Dismissing the Complaint Against Retired Justice Dante O. Tinga
On July 5, 2011, the Supreme Court of the Philippines issued a resolution dismissing the complaint against retired Justice Dante O. Tinga, filed by Engr. Ernesto G. Bautista. The dismissal was based on the finding of "utter lack of merit" in the complaint, and the fact that Justice Tinga had already retired. Please take notice that the Court en banc issued a Resolution dated July 5, 2011, which reads as follows:
"A.M. No. 10-5-1-SC (Re: Order of the Office of Ombudsman Dismissing the Case of Engr. Ernesto G. Bautista against [Ret.] Justice Dante O. Tinga, et al. and Referring the Same to the Supreme Court for Appropriate Action). — The Court Resolved to DISMISS the complaint against Justice Dante O. Tinga for utter lack of merit and considering that Justice Tinga is already retired." Carpio and Velasco, Jr., JJ., no part. (adv59) AcHCED
