by the Bureau of Customs;

g. PNP-TMG motor vehicle clearance; and

h. Other importation documents being required by LTO.

3. Issuance of Plates

LEVs shall be issued an orange-colored motorcycle plate at the rear and a sticker in front to be used exclusively for all electric motor vehicles to differentiate from the gasoline-powered vehicles. The sticker shall be of the type that will be destroyed once removed from vehicle, hence, cannot be transferred to another vehicle.

SECTION 6. Applicable Provisions of the Law. — All applicable existing laws, rules and regulations that are not in conflict herewith shall be enforceable to LEVs.

SECTION 7. Effectivity. — These guidelines shall take effect fifteen (15) days from the date of approval by the Secretary of the Department of Transportation and Communications. IEHTaA
