CIAP BOARD RESOLUTION NO. 04-14
"ENDORSING AMENDMENTS TO THE CONSTRUCTORS PERFORMANCE EVALUATION SYSTEM IMPLEMENTING GUIDELINES TO THE NATIONAL ECONOMIC AND DEVELOPMENT AUTHORITY (NEDA) BOARD'S COMMITTEE OF INFRASTRUCTURE (INFRACOM) FOR APPROVAL"
WHEREAS, Section 12, Annex E of the Revised Implementing Rules and Regulations (IRR) of RA 9184 or the Government Procurement Reform Act, requires all procuring entities, implementing government infrastructure projects to evaluate the performance of their contractors using the NEDA approved Constructors Performance Evaluation System for the type of projects being implemented. WHEREAS, in the Philippine Domestic Construction Board (PDCB), in its efforts to improve the implementation of CPES, conducted series of CPES Interagency Meetings and came up with the proposed amendments to the CPES Implementing Guidelines under PDCB Resolution No. 1, s. 2013 and submitted the same to CIAP Board;
WHEREAS, during the CIAP 65th and 66th Regular Meetings held on 19 April 26 and 26 July 2013, respectively, the Board discussed the proposed amendments to include among others the proposal for clarification of validity period on the disqualification of contractors and its automatic reinstatement into a good standing rating, in case there is no second and final CPES evaluation with a certain period.
WHEREAS, during the CIAP Special Meeting held on 10 September 2013, the Board further discussed the above proposed amendments and recommend the lifting of disqualification of contractors resulting in below satisfactory for CPES rating for ongoing project should be left at the discretion of the concerned agency instead of "automatic lifting" after one year. The said recommendation was sent back to PDCB for further study.
WHEREAS, during the PDCB 75th Regular Meeting held on 17 October 2013, the PDCB deliberated on the CIAP Board's recommendation and agreed to reword the proposed amendments to the CPES guidelines particularly, Sec. 12.3.4 in accordance with the said recommendation;
WHEREAS, the said final version of the proposed amendments to the CPES Guidelines incorporating the said recommendation was presented to the CIAP Board in its 67th Regular Board Meeting held on 26 March 2014 attached as "Annex A";
NOW THEREFORE, the members of the Construction Industry Authority of the Philippines after due deliberations in the said Meeting, RESOLVES, as it is hereby RESOLVED, to endorse to the National Economic and Development Authority (NEDA) Board Committee on Infrastructure (INFRACOM) for approval of the proposed amendments to the Implementing Guidelines of the Constructors Performance Evaluation System (CPES) on aspects and criteria for evaluation, requirements and procedure for renewal of accreditation as well as post qualifications, among others, hereto attached as "Annex A" and made an integral part of this Resolution.
