Deferment of the Implementation of the Third Phase of the Revised Fees and Charges under Memorandum Circular No. 12-2013

WHEREAS, pursuant to DOF Administrative Order No. 31, Series of 2012 and DOF-DBM-NEDA Joint Circular No. 1-2013 dated 30 January 2013, the MTRCB promulgated Memorandum Circular No. 12-2013, prescribing a revised schedule of fees and charges collected by the MTRCB in the exercise of its mandate under P.D. 1986;
WHEREAS, in order to cushion stakeholders vis-Ã -vis the increase, the implementation of the revised MTRCB schedule of fees and charges was divided into three phases such that the first and second phases were implemented on 01 January 2014 and 01 July 2014, respectively; on the other hand, the third phase of the increase was made effective for 01 January 2015;
WHEREAS, various stakeholders of the movie and television industries have expressed that the gaps between the abovementioned phases were rather too close, and the implementation of the third phase comes at a time when they have not yet fully adjusted to the increase;
WHEREAS, it is also part of the Board's mandate to assist the movie and television industries when possible, and it finds that the relaxation at this juncture of the effectivity of the third phase is justified, and may even stimulate more activity in the said industries;
NOW, THEREFORE, pursuant to the Board's power under Section 3 (a) of P.D. 1986 to promulgate such rules and regulations as are necessary or proper for the implementation and accomplishment of the purposes and objectives of P.D. 1986, and after taking into consideration the above considerations, the Board hereby resolved, as follows:
a) defer the implementation of the third phase of the revised schedule of fees and charges, under the Memorandum Circular No. 12-2013, originally due for implementation on 01 January 2015 until 30 June 2015; and
b) subject to the above, but without prejudice to such other period as may hereinafter be determined by the Board, the rate of fees and charges to be collected beginning 01 January 2015 shall then follow the present fees and charges which went into effect 01 July 2014.
APPROVED, by the Movie and Television Review and Classification Board, in a meeting called for the purpose, on 22 October 2014.
